MINUTES
Motion by K -oley and seconded by D Feltovic to accept the
minutes of the October 5 1994 meeting as amended
OLD BUSINESS
Lot 15 (#21) Carriage Chase - Amended Order of Conditions
The Commission discussed the amendment and signed the Amended
Order of Conditions which had been voted upon at a previous
meeting
Lot 5 Sullivan- Discussion
J Lynch and Julie Parrino inspected the site J Lynch drafted
proposed recommendations for dealing with the site Building
material within slope that is not stabilized Violation of
conditions #22 29 & 35 Jim Grifoni wants specific details of
what needs to be done The Commission discussed recommendations
of a fining s1stem if work is not complied with in certain time
frame Jim Grifoni claimed he will conduct work as soon as
possible A group site visit will occur on Saturday October 22
1994 at 8 00 A M This matter is continued to the next agenda
November 2 1994

1780 Osgood Street - Certificate of Compliance & Bond Release

Land survey in compliance and plans in file Motion by A Manzi
to issue a Certificate of Compliance pending a final inspection
by Conservaticn Agent seconded by R Mansour Vote Unanimous

Compliances and Bond Releases

Curt Young of Wetlands Preservation, Inc was present and
requested compliance and bond release The commission stated
that a site % isit and as-built was needed G Reich suggested

that this request be reviewed when proper documentation is
supplied by applicant No action
So Bradford Rd Lots 23 24 25 26A & 28A 242-591
Curt Young of Wetlands Preservation Inc was present and
requested compliance and bond release The commission stated
that a site visit and as-built was needed No action
Blue Ridge Road 242-651
Curt Young of Wetlands Preservation Inc was present and
requested compliance and bond release The commission stated that
a site visit and as-built was needed No action
Appleton Street, Hitching Post Road - Certificate of Compliance
and Bond Release 242-712 and 242-429
Curt Young of Wetlands Preservation Inc is present requesting a
bond release and compliance on DEP #242-429 DEP #242-429 is
bonded for $15 000 He is requesting that $10 000 be released
and $5 000 be applied to the Order of Conditions DEP #242-712
Bond The detention pond and enforcement orders are completed
Motion by A Manzi to issue compliance and bond release of
$10 000 for DES #242-429 and apply the remaining $5 000 to DEP
#242-712 seconded by J Lynch Vote Unanimous
Lot 146 Blue Ridge Road - Certificate of Compliance and Bond
Release 242-674
The applicant was present and requested certificate of compliance
and a bond release pending a final inspection Motion by G
Reich seconded by A Manzi to issue certificate of compliance
pending a final inspection seconded by A Manzi Vote
Unanimous
Sewer Hookup Discussion
George Perna Director of Public Works (DPW) was present and
stated that 60 houses will need to hook up to sewer Ten houses
might be within wetland 3urisdiction It would be very lengthy
for each individual to file with the Conservation Commission
Mr Perna would like suggestions for the Commission in order to
make the process easier The public works department will
oversee this p=o3ect R Mansour suggested that the DPW file a
Notice of Intent for all lots affected and representing all
parties
Watershed Bylaw Discussion
George Perna Director of Public Works (DPW) was present and
discussed basic concepts of the Watershed Bylaw K Foley
questioned how pre-existing businesses would be affected G
Reich addresses previous concerns over takings J Lynch would
like to see slopes incorporated into the Watershed Bylaw

Foxwood Discussion - 242-683
Mr Steven Stapinski was present and addressed the Commission
He stated that the Planning Board has given permission to extend
150 feet of pavement into Phase III Swales and detention pond
areas in Phases I and II stabilized Revised construction
sequence also requested G Reich and A Manzi claimed site was
very stable during rainstorm weeks ago Motion by K Foley for
modification to allow paving into Phase III and accept sequence
revision, seconded D Feltovic Vote Unanimous
Lots 3._ 4. 5 Great Pond Road and Lots 1 & 2 Marbleridge-
Amendment to Order of Conditions. T Laudani. 242-696
Thomas Laudani was present and addressed the Commission The
Order of Conditions which was approved at the September 7 1994
NACC meeting was different from those issued September 19 1994
Condition 25 was rewritten to incorporate the need for a water
samples before during and after construction The bond to be
posted is $15 000 ($3 000 per lot $6 000 for crossing ) These
conditions apply to lots 3 4, and 5 only Motion by G Reich to
issue amendment as written seconded by J Lynch Vote

Lot 7 Old Cart Way - Notice - Continued from October 5 1994
The Commission received a letter from Mr Maus to request
continuance un-il the Commission's next meeting Abutters were
present and were concerned with the request for a continuance
Mr Ron Pica claimed that problems with a covenant restrictions
might force the house to be set back further Mr Pica asked
that this matter be continued to the hearing in four weeks
Motion by J Lynch to close the public hearing and issue a
decision within 21 days seconded by K Foley as applicant has
had sufficient time to correct plans and documentation
Vote 4-1-1 G Reich opposed and R Mansour abstained
Lots 1-6 (#989. Salem Street - Notice - Continued from 1OZ05/94
Steve Stapinsk_ was present and addressed the Commission A site
walk was conducted on Saturday October 15, 1994 Modifications
have been made on a new plan submitted to the Commission A
stone wall wil_ be added to segregate the lawn and wetland of Mr
Grady an abutter Steve Stapinski walked the site Mr
Halloran an abutter addressed his water concerns Mr Halloran
will be tying into the sewer and will be incorporated under this
file Drainage calculations will be conducted by an outside
contractor Motion by J Lynch to continue this public hearing
in to November 2 in order to await drainage calcs seconded by
A Manzi Vote Unanimous

37 Anne Road, Map 37B, Lot 0053 (242- ) - Notice - Continued
from 10/05/94
Mr Ron Pica was present and appeared before the Commission The
project includes a covered bridge over an existing crossing A
Manzi and Susan Ford inspected the site and agreed with wetland
delineation A Waiver Request is required for this project
Notice of Intent should have the Waiver Request The applicant
needs to fill out the Waiver Request as soon as possible Motion
by K Foley to close the public hearing and issue a decision
within 21 days of receipt of the Waiver Request, seconded by D
Feltovic Vote Unanimous
Jerad Place Phase III Sunset Rock Road (242- ) - Notice of
Intent
Thomas Neve was present and appeared before the Commission He
is representing the applicant Robert Januscz Construction of
Sunset Road and Lots 1 2 12 13 14 15, 16 & 18 within buffer
zone Extension off of Candlestick Road Robert Januscz
purchased land from Miller PRD approved by Planning 900-foot
road with cul-de-sac Bordering vegetated wetlands Property
Lot 17 is open space area Sizing of septic systems are
permanent 30 X 70 envelopes of houses that might include decks
Ponds #3 and #2 constructed for BMP's Drainage calcs reviewed
by Bill Merciak Erosion controls will encapture the whole site
A site walk wi_1 be conducted Motion by J Lynch to continue to
next meeting, November 2 1994 seconded by G Reich
Vote 5-0-1 A Manzi abstained
Rte 114, Turnpike Street (242-715) - Notice of Intent
Steve Stapinski was present and appeared before the Commission
presenting plans for a single family home 780 s f of wetland
will be fille3 for driveway with a 1 350 ' replacement area
Driveway 25 ' f-rom wetland Wetland filled has speckled alder and
canary grass Motion by J Lynch to close the Public Hearing
and issue a decision in 21 days seconded by D Feltovic
Vote 4-0-1 R Mansour abstained
Lot B - Summer Street ,(242-717) - Notice of Intent
Steve Stapinski was present and appeared before the Commission
Single family home within buffer zone Lot adjacent to Foxwood
(partly open space) Town water will be connected into home, 53 '
from wetland no wetland alteration Motion by K Foley to close
the public hearing and issue a decision in 21 days seconded by
D Feltovic Jote Unanimous
Lots 1-14 Hidden Pond Road (Road A) (242- ) - Notice of Intent
Thomas Neve was present and appeared before the Commission Mr
Neve represents David Kindred The request is for a subdivision
roadway to serve 14 lots (13 new homes) The roadway will cross

a brook. Existing culvert is present. The property was
originally owned by Love's Farm off of Duncan Street. Hidden
Pond Road is off of Wintergreen. Existing culvert at wetland
crossing will be replaced by box culvert. 261 wide road with
gravel shoulders. Farm will be kept in a covenant and 6,0-65%
land set aside for open space. Common driveway for lots 5 and 6
around wetland will be 10-151 away from wetland. Altering 1, 110
s. f. , replacing 1, 265 s. f. Separate Notice of Intent will be
needed for lots. Abutters Martineaus were present they have hired
a firm to deal with water problems. Abutters Gary and Susan
Wieman were also present, they questioned open space and what
will happen to it. Anne Barbagallo, abutter to Lots 5 & 6
concerned with slope of her yard and possible water problems. A
site visit is required. Motion by K. Foley to continue to next
meeting, seconted by D. Feltovic. Vote: Unanimous.
Lot 7 Old Cart Way
Mr. Maus appeared before the Commission to discuss 7 Old Cart
Way. The public hearing was closed earlier in the evening. Mr.
Maus asked for reconsideration. After repeated requests, G.
Reich made a Motion to re-open the public hearing on November 2 ,
1994 , the Motion failed for a lack of a second.
The meeting adjourned at 11: 20 P.M.
