MINUTES:
Motion by K. Foley and seconded by B. Varoutsos to accept the
minutes of the October 19, 1994 meeting as written.
OLD BUSINESS:
.Lot 5.Sullivan - Discussion
The Commission issued a violation against Mr. Griffoni and a site
visit detailed the work that was needed in order to bring the site
to full compliance. Julie and Susan conducted the final site visit
and noted completion of work. Motion to issue a violation by J.
Lynch, seconded by K. Foley.
NEW BUSINESS:
Woodland Estates
Mr. Cormier and his son were present for discussion. J. Lynch noted
that he saw work being conducted at the site without erosion
controls in place. Susan and Julie visited the site on October 27,
1994 and discovered work taking place near detention pond without
erosion controls in place. Susan prepared an Enforcement Order and
delivered it on October 28, 1994 with the North Andover Police
Department. Upon deliverance, Susan noted that some erosion
controls had been put in place. Silt fence near the detention pond
had been installed however haybales need to be in place also. Susan
allowed for the continuation of work for certain sections of the
project. Mr. Cormier claimed silt fence and haybales will be
properly installed and he never had intentions to violate the
conditions. Discussion of past violation in regards to a wetland
crossing. Motion by George Reich to issue a violation and $100. 00
fine, seconded by J. Lynch. The power to lift the Enforcement Order
has been given to the administrators after an inspection of the
site.
Meadowood III - Modification
Steve Stapinski presented new plans indicating the change of grade
to the road. Bob Mansour had visited the site and claimed that the
change would benefit the site. George Perna from DPW was also in
favor of the change. Joe Lynch motioned to accept the modification,
seconded by Kevin Foley. Unanimous.

Lot 1 Old Vxllage (242-659)
Ben Osgood Jr was present to request a partial bond release As-
builts for the lot have not been submitted yet Trees have been
planted between the house and wetland Julie Parrino conducted a
site visit of the lot George Reich motioned to reduce the bond by
$2 000 seconded by K Foley Unanimous
Lot 31A Equestrian - Certificate of Compliance
Shawn Slattery present for discussion There were three file
numbers on this lot 242-296 242-257 and 242-309 The three files
pertained to the subdivision individual lot and common driveway
Certified Engineer Letters were available for 1257 ' and 1309 ' The
applicant needs to check his titles clear the confusion over the
three file numbers that he was not aware of and submit a P E
letter for file 242-296 in order to receive a compliance
Blue Ridge Road Extention - Compliance
No-one present
Lot A Foster St
Ben Osgood Jr present for discussion This public hearing has been
continued for sejeral weeks Tom Neve has been hired to finish the
construction of the lot and new plans will be submitted Re-
notification of abutters and re-advertisement will take place and
applicant has asked that the public hearing be continued to the
December 7 1994 meeting Joe Lynch motioned to continue the
meeting to Dec 7 , 1994 seconded by K Foley Unanimous
Channel Building Company
Tom Neve present for discussion Tom Neve explained how the
drainage was deficient for this lot because the pond located on
the southerly end of the property was built smaller than required
It fall 2 0 CFS short of providing mitigation for the 100-yr storm
event Does not pose significant threat to ad3acent properties
Proposes installing a 7 5" orifice into the 15" reinforced concrete
culvert outlet of the pond establishing an outlet invert of
237 78 ' Joe Lynch motions to issue a Certificate of Compliance as
it stands with -he addition of the construction of a 7 5" orifice,
seconded by K Foley 3 0 1 G Reich abstained Site visit will be
conducted upon completion of orifice

Tom Neve present Site walk conducted on October 29, 1994 K Foley
motioned to close the public hearing and issue a decision within 21
days seconded J Lynch Unanimous
Lots 1-14 Hidden Pond (Cont from 10/19/94)
Tom Neve present representing Flintlock Realty Trust Question
arose of the right to trespass on the land The person leasing the
property caused some previous problems with allowing people to
enter onto the property Martha Love sent in a letter giving
permission to enter the property however the leaser did not The
situation has been cleared and full access to enter upon property
has been granted Tom Neve reviewed the intentions and designs of
the 14 lot subdivision He also discussed reconstructing the
intersection at Foster St BMP sedimentation ponds will be
installed near ci-lvert at crossing and also at the end of the cul-
de-sac Waivers needed for the construction of the roadway within
25 ft of the wetland Mr Neve willing to put retaining wall
around the wetland near the cul-de-sac Discussion of drainage
calculations and their validity Joe Lynch concerned about moving
the retaining wall closer to the road at the first belly of the
wetland on the roadway J Lynch also addressed his concerns over
the rapid flow of water moving through the culvert Joe addressed
the water will f_ow over the roadway according to the information
on the FEMA maps Tom Neve is awaiting FEMA information to address
these questions
Dave Sharp an abutter who lives on Wintergreen expressed his
concerns over future water problems and questioned the validity and
accuracy of runoff calculations Ed Albert an abutter who lives on
Wintergreen expressed that he does not believe the drainage
calculations and that the water levels vary greatly over the years
He suggests a 36 or 48 month study be conducted to view changes in
water depth and flow Tom Jonka is the closest abutter to the
pro]ect and he claims that there is heavy water flow and ponding in
spring Suggests that the roadway into the subdivision come of off
Duncan Drive He claims that the wetlands will be protected near
Foster St Mr Neve claimed that a red-maple swamp wetland would be
crossed if roadway came from Duncan Also there is an easement
through the farm that would not allow for a subdivision roadway
Motion by George Reich to continue hearing till the next
meeting seconded by B Varoutsos FEMA maps and pre and post
runoff calculaticns will hopefully be submitted at the next meeting
along with the shoulder revisions to the roadway Plan submitted to
the Planning board in regards to the 2 acre lots will also be
submitted
Lot 1 Johnson (1208 Turnpike)
John Berube present for the open of the public hearing for the SFH
The exact address of the lot was discussed Henry Fink an abutter
to the lot claims the plans are not in agreement with the

advertised lot The lot has been subdivided Septic is 85 ft from
wetland Wetlands to the left of the proposed house Representative
needs to re-advertize the lot as Lot I Johnson instead of 1208
Turnpike Also, additional resource areas need to be plotted on the
plan Motion by K Foley to continue hearing to the next meeting
seconded by J Lynch Unanimous A site walk will be conducted
Lot 3 Candlestick
Mark Rae was present however his engineer was not present
therefore a continuance was requested Hearing opened and motion by
J Lynch to continue to the next meeting seconded by K Foley

Public hearing opened for discussion of the construction of an in-
ground pool with the Buffer Zone Receipts of notification will be
brought to Town Hall in the morning because the applicant misplaced
them George questioned what would happen if applicant hit water
during construction Motion by K Foley to close the public hearing
and issue a decision within 21 days seconded by J Lynch
