OLD BUSINESS
Lot 31A Equestrian, Files 242-296 242-257 & 242-309, COC
Scott Giles present Submitted certified letter for file 242-296
Mr Giles confused why the additional letter was needed for this
particular file Letters had already been sent in for files 242-257
and 242-309 George Reich motioned to issue partial compliances for
the three files in regards to lot 31A Equestrian contingent upon a
satisfactory site visit seconded by K Foley
NEW BUSINESS
Lot 1 Ingalls - Discussion
Scott Giles present to represent applicant Enforcement Order was
previously issued because of the concern over the discrepancy in
elevation between the neighboring lot and lot 1 Ingalls Mr Giles
claims there is no base flood elevation tied to this elevation The
wrong plan was used during the Commission site walk The correct
plan shows the ccmpensatory wetland replication area and the 100
year flood plain Mr Cassevechia the abutter to the lot is
concerned over potential flooding in his driveway Scott Giles will
submit new plans that will illustrate the location of the grass
swale between the two properties
Lot 38 Lancaster - (242-680) Certificate of Compliance
Scott Giles present representing applicant Lot has been inspected
and is stable Scott Giles submitted land surveyor letter stating
compliance, however, PE letter is needed K Foley motioned to
issue COC upon receipt of letter seconded by D Feltovic 4-0-1 G
Reich abstained
Lot 4 South Cross Road -(242-662) COC
Applicant Pat Murphy present Addressed how the driveway was moved
in order to lessen the removal of trees Wetland crossing for the
construction of the driveway Wetland replication constructed by
Steve Durso The replication area has not gone through the two full
growing seasons therefore only a partial bond release will be
granted Motion by J Lynch to reduce the bond from 6 000 to 3 000
seconded by Bob Mansour Unanimous

Dan Betty present seeking a 10 000 bond release for the completion
of the roadway at Wagon Wheel Estates Motion by Bob Mansour to
release the bond for the roadway seconded by Joe Lynch Unanimous
Nadine Lane - Enforcement Order, Discussion
Discussion transferred to the opening of the public hearing for the
Request for Determination on Nadine Lane

18 Willow Street Nadine Lane
Phil Christianson and Mr Scott from Scott Construction present
Determination is for the 437 ' feet of roadway within the BZ
Referenced the file 242-676 that addressed the wetland replication
line that was determined in the past Work was conducted outside
the 100 foot BZ of the determined wetland line The wetland line
extending off of the Meadowood property has not been determined
therefore additional areas may be necessary to be filed under the
Notice of Intent Stripping of loam has been conducted and an
enforcement order has been placed on the subdivision to stop work
until all resource areas are clearly defined Erosions controls
have been installed which outline the whole property K Foley
motioned to issue a positive determination for the construction of
a portion of the roadway seconded by J Lynch Unanimous

Jim Bourgeois present to represent the applicant from Chem-Lawn
Applicant wants to expand on the parking lot in back of the
building because of the seasonal parking problem Mr Bourgeois
feels the area is not subject to Conservation jurisdiction Wetland
flagged by Steve Durso The Commission asked the rep and applicant
if they can hold their decision until the next meeting so that a
site walk could be conducted K Foley motioned to continue the
hearing until Dec 7, 1994 , seconded by J Lynch Unanimous

Letter submitted by applicant to continue the public hearing K
Foley motioned to continue the hearing until the next meeting
seconded by Deb Feltovic Unanimous
Lot 1-14 Hidden Pond - (242-718)
Jim Bourgeois present representing Flintlock Realty There appears
to be some discrepancy between the FEMA map flood calculations and
those calculated by Neve Associates This continues to be explored
The project has cone before Planning which allowed them to work
with DPW on road width revisions J Lynch motioned to continue the
hearing until Dec 7 seconded by Deb Feltovic Unanimous
Lot 1 Johnson St - (242-722)
John Berube present representing applicant He presented the
revised plans requested by the Commission Wetland flags marked on
new plans along with the house dimensions A plant species list was
also submitted Henry Fink an abutter addressed that abutters were
not identified on the plans and questioned if the new plans had
been submitted to the office prior to the continued hearing
G Reich stated the revisions made on the plans were minor and done
at the Commissions request Suitable plans were available at Town
Hall at time of Notice J Lynch motioned to close the public
hearing and issue a decision within 21 days, seconded by Bob
Mansour Unanimous
Lot 3 Candlestick
Phil Christianson present to represent the applicant The NOI is
for the construction of a SFH in the Buffer Zone The septic was r
approved by Health under a variance because of its location 79 ,
from the wetland one corner of the house is 32 ' from the wetland
Waiver request needs to be submitted J Lynch motioned to continue
the public hearing until Dec 7 seconded by Deb Feltovic A site
visit will be conducted
Nadine Subdivision
Phil Christianson present Hay bale line that exists to this date
is in accordance with this filing not that of the Determination
The NOI is for the construction of houses on lots 1 2, 3 , 4 5
and 16 Questions of where the wetland boundaries end need to be
addressed because additional house lots might need to be filed

along with this NOI Phil concerned about flagging wetlands on
other abutters property A site walk needs to be conducted along
with the additional wetland flagging by a professional The
standing water or the site is 4 ft below the grade George Reich
motioned to lift the Enforcement Order, seconded by Bob Mansour
Motion by J Lynch to continue until the next meeting seconded by
D Feltovic Unan_mous Work can be conducted ONLY on lots 12 13
14 and 15
K Foley motioned to adjourn the meeting at 9 45 PM, seconded by G
Reich
