Pledge of Allegiance Chair Albert Manzi Jr. will only cast a vote in the event of a tie, in accordance with Robert's Rules of Order Newly Revised 12th ed.,§4:56 Acceptance of Minutes • A motion to accept the minutes of May 19, 2025, as drafted was made by Mr. Mabon, seconded by Mr.White. • Vote 6-0, Unanimous. • A motion to accept the minutes of May 28,2025,as drafted was made by Mr.White, seconded by Mr.Mustain. • Vote 6-0, Unanimous. Request for Determination of Applicability(RDA) 311 Stevens Street(Yazicioglu) • The Administrator explained the project involves full-depth reclamation of the driveway with grading and compaction. Most work remains within the existing footprint, except for two areas at the neck to be widened for better circulation. This widening is outside the Buffer Zone. A 2"binder and 1.5" finish coat is proposed. All work is outside the 50-foot NBZ. Erosion controls are shown along the driveway edge. The existing concrete culvert at the driveway entrance appears sound and within the Town ROW. • 7:05 p.m., Mr. Bohenek joins the meeting. • Mr. Manzi confirmed the scope of work and asked about base material and project duration. • Tolga Yazicioglu,the Applicant said the contractor plans to use gravel, with excavation and compaction in one day and paving shortly after. • Mr. Manzi noted potential material migration and recommended limiting work to dry weather. • 7:07 p.m., Mr. McDonough joins the meeting. • The Administrator recommended a Negative#3 Determination with conditions: erosion controls,pre- and post-construction inspections, and dry weather work. • A motion to close the hearing and issue the Negative Determination#3 with conditions as recommended and discussed was made by Mr. Mabon, seconded by Mr. Mustain. • Vote 5-0-1, (In Favor: White, Mabon, Bohenek, Valentino,Mustain,Abstained: McDonough). Documents Email from alek&chonrise i eeri ®c requesting a continuance until 06125125 General/New/Old Business 242-1746,Request for Extension,495 Main Street,Recreation Complex(Town of North Andover) • The Administrator stated the Order of Conditions (OOC), issued in April 2019, covers improvements at North Andover Middle School, including synthetic turf fields, recreation areas,parking, grading,utilities, and stormwater systems (catch basins,particle separators, infiltration chambers, and turf drainage). The project was delayed due to litigation,now resolved. Since the OOC was not part of the litigation, it remained valid. It also benefited from COVID tolling and the 2024 Mass LEADS Act, extending the expiration date to July 18, 2025. This is the first request for a one-year extension.Under the Bylaw,two one-year extensions are allowed. Per MACC guidance, Orders that received state-level extensions remain eligible for the routine local extension process. Due to increased costs,the project will be completed in three phases. Phase 1 is scheduled for this summer/fall and includes informal recreation space, a multipurpose field, softball field, and associated drainage, all outside the Commission's jurisdiction. The consultant confirmed Phase 1 drainage can be built as a standalone system. Wetland delineation updates will be addressed when funding for Phase 2 is secured. If that work doesn't begin within enough time, a new NOI may be required. Condition#37 of the OOC requires groundwater testing prior to bidding. • Mr. Manzi emphasized that the request is strictly for a one-year extension of the existing Order,no new work is being proposed. • Ms. Valentino noted that if Phase 2 doesn't move forward,the Order could be closed out after Phase 1. • Mr. White confirmed current members, even those not seated at the time of the original filing, can vote on the extension. • Mr. Mustain supported the request, stating that while he has questions on the plans,they're not relevant to the vote before the Commission. • Ms. Valentino agreed,noting the Commission is not being asked to approve the phasing plan,just the extension. • Mr. Bonhenek asked about the Town Meeting vote on bonding. • Mr. Murray said Phase 1 is still moving forward,though that vote may impact Phase 2. • Mr. Manzi added that Phase 2 may require a new NOI,which would open the review process again. • Wayne Gendron, 134 Berkeley Road asked if Phase 1 includes subsurface drainage with filtration. • Mr. Murray confirmed it does,with overflow and infiltration designed per the original approval. • Mr. Gendron also asked if water or PFAS testing would be done. • Mr. Murray stated no testing is planned or required under the current design. • A motion to grant the 1-year extension was made by Mr. McDonough, seconded by Mr. White. • Vote 6-0, Unanimous. Documents 2025-06-11 Conservation Commission Minutes Page 2 of 3 242-1746, Main Street 495 (Rec Complex) OOC, 495 Main Street Rec Plex-Letter to Cons Com Requesting an Extension DEP File Number 242-1746- 5-13-25, North Andover Middle School Conservation Commission Presentation Plans -5-28-25, Recreation Complex Permitting Plans 3-27-19 Small Project NACC #345, 75 Milk Street(Haffners Energy Group) • The Field Inspector and Planner explained the project involves removal and replacement of a damaged 500- gallon propane tank. A small excavator with a 12"bucket will be used to remove the existing tank and install the new one,with clean sand used for backfill. The tank is 38 feet from the wetland and outside the 25-foot No Disturb Zone. Conservation Staff verified all distances in the field. The area is flat with a gentle rise near the tree line and levels off before the BVW, so erosion controls are not recommended. She recommends approval under Category"L,"with conditions including off-site disposal of excess soil and pre- and post- construction inspections. • The contractor was not present. • Ms. Valentino asked for clarification on the tank damage and confirmed it is not leaking. • The Field Inspector stated she is unsure of the specific issue but confirmed the tank is shut off and not currently in use. • Mr. Mabon raised a concern about the underground piping from the tank to the house,noting that piping can fail and should be inspected. If pipe replacement is needed, the contractor must notify Conservation Staff to ensure proper handling. He noted such replacements are often routine preventative maintenance. • A motion to accept and approve this as a Small Project"L"with conditions as recommended was made by Mr. McDonough, seconded by Mr. Mustain. • Vote 6-0, Unanimous. Documents IMG_4505, IMG 4530, Small Project Application with Supporting Materials 05 2125 Decision 242-1910, 575 Osgood Street(Edgewood Retirement Community) • The Administrator reviewed the draft Order of Conditions. • Condition#3 8I will require wetland markers to be secured to posts if a mature tree is not available. Condition #65H will be revised to remove the reference to"high school campus." Condition#30 will clarify that any future wetland crossing will require a new NOI. A$2,000 performance bond will be required. • A motion to adopt the Order of Conditions as drafted and amended was made by Mr. McDonough, seconded by Mr. Mustain. • Vote 6-0, Unanimous.
