MINUTES
Motion by J Leeman and seconded by B Mansour to adopt the minutes
of December 15, 1993
OLD BUSINESS
#940 Great Pond Road (#242-656) - Discussion
No show no action
1600 Great Pond Rd - Violation
R Doucette provided an overview of the violation The homeowner
conducted extensive landscaping and repaving of a driveway on his
property The work was done immediately adjacent to a wetland
and Lake Cochichewick without permits A preliminary plan was
presented The bordering vegetated wetland and the edge of work
must be shown on the plan A Notice of Intent will be filed
North Andover Estates (#242-585,600,675) Discussion
Jack Mallett and John Nolan Tom Frangos, Phil Christiansen Phil
Catone and Joe O'Brien appeared R Doucette provided an overview
of the stabilization process Jack Mallett discussed the three
page addendum to the Enforcement Order Some minor erosion
controls not installed due to frost but the majority has been
implemented Phil Christiansen submitted as-built plans for
detention basins and also a proposed stone filter at the outlet
of the large detention pond Also proposed to remove some silt
fence to allow runoff to flow through woods and not flow down
slope along the silt fence A stone filter berm is also proposed
in the smaller detention basin
Richard Doucette recommended allowing work to continue (utility
trenches and 2 new foundations) after the installation of the
stone dams Paul Tariot motioned and Richard Milliard seconded
to lift the en=orcement order and to allow that work specified in
the construction sequence, after the installation of the stone
dams 4 yes votes 0 no votes Robert Mansour and Richard
Milliard abstained

P Tariot motioned J Leeman seconded, to close the public hearing
and take no ac-lon against the bond

China Blossom - Violation
Richard Doucette provided an overview Mr Chu, Sr and
Mr Chu Jr appeared and discussed the sewage release Their
contractor did not respond in a timely fashion The pump is now
working but will need additional work There was discussion of
the grease trap and its maintenance Another grease trap is
needed It will be done in the Spring

S Giles presented an as-built and letter requesting a Certificate
of Compliance John Leeman motioned and Robert Mansour seconded
to grant the compliance Vote was unanimous in favor of the
motion
Lot 26A So Bradford St (#242-622) - Compliance
S Giles presented plans and letter requesting a Certificate of
Compliance Kevin Foley motioned and Paul Tariot seconded to
grant the compliance Vote was unanimous in favor of the motion
Woodland Estates (#242-634) - Discussion
B Bergeron appeared Discussion ensued regarding Enforcement
Order to restore stream bank The applicant would like to cut
trees now and restore stream bank later Discussion of bridge
and tree cutting Kevin Foley motioned and Paul Tariot seconded
to modify the Enforcement Order to allow tree cutting up to the
second crossing No work to be allowed past the stream Vote
unanimous in favor of motion

Steve Stapinski and Curt Young spoke about erosion and
sedimentation control Steve Stapinski discussed self-imposed
restrictions pertaining to erosion control, construction and
building occupancy No more than twelve (12) sites under active
construction Discussion of phasing Discussion of wetland

changes from rydrologic changes as a result of the project
Kevin Foley asked about Department of Environmental Management
(DEM) concerns Paul Tariot asked about DEM concerns, changes to
hydrology, and phasing Richard Doucette asked about changes to
the lateral extension of wetlands erosion controls and how they
comply with draft erosion control policy Doucette stated that
the coordinator needs to have the authority to implement erosion
controls required, and asked if the applicant had previously
worked on a similar hillside project Three examples given
Doucette discussed slope stabilization techniques Also
discussed stabilization and phasing Paul Tariot motioned to
close the public hearing and issue the Order of Conditions within
21 days Seconded by Kevin Foley Vote unanimous 1n favor of
motion

Scott Giles submitted revised plans for a single family home
close to the wetland Kevin Foley motioned to close the public
hearing and issue the Order of Conditions Paul Tariot seconded
Vote unanimous in favor of motion
Lot 1 Berry St , Lot 2 Turnpike - Determination
Patrick Garner presented a plan showing a wetland delineation
This plan included input from the Administrator Discussion of
wording in Determination of Applicability so that the NACC can
retain the right to verify the delineation when the NOI is filed
Paul Tariot motioned to close the public hearing and issue a
Positive Determination of Applicability Richard Milliard
seconded Vote unanimous in favor of motion

Paul Tariot motioned to grant the Partial Certificate of
Compliance Zohn Leeman seconded Vote unanimous in favor of
motion
