HomeMy WebLinkAbout2006-01-25 Conservation Commission Minutes Conservation Commission Meeting Minutes January 25, 2006 Members Present: Albert P Manzi, Jr , Vice Chairman, John J Mabon, and Joseph W Lynch, Jr, Sean F McDonough, and Louis A Napoli Member Absent: Scott L Masse, Chairman, and Deborah Feltovic Staff Members Present: Alison E McKay, Conservation Administrator, Pamela A. Merrill, Conservation Associate, and Donna M Wedge, Conservation Secretary Meeting came to Order: 7:19 P. M. Quorum Present. Mr. Manzi resided as Chair in absence of Mr. Masse. Pledge of Allegiance General Business 242-1240, 67 Surrey Drive (Smolap-)(Merrimack Emineerinp,Services, Inc.) The applicant Mr David Smolag was present Ms Merrill stated that the Order of Conditions was issued in May of 2004 for the construction of a garage addition within the Buffer Zone to a BVW Norse Environmental was designated as the project's monitor and reports were found in the file An inspection was conducted on January 18, 2006 All areas were stable with grass with no sign of erosion The Order required the applicant to plant 8 High Bush Blueberry shrubs as part of the mitigation for maintaining portions of the 25-foot No-Disturbance These were installed and appeared to be healthy with no sign of stress or dieback The wetland markers were placed in between High Bush Blueberry shrubs The as built plan was consistent with the approved plan Measurements were taken to verify compliance A motion to issue the COC and release the bond was made by Mr Mahon, seconded by Mr Lynch Unanimous Vote to Rescind Filing Fee Appropriation-MACC Handbooks Mr Manzi questioned if the handbooks were for all Conservation Commissions throughout the State or just for North Andover? Mr McDonough offered the same question Ms McKay referred to Epsilon Associates letter Mr Lynch stated that former employees of the Town now worked for Epsilon Associates and requested additional information from the ethics Commission Mr Manzi suggested tabling the discussion until the next meeting Mr McDonough suggested contacting the State Ethics Commission A motion to continue to the February 8, 2006 meeting was made by Mr Mahon, seconded by Mr Lynch Unanimous Enforcement Order Ratification Flagship Drive Dutton & Garfield (Steve Foster)(The Neve-Morin Group, Inc.) Ms Merrill stated that the Enforcement Order was for explorative work only to determine if there was a clasped pipe under ground She noted that there was extensive flooding in this location The DPW had made an attempt to clean the catch basin during the summer but had difficultly due to what appeared to be a blockage or collapsed portion of the pipe Mr Manzi stated there was very high ground water in the area and indicated that proper dewatering 1 measures should be taken He specifically stated that there should be a dewatering tank ready to do since the existing detention pond was is already flooded Mr Lynch stated that this area was within the floodplam Ms Merrill stated that Tim Willett, Water& Sewer superintendent stated that the headwall was probably not built correctly Ms Memll stated that erosion controls, environmental monitor, and dewatenng would be required Mr Lynch stated that Steve Foster of Dutton & Garfield would do a good job on site Mr Manzi stated that the applicant would have to file a Notice of Intent for work other than exploratory digging A motion to ratify the EO was made by Mr Mabon, seconded by Mr Napoli Joe Lynch opposed Vote 3-1. Updates 242-949, 44 Mill Road, (Nestor)(New England Engineering Services, Inc.) Ms Merrill stated that the applicant had a pipe installed under the driveway to divert the water from the runoff down the driveway The driveway grade was not built correctly when constructed The retaining wall would have to be fixed in the springtime Ms Merrill stated she had been out there Saturday, Sunday and Monday and observed no icing on the roadway She indicated however, that there was additional work to be done to fix the problem on the site Mr Manzi stated that there are no discussions on fines Mr Lynch stated that this area had high ground water in the area of Clay Pit Hill and when the filing was originally presented, the abutters stated that there would be problems with the driveway The applicant has complied with the repairs for now The Commission indicated that they might consider fines at a later date Open Space Rules & Regulations Mr Mabon indicated that the document presented was a working draft and was similar to what was discussed a year and a half go but not officially adopted as no agreement had been made to the hunting portion of the document Mr Mabon presented the draft as written The Mr Manzi asked about the status of Cullen property acquisition before the Community Preservation Committee Mr Mabon stated that the CPC requested more information before they would place it on the Town Meeting Warrant Public Hearings: 8:05 P. M. 242-1208, Foster Farm Elementary School (North Andover Buildinp-Committee)(DiNisco Design)(cont,from 12/14/05) No one was present A motion to continue to the February 22, 2006 meeting was made by Mr Mabon, seconded by Mr Lynch Unanimous 242-1345, Lot 1 Great Pond Road (Great Pond Road Realty Trust)(New England Engineering Services, Inc.)(cont. from 1/11/06)(Reguest to cont. to 2/8/06) No one was present Ms McKay stated that the drainage escrow account had been set up and Lisa Eggleston had submitted her review (included in packets) The plans however had not yet been revised to reflect the upgradient wetland and other revisions previously The applicant was requesting a continuance to the meeting of 2/8/06 A motion to continue to the February 8, 2006 meeting was made by Mr Mabon, seconded by Mr Lynch Unanimous 2 Decisions 242-1340, 1171 Turnpike Street-Uncle Bob's Self Storage (Sovran Acquisition Partnership) (New England Engineering Services, Inc.) Ms Merrill discussed the conditions which included installation of White Birch Pines upslope as a visual barrier, invasive species to be removed by hand on an annual basis, an O & M plan followed yearly for cleaning of the catch basins, monitoring by an engineer in perpetuity, 2-yr monitoring for the required plantings, Environmental Monitor, Pre-Construction meeting, Wetland Markers, a$7, 000 bond, and restoration activities A motion to accept the Order of Conditions as drafted was made by Mr Lynch, seconded by Mr Napoli Unanimous 242-1333,Waverly Road/Turnpike Street-Walueen' s (Mark Investments, Inc.)(Bohler Engineering, P. C.) Ms McKay discussed the draft conditions which included a bond in the amount of$50,000, a pre-construction meeting prior to construction, 100 haybales, 40 additional haybales on site, sequencing of stormwater management installation, environmental monitoring on site all the times, sequencing of stormwater installation, reports of stormwater facilities submitted to the Conservation Department, dewatenng, wetland markers The Conservation Commission stated they would choose the environmental monitor for the site Mr Lynch added meeting the stormwater requirements of recharge off site and ground water to an existing culvert by Boston Market to best comply with the stormwater standards, 300 haybales &trenched silt fence around the entire site to keep the silt from getting into the groundwater and that the O & M plan be complied with in perpetuity In addition, a plantings plan, a stormwater management plan, 4 signs indicating No Salt/No Snow Stockpiling and the bond amount to be set at$100,000 A motion to accept the Order of Conditions as amended was made by Mr Lynch, seconded by Mr Napoli Unanimous A motion to adjourn the meeting at: 9:30 P. M. was made by Mr. Lynch, seconded by Mr. McDonough. Unanimous. 3
