Conservation Commission Meeting Minutes

Meeting came to Order at: 7:10 P. M. Quorum Present.

No one was present Ms Merrill stated the Order of Conditions was issued in February 2005 for
the replacement of a septic system within riverfront resource area associated to Boston Brook
and the Buffer Zone to a Bordering Vegetated Wetland The applicant was required to remove a
shed that was installed immediately upslope of an adjacent wetland boundary and within the
limits of the floodplam associated with Boston Brook The applicant was required to plant 4 silky
dogwood shrubs where the shed was previously located as compensation for encroachment into
the resource area This condition has been satisfied The six-wetland markers were placed along
the wetland line, as the 25-foot No-Disturbance zone has historically maintained as mowed lawn
All disturbed areas were stable against erosion The as-built plan was determined to be consistent

Louis Napoli A motion to issue the COC and bond release was made by Mr Lynch, seconded

Small Projects Conditions Review
247 Bridges Lane
Ms McKay stated the above ground pool would be between 75-feet to 80-feet away from the
wetland resource areas Leah Basbanes, Associates flagged the wetland line in 2005 Ms McKay
stated the pool has been installed because the lady had come into the office for an hour and half
the building permit was sitting there for over a month so they had to issue the building permit
Mr Bellavance the Director of Community Development Division signed the U form I put some
comments on the U form Scott Masse, Albert Manzi, Joseph Lynch, John Mabon, Sean
McDonough, Louis Napoli No action on this small project

The applicants Mr & Mrs Good was present Ms McKay this is for the replacement of septic
system the wetland line was reviewed and approved The project is 90-feet away from the
wetland resource area Scott Masse, Albert Manzi, Joseph Lynch, John Mabon, Sean
McDonough, Louis Napoli A motion to accept the small project conditions as drafted was made
by Mr Lynch, seconded Mr Manzi Unanimous
24 Gilman Lane
The applicants George and Cheryl Gikas was present Ms Merrill stated this should be small
project I reviewed the wetland line, which was delineated by William Manuell of Wetland&
Land Management, Inc and agreed with the delineation Mr Lynch stated this is work able
project but you would have to file a Notice of Intent Mr Manzi stated this is not a small project
pools are not on the list entitled to enter into small project this would require a filing with the
Conservation Commission. Mrs Gikas stated we only want to put in kidney shaped in ground
pool so our family can enjoy a pool when it is hot instead staying in the house We would even
make the pool smaller if that would work for the Conservation Commission Scott Masse, Albert
Manzi, Joseph Lynch, John Mahon, Sean McDonough, Louis Napoli A motion to deny pools are
not on the list for small projects was made by Mr McDonough, seconded by Mr Lynch

staff The applicant has submitted the request for revised plans and revisions to the drainage

McDonough, Louis Napoli A motion to close and issue a decision within 21 days was made by

Andy Lambert of New England Engineering Services, Inc and Mr Michael Seekamp of
Seekamp Environmental Consulting and Abutter Mr & Mrs Pope of 15 Nutmeg Lane was
present Ms McKay stated DEP comments-Is isolated wetland subject to flooding The area is
not a depressional basin and would not hold at least one-quarter-acre foot of water volume, with
an average depth of 6 inches Mr Seekamp stated there needs to be infiltration dention or may be
a swale to control the run-off to the Popes property Mr Masse stated Mr Seekamp can you send
in a memo of what you are proposing so New England Engineering can have Ben Osgood to take
care of the Popes concerns Mr Lambert stated that if fine we can take care of their concerns of
water run-off to their property from flooding Scott Masse, Albert Manzi, Joseph Lynch, John

Christopher Tymula ofMHF Design Consultants, Inc and Jennifer Vicich of Wetlands
Preservation, Inc was present Ms McKay stated the revised plans and drainage report
submitted to address Lisa Eggleston' s comments Lisa Eggleston' s second round of comments
were received She indicates the project has been redesigned to provide increase on-site filtration
and detention, such that no;increases in peak runoff rates or total runoff volume are projected
Additional test data was also submitted to verify depths to groundwater in the proposed
detention/infiltration areas However, she indicates that although these concerns have been
adequately addressed, she does still have several comments regarding the current drainage design
and analysis including discrepancies in the infiltration rate, inadequate 2 foot separation to
groundwater at the proposed system#2-recommends additional testing at this location to verify
the effectiveness of infiltration, no soil testing was conducted in the vicinity of the proposed
infiltration basins #1 & #2, Questions regarding whether the size of the Stormceptor units would
be adequate, and incorporating/addressing maintenance (mowing) of grass lined drainage swale
and access to stormwater structures in the O & M plan Mr Tymula stated we would be doing
more testing tomorrow soil testing A type soils, also we received Planning Board approval

The applicants Mr & Mrs Greg Swiniarski and Mr & Mrs Edward Swmiarski and William
Dufresne of Merrimack Engineering Services, Inc were present Mr McDonough read the legal
notice Ms McKay stated the filing is for the demolition of an existing single-family dwelling,
the existing single-family dwelling is in a state of disrepair for the construction of a new single-
family, associated driveway, deck, utilities and associated grading and landscaping within the
Buffer Zone to a Bordering Vegetated Wetland A septic system is also proposed but will be
located outside of the Buffer Zone No Disturbance is proposed within the 25-foot No-
Disturbance zone or the 50-foot No-Build zone The erosion controls are proposed around the
project site, as well as a loam/soil stockpiling area to the front of the site A foundation drain is
also proposed to the rear of the proposed home The wetlands are located around the project site
(to the south and east/rear of the proposed work) and were delineated by Norse Environmental
Services in March of this year The wetlands have been reviewed and approved An existing
dilapidated shed is located within the 25-foot No-Disturbance zone Recommend condition to
remove and restore area In addition, portions of the existing gravel driveway are located within
25-foot No-Disturbance zone Recommend removal and restoration of the portions within No-
Disturbance The site is not located within estimated habitat of state listed rare wildlife Existing
tree line not shown, but wooded/densely vegetated area(25-foot no-disturbance is not disturbed)

Proposed barrier to deter future encroachment Still under review by DEP Mr Swiniarski stated
there is a man made pond in the back which people swim in the summer and skate on in the
winter I would not want to lose the view of the pond from back yard Mr McDonough stated the
gravel driveway should have some kind of barriers so there is not encroachment into the 25-foot
No-Disturbance zone, wetland markers, stonewall, fence, plantings Ms McKay stated the
