NELSON, IDIIIEC"I'011 December 8, 1988 Christiansen & Sergi Engineering 160 Summer Street Haverhill, MA 01830 Re: Long Pasture (#242--441) Dear Mr. Christiansen: This letter is in response to your letter dated October 31, 1988 and a follow--up to the discussion at the NACC's meeting of December 7, 1988. The NACC has reviewed the material you have submitted with regards to our concerns about the project. The proposed solution to the protection of the hydrologic connection between wetlands on the site seems reasonable to the NACC. The resolution of the concern relative to the isolated wetland on Lot #11 is not as simple. Admittedly the definition and delineation of isolated land subject to flooding in the wetland regulations (or Policy Memo 85-2) is not straightfoward or easy to follow, But it appears to us that it requires that a one (1) year storm and an assumption of no infiltration in the area in question be used to determine jurisdiction. If this was done (by using an SCS curve number of 98 for say 1 acre of Lot #11) , then it is likely that this area would meet the threshold for jurisdiction. Further, it appears to us that the regulations require use of the 100 -year storm for delineation of this resource area once the threshold test is met. Under this second analysis, a substantial area would be delineated as the isolated land subject to flooding on the site. Based on these questions about the analysis presented, the NACC still main- tains that there is a resource area to be protected on Lot #11, both under State Law, as well as the Town Bylaw. Although the condition imposed by the Planning Board to address this concern may make sense under the policies and regulations, it has not been our policy or practice to defer into the future whether an area is or is not a wetland, and whether it needs to be protected or not. Given that this is not a straightforward item in the wetland regulations, ..we would be interested in reviewing additional guidence from DEQE (if it exists) on how to define this resource area. Notice of Intent submitted by Christiansen & Sergi, Inc. dated October 27, 1987, 116 pages. b. Plans entitled "Proposed Site Grading for Long Pasture", dated August 28, 1987, prepared by Christiansen & Sergi, Inc. c. Letter from Nancy wedge dated 11/8/87. d. Letter from Paul Plisinski dated 11/12/87, FINDINGS: 1. The following wetland resource areas are affected by the proposed work: land under water, Land subject to flooding (isolated and/or bordering) , and bordering vegetated wetland. These resource areasare significant to the interests of the Act and Town Bylaw as. noted above. These resource areas are also significant to the wildlife and recreation interests of the Bylaw. The applicant has not attempted to overcome the signficance of these resource areas to the identified interests. 2. The NACC is in agreement with the applicant's wetland resource descriptions and delineations except as noted below. 3. Area GG is described by the applicant� as an area of "standing water in the spring", but "not a wetland resource area under the regulations." However, photographic evidence provided by abutters and personal observations by members of the NACC indicate that the area subject to flooding is significantly more extensive than shown on the plan, extending perhaps tD the 98 ft. contour. The NACC finds that thismay constitute isolated land subject to flooding as defined in section 10.57 of the regulations. 4. Area EE, EF and DD are described by the applicant as containing wetland vegetative species but do not, according to the applicant, constitute bordering vegetative wetlands (BVW) because of a lack of hydrolic connection to the BVw labeled as area CC. The NACC finds that hydrolic connections do exist between these areas and that areas EE, EF, and DD must be considered as bordering vegetative wetlands. 2 LONG PASTURE 242--441 DECISION: Based on the findings noted above, the NACC denies this project, as proposed, because of inadequate information regarding the wetland resources boundries.
