WHEREAS, the Massachusetts Highway Commission, acting on behalf of the
Commonwealth of Massachusetts,did,under date of May 7, 1913 (Layout No. 1455), and the
Department of Public Works, Division of Highways, acting on behalf of the Commonwealth of
Massachusetts,did,under date of November 18, 1924(Layout No. 2219), lay out and take charge
of as a State highway, a road, in the Town of North Andover, County of Essex,now known as
Turnpike Street(Route 114) and the Department of Public Works,under date of November 18,
1924(Layout No. 2217). layout a road in the Town of North Andover, County of Essex,known as
Andover Street(Route 125),and the Department of Public Works, acting on behalf of the
Commonwealth of Massachusetts,did,under dates of April 9, 1940(Layout No. 3341),July 30,
1946 (Layout No. 3494), March 27, 1974(Layout No. 6072), December 11, 1991 (Layout No.
7061)and the Department of Highways, acting on behalf of the Commonwealth of Massachusetts,
did,under dates of December 15, 2004(Layout No. 7864),February 2,2005 (Layout No. 7863),
October 7, 2005 (Layout No. 7925), and November 15, 2006 (Layout No. 7984), alter the location
of said State highway and the Department of Public Works,under date of November 18, 1924

(Layout No. 2219)layout a road in the Town of North Andover,County of Essex known as
Andover Street(Route 125)and did lay out and take charge of said State highway as altered as
shown on the plans of said State highway on file in the office of the Massachusetts Department of
Transportation, copies of which plans have been filed in the office of the County Commissioners
of said County,or their successors, if any, and in the office of the Town Clerk of said Town of
North Andover; and
WHEREAS, it now appears advisable to make further changes in the location lines of
said State highway and to abandon a portion of said 1974 State highway layout;
NOW, THEREFORE, acting under the provisions of Chapter 6C and Chapter 81 of the
General Laws, as appearing in the Official Edition thereof, and acts in amendment thereof and in
addition thereto, the Massachusetts Department of Transportation adjudges that public necessity
and convenience require that said Department should alter and abandon a portion of the location
of said State highway, and should lay out and take charge of said way, as altered, as hereinafter
described.
The alteration is made in eleven sections and consists of widening the aforesaid State
highway on both sides thereof, and revising a portion of the aforesaid 1974 State highway
alteration to conform to the boundary of a portion of State highway location abandoned as
hereinafter described, and is more fully described as follows:
The baselines used for the State highway hereby altered and laid out are portions of the
baselines of location of the aforesaid May 7, 1913 (Layout No. 1455),November 18, 1924
(Layout No. 2219)April 9, 1940(Layout No. 3341), and July 30, 1946(Layout No. 3494) State
highway alteration of Turnpike Street(Route 114),the aforesaid November 18, 1924(Layout No.
2216) State highway layout of Winthrop Street(Route 114) (in Lawrence),the aforesaid

November 18, 1924 (Layout No. 2217) State highway layout of Andover Street(Route 125), the
June 16, 1925 (Layout No. 2264) State highway layout of Elm Street, and the December 11, 1991
(Layout No. 7091)Auxiliary baseline"C"of the State highway alteration of Peters Street(Route
113). A portion of the main baseline of the aforesaid April 9, 1940(Layout No. 3341) State
highway alteration of Turnpike Street(Route 114)is hereby partially re-established as follows:
The main baseline of Turnpike Street(Route 114)begins at a point at station-0+32.02,
said point being identical with station-0+32.02 of the main base line of the aforesaid April 9,
1940 State highway alteration(Layout No. 3341) of Turnpike Street(Route 114), and extends
thence, following said base line as hereby re-established S 47°16'56"E 32.02 feet to a point
shown on the plan as station 0+00.00 for the line back, said point equal to station-0+00.21 for the
line ahead; thence S 45°39'45" E 1,040.71 feet to the point of ending thereof, shown on the plan
as station 10+40.50, said point being identical to station 10+40.50 of the main baseline of the
aforesaid April 9, 1940 State highway alteration(Layout No. 3341) of Turnpike Street(Route
114).
The Waverly Road baseline begins at a point in the existing roadway of Waverly Road, at
lv 3072253.9243, E 754566.6357,hereinafter referred to as station 0+00.00, and extends thence N
12056'04" E 726.43 feet; thence northeasterly by a curve to the left of 2,851.36 feet radius 273.57
feet to the point of ending thereof, at N 3073231.0778, E 754777.5956 as shown on the plan
hereinafter referred to as station 10+00.00.
Note: Station 30+74.07 of the baseline of location of the aforesaid November 18, 1924
State highway layout(Layout No. 2219)of Turnpike Street(Route 114) is identical with station
5+87.30 of the Waverly Road baseline.

E 756521.1590, as shown on the plan hereinafter referred to as station 8+00.00.
The Hillside Road baseline begins at a point in the existing roadway of Hillside Road at N
3067319.0259, E 759532.0100, hereinafter referred to as station 5+43.30, and extends thence N
34015'27"E 395.62 feet; thence N 19°58'35"E 281.91 feet; thence N 10120'10"E 122.47 feet;
to the point of ending thereof, at N 3068031.4434, E 759872.9923, as shown on the plan
hereinafter referred to as station 13+43.30.
Note: Station 41+63.87 of the baseline of location of the aforesaid July 30, 1946 State
highway alteration(Layout No. 3494)of Turnpike Street(Route 114)is identical with station
9+63.30 of the Hillside Road baseline.
The Mill Road baseline begins at a point in the existing roadway of Turnpike Street
(Route 114) at N 3065349,5217, E 762143.0993,hereinafter referred to as station 0+00.00, and
extends thence N 50°22'02"E 239.27 feet; thence N 8°28'23"E 60.73 feet to the point of ending
thereof, at N 3065562.2100, E 762336.3222, as shown on the plan hereinafter referred to as
station 3+00.00.
Note: Station 74+87.19 of the baseline of location of the aforesaid July 30, 1946 State
highway alteration(Layout No. 3494)of Turnpike Street(Route 114) is identical with station
0+00.00 of the Mill Road baseline.
The Willow Street baseline begins at a point in the existing roadway of Turnpike Street
(Route 114) at N 3065349.5217, E 762143.0993,hereinafter referred to as station 0+00.00, and

The location lines of the sections of highway hereby laid out in behalf of the Town of
North Andover are to be further defined by bounds set thereon at the angle points,points of
curvature, and at the points of beginning and ending thereof, where feasible.
For the purpose of laying out, constructing and maintaining said State highway, the
Massachusetts Department of Transportation does hereby take, under the provisions of Chapter 79
of the General Laws and all other general or special laws thereto enabling, all of the land not
already owned by said Department, outside the limits of the existing public way or ways, and
within the limits of the layout hereinbefore described, including all trees and structures located
thereon(not, however, including poles, towers, lines,wires, cables and other appurtenances for the
conveyance of electricity and telephone communication, or any other utilities) situated in the
Town of North Andover, County of Essex, all of said land being taken in fee simple, except Parcels
19-E-1, inclusive, 19-E-5 to 19-E-12, and 19-E-15, in which an easement for highway purposes is
hereby taken, the supposed owners of Parcels 19-2, 19-3, 19-5, 19-6, 19-9 to 19-14,inclusive, 19-16
to 19-20,inclusive, 19-22 to 19-24, inclusive, 19-27, 19-29, 19-30, 19-32, 19-33, 19-40 to 19-42,

For the purpose of laying out, constructing and maintaining the section of Town highway

public to use those parts of the public way or ways in the Town of North Andover which are
included in the foregoing description.
Easements are hereby taken in the parcels of land hereinafter described and shown on the
plan referred to as Parcels 19-C-1 to 19-C-4, for the purpose of improving the existing channel, and
consists of the right to enter upon said land at any time with the necessary equipment to clear sand,
gravel and debris that is obstructing the waterway,to excavate and to install rip-rap and to maintain
and use the aforesaid channel.
