Preliminary Plan Denial
The Planning Board herein denies the six(6) lot Preliminary Plan located off of Raleigh
Tavern Lane. The application was submitted George Farr, Farr Better Homes, Inc., 216
Raleigh Tavern Lane, North Andover, MA 01845. The area affected contains
approximately forty(40) acres in the R-2 Zoning District.
Findings of Fact
1. The Conventional Subdivision (Proof Plan) does not include all of the information
required by Section 3 of the Subdivision Rules and Regulations as noted below:
a) The Zoning District in which the proposed subdivision is located, including
the flood hazard areas as determined by the Federal Emergency
Management Administration.
b) Existing easements and proposed for utility lines, walks, and other rights-
of-way.
c) Proposed drainage lines for both storm water and surface water. Proposed
locations for detention/retention ponds.
d) Key Map
2. The Conventional Subdivision (Proof Plan) does not adhere to all of the design
standards indicated in Section 7 of the Subdivision Rules and Regulations.
3. The Conventional Subdivision (Proof Plan) does not conform to the current
Zoning Bylaw:
a) Lots 5 and 6 lack 50' of frontage. The Bylaw requires 150', while these
lots contain only 100'.
4. Insufficient septic testing has been completed on this site:
a) Lots 3 and 4 have appropriate deep holes, but the percolation test
elevations are too high to reflect the permeability rate of the parent
material. Therefore percolation tests need to be performed on these lots.
b) Lots 5 and 6 have only one deep hole per lot and no percolation tests.
Additional information is required on these lots.
5. The applicant must file with the Conservation Commission to determine the limit
of the wetland resource area.

I have reviewed the proposed preliminary conventional
subdivision plan for Salem Forest IV and have the following
comments :
Lots 1 and 2 appear to be okay with sufficient and acceptable
testing in areas not far from the proposed road. Lots 3 and 4 have
appropriate deep holes, but the percolation test elevations are too
high to reflect the permeability rate of the parent material . I
would recommend that percolation tests be again performed on these
latter two lots .
Lots 5 and 6 have only one deep hole per lot and no
percolation tests . As I understand, these two lots are not being
looked at as actual building sites, but as components which help to
determine the number of lots in the PRD. Because of this, I
recommend that the additional deep holes be dispensed with and only
percolation tests, if needed, be done . I believe that percolation
tests might have been done on these lots, but cannot make any final
determination because only these two deep holes are shown on the
preliminary plan. If it can be shown that perc tests have been
done, as I believe, then I can say that these two lots can also be
said to be buildable .

Re: Status of Salem Forest IV
Farr Better Homes, Inc. filed a Notice of Intent with the
Conservation Commission on August 5, 1995 for the construction and
maintenance of a road through a bordering vegetated wetland and
also construction and maintenance of a 10 foot wide driveway
through a Bordering Vegetated under 310 CMR 10. 53 3 (e) . The
Commission issued an Order of Conditions denying the project based
on the following reasons:
1. The applicant proposed two wetland crossings, one totalling 3970
square feet of Bordering Vegetated Wetland filling and the second
totalling 900 square feet of wetland filling. The NACC determined
that the second crossing (900SF) does not meet the provisions of a
limited project.
2 . The applicant did not submit any drainage calculations to
quantify the potential impacts on the flood control or pollution
attenuation interests of the Act or Bylaw.
3 . The applicant failed to quantify the amount of impacts to Land
Under Water and failed to mitigate those impacts.
4 . No proof of mailing to abutters were submitted as required by
the Act and Bylaw.
For these above reasons the NACC denied the Notice of Intent. No
determination has been made to the buildability of any portion of
the property.
An Order of Conditions was issued to Farr Better Homes, Inc. on
March 6, 1996 for the crossing of a Bordering Vegetated Wetland
with a backhoe, or similar type of machinery, in order to conduct
official soil testing required by the North Andover Board of
Health. The Order of Conditions ONLY pertains to the crossing
required for soil testings. The NACC neither agreed nor disagreed
with the applicant's delineation of the wetland resource area.
Subsequent filings for work on this property will warrant approval
of the applicant's proposed delineation at that time.

Under Chapter 131, Section 40, 310 CMR, 10.55 4 (b) , the issuing
authority (NACC) may issue an Order of Conditions permitting work
which results in the loss of up to 5000 square feet of Bordering
Vegetated Wetland when said area is replaced in accordance with the
conditions as outlined in the performance standards listed in 310
CMR, 10.55 4 (b) . Salem Forest IV as currently presented to the
Planning Board, proposes 4870 square feet of wetland filling which
falls within the 5, 000 square foot alteration threshold as allowed
under the Massachusetts Wetlands Protection Act. If available,
alternative access that offers the least impact to the wetland
resource area will be required by the Commission. In this
particular filing, the Conservation Commission could require the
applicant to propose access to lots 5 & 6 from Granville Lane if
square footage of wetland impacts is less than that of the present
proposal.
