RE: Conditions for Accepting Open Space-Jared IV PRD.
Dear Mr. Janusz:
Prior to the Conservation Commission's acceptance of the Open Space, the Open
Space Committee requests that the following be completed:
1. The dedicated open space shall be marked in the field with an
applicable number of permanent markers including but not limited to
pipes and/or stakes labeled accordingly.
2. All access points shall be marked with a sign stating"North Andover
Protected Open Space." The North Andover Conservation
Commission (NACC) has adopted a specific sign; please contact the
Conservation Administrator for details.
3. All debris, including but not limited to tires, trash,and barbed wire,
shall be removed from the dedicated open space and disposed of off-
site in an acceptable manner.
4. Where applicable, existing and/or recently constructed trails shall be
cleared and marked in accordance with the requirements of the North
Andover Trails Committee (NATC). Please contact the NATC
Chairman for specifics.

5. An"as-built" plan of the designated open space at a scale acceptable to
the NAOSC and Planning Board shall be submitted with a clear
depiction of the following features:
➢ Property Lines;
➢ Open Space Markers;
➢ Wetland resource areas;
➢ Topography at 2' intervals, and;
➢ trails w/ access points.
Upon completion of these above referenced tasks please schedule a site visit with
a representative of the NAOSC. The Planning Board will require a favorable
recommendation from "§,group within 21 days from the date of this site visit
prior to agreeing to accept the dedicated open space parcel.

FOR ACCEPTING OPEN SPACE FOR THE JERAD IV PRD WERE CONTAINED IN THE SPECIAL
PERMIT FOR THE PRD-REFERENCE PARAGRAPH 3.C. ON PAGES 2 AND 3 OF THE
CONDITIONAL APPROVAL

I HAD FORWARDED THE ENCLOSED LETTER AND DEED TO KATHLEEN COLWELL LAST
WEEK.
UPON REVIEWIIVG THE SPECIAL PERMIT FOR THE JERAD IV PRD, PARAGRAPH 3C.
INDICATES THAT PARCEL,A(42 ACRES) AND THE OPEN SPACE(22.05 ACRES)SHOULD HAVE
BEEN DONATED TO THE TOWN PRIOR TO ENDORSEMENT OF THE PLANS. HOWEVER, THE
PLANNING BOARD'S PRD MODIFICATION OF A DEFINITIVE SUBDIVISION PLAN CALL FOR
THE DONATION TO BE MADE "PRIOR TO FINAL RELEASE OF SECURITY RETAINED FOR THE
SITE BY THE TOWN",
ON PAGE 4 OF TIES SPECIAL PERMIT-PARAGRAPH 9 COVERS THREE ITEMS TO BE
COMPLETED "PRIOR TO RELEASE OF SECURITY" -A GRAVEL PARKING ARIA, A TOT LOT,
AND A WALKWAY CONNECTING JERAD 11 WITH JERAD IV, ALL OF THESE ITEMS ARE
WITHIN 100'.__OF THE WETLANDS AND WOULD BE MONITORED BY NACC.
KATHL.EEN HAS INDICATED THAT THE PLANNING BOARD WOULD LIKE THESE MATTERS _
COMPLETED)BEFORE ACCEPTING THE DONATION OF LAND TO THE TOWN. IF YOU AGREE,
I WOULD LIKE TO SCHEDULE A REVIEW WITH YOU. PERHAPS WE COULD SCHEDULE A =
WALK THROUGH CONCERNING THE WALKWAY AND HOW IT SHOULD CONNECT WITH
