RE: Street Acceptance for Jerad Place IV Development
Dear Developer:
The Planning Office is in the process of assessing active subdivisions to determine the
compliance with the approved plans and the decision. Our goal is to assist you in
reaching street acceptance with a completed project. In gouzg through our files, we
noticed that you have documentation required to be submitted to'our department to
maintain compliance with the Town of North Andover Subdivision Regulations and the
Notice of Decision issued relative to your project. In the absence of this information,
you will be unable to get your street accepted.
On the following page, please find a detailed list of information we will need in order for
you to get your street-accepted. The list may refer to conditions in your Notice of
Decision, which we are attaching for you to easily refer to.
Additionally, I would suggest that you set up a meeting with myself, so that I may
explain to you what is left in your subdivision to be completed. At that time we can also
schedule an inspection of your subdivision by the Department of Public Works at a
mutually convenient time in order for you to be ready for street acceptance.
This list is only a preliminary review, and there may be more items outstanding that need
to be completed once an inspection has been conducted. Upon further review your
subdivision, we will compile a more detailed comparison of your decision(s) and the
rules and regulations as it relates to your subdivision.

inform you how the process will work.

ITEMIZED LIST OF OUTSTANDING ITEMS FOR JERAD IV
The following items are presented in three sections. Section 1 is the Recording
information required. The information checked in this section is considered missing or
incomplete. Section 2 are the items missing or incomplete as required by the Notice of
Decision for the PRD, if applicable. Sections 3 are the remaining items missing for the
Subdivision Decision. The numbers for sections 2 and 3 represent the item number in the
respective decision. Please review your enclosed decision carefully to coordinate with
this information. Rather than handle each issue separately we would recommend that all
of the necessary research to resolve all of the below issues be conducted prior to
contacting the Planning Office. This will insure that meetings to resolve these issues are
productive.

In accordance with section 9a of the subdivision rules and regulations of North Andover,
you must request a certificate of compliance for a street acceptance.
A copy of the subdivision rules and regulations are available in the Planning Office located at 27 Charles
Street for$10.00. We recommend that ifyou do not have a copy you purchase one. Obtaining specific
pages from the Regulations may not provide all of the information necessary to address your issues.

The following issues should be addressed before final paving:

The following roadway issues have been identified and should be reviewed and addressed prior
to or during final paving. The locations are identified from Boxford Street into subdivision.

The Planning Board has asked me to contact you regarding remaining items at the Jared IV subdivision. These
items are outlined in Bob Beshara's punch-list generated July 23,2002. It is my understanding that you split your
time between the sunshine and bay states. If you do not have a copy of the punch-list,please reply to this email
and indicate to which address you would like me to me send a copy (or you can provide a fax number). Lastly,
kindly call me to discuss the remaining items and to arrange a schedule for their completion. I encourage to call
me soon as the Board indicated it would like to see these issues settled soon.
Thank you in advance for your prompt attention to this matter and look forward to collaboratively resolving any
outstanding issues with Jared IV.

Re: Jared IV Subdivision
Enclosed is a copy of the two Planning Board decisions, the Order of Conditions, the deed for the
conveyance of the open space and the letter dated July 22, 1998 from the Planning Department and
the Open Space Committee. The developer is looking for the Town's acknowledgement of receipt of
the Open Space property. It is my understanding the open space property has not yet been conveyed
as outstanding issues, as referenced in the attached letter from the Open Space Committee, have not
been satisfied. The developer is eager to transfer the land, however, he objects to the conditions placed
upon him from a Committee that no longer exists. The requirements outlined in the letter are not
included in either the Planning or Conservation decisions.
Please feel free to call me if you have any questions. I will be discussing this project and letter with
Alison McKay and Heidi Griffin next week. Thank you.

Dear Julie:
I have enclosed copies of letters to Jack Sullivan and Mark Rees.
I asked Jack for an updated cost estimate for the completion of the roadway for Jerad IV-I had provided
him with a copy of the interim as-built,recently. In this regard,would you inform me of the current value
-interest included-of these bonds?
Jack Sullivan has indicated that the granite curbing which is planned for the cul-de-sac should be
eliminated-it will pose a hazardous condition for snow plowing-particularly in a cul-de-sac,which will
also lead to maintenance costs in the springtime for repair and/or replacement..I understand this item will
require a modification to the plan,but I would appreciate how the board would"lean" on this matter.
Also,as part of the modification and in anticipation that the"estimated cost-to-complete"may exceed the
bonded value of the roadway,I would ask the planning board to consider the"contingent release" of a
portion of the accrued interest and erosion control bond to meet roadway requirements. The subdivision
has been stabilized for years and the erosion funding is no longer necessary. I would make the same
request of the conservation bond.
In summary,there are ample funds available and I request the planning board's cooperation in the
successful completion of this project. Please advise me of the planning boards schedule so that we can
arrange a time for the public hearing-early October would be preferable. I will contact th assessors office
for an abutters list, and provide an update to the homeowners along with notice of the public hearing.

Timberland Builders has posted$113,'770.00 for the completion of Jerad IV. Of that amount, W 770.-`
was for the completion of the roadway while$?0,000 was posted for erosion control. and$5,000 to NACC
for the infrastructure. A copy,of the details is attached.
We need w review the cost elements in light of today's costs and remaining cost of completion. To aid in
this effort, t have enclosed a cost proposal from ARCO Excavators which was made after a detailed on-
site review with you.
1 will contact the Planning Board to see if they would support a request for modification which would
eliminate the granite curbing which is consistent with your reconunendation. In addition,I will contact
homeowners concerning street trees

Dear Mr. Rees:
As a follow-up to my letter to you dated May 20, 2004,and Julie Voudrak's response dated July 15, 2004,
I have not heard from Alison McKay nor town counsel concerning the issues associated with the open
space parcel In Jared IV. In a telecon with Julie last week,she indicated that the town would not
acknowledge the value of the eight lot contribution until the five conditions of the Open Space Committee
had been resolved. I submit these are separate and distinct issues-one has nothing to do with the other.
If the North Andover Conservation Corrunission does not want to accept the open space contribution it
may be in violation to the terms and conditions of our agreement which is on record at the Registry of
Deeds and is part of the title of the homeowners in Jerad IV.
Mr. Rees, I would like the town of North Andover to verify the facts of this situation -that the donation to
the town contains the value of eight two-acre lots -and, that the conditions imposed by the now defunct
Open Space Committee were not part of the approval process nor accepted by me,and are not binding. As
an alternative to the latter, if the conservation commission does not want to accept the open space parcel
perhaps we should consider making the donation to another state sponsored non-profit organization such
as Green Belt,
