Office of the Planning Department Community Development and Services Division 1600 Osgood Street 9SaA�►►ug�� North Andover,Massachusetts 01845 NOTICE OF DECISION (INSUBSTANTIAL CHANGE) Date of Decision: June 11,2013 petition of: Key Lime Inc. 60 Beechwood Drive North Andover, MA 01845 )Premises Affected: Olde Salem Village SalemTurnpike,Lots 1 &-2, 9 & 10 and 16 & 17 HISTORY AND BACKGROUND On September 20, 2005 The Planning Board approved the construction of 37 single and multi-family dwelling units in the Village Residential District, based on an application for Site Plan Review submitted by Key Lime Inc., approving the Project. On June 6,2013,the applicant provided an updated plan titled"Grading Plan in North Andover, MA",revised to June 6, 2013. The plan depicts the following changes: • Units 9 &10, 11 & 12, 17 & 18 will be built as single family homes in place of the 2 family townhomes as shown on the original plan. FINDINGS OF FACT The Findings of Fact are as follows: i.) The proposed revisions are consistent with revisions to the plan approved by the Planning Board in the Site Plan Review Modification dated May 22, 2008. That decision approved the change from two-family units to single family units for Units 13&14, 21 & 22, 29 & 30 and 31 & 32. ii.) The applicant has provided an updated plan set dated June 6, 2013. The proposed changes are therefore deemed insubstantial and not materially different that the approved plan, referenced in the September 20, 2005 Special Permit Decision, CONDITIONS The Town Planner's finding of no substantial change is conditioned on the following: Ivey Lime,Inc. Mayflower Drive Units 9&10, 11&12 and 17&18 June 11,2013 ® This Decision shall be recorded with the Registry of Deeds and evidence of recording is to be provided to the Planning Department. ® The applicant shall provide a plot plan showing single family homes in order to obtain a Building Permit. e Upon completion of the subdivision,the applicant shall provide an as-built that will reflect the changes outlined in this decision.
