Dear Mr. Long:
The following petition was heard at a meeting of the Planning Board on 141onday evening,
July 2, 1979 in the Toi-rn Office Meeting Room at 7:30 P.M. The following members were
present and voting: Ui.11iam Chepulis, Chairman; Joyce A. DiTore; John J. lloTitei ro,
Vice---Chairman; and Michael P. Roberts.
Arthur Kalogianis, developer, Frank C. Gelinas, and Reginald Marden, attorney, were
present representing T.D.J. Development Corp. Atty. Marden stated that the proposal
is for a 46 lot subdivision in an R--2 zoning district; parcel designated by //1 is a
road relocation which will be deeded to the Town for the purpose of straightening the
road; the intention is to run water along Campbell Rd. some 2200 ft. to Forest Estates
and into the Campbell Forest subdivision. Mr. . Geli.nas added that Road A and Road B
are 2300 and 2100 ft. in length; there will be 45 d-Telling sites; the proposal fulfills
each of the requirements of the Rules & Regulations Governing the SUbd.ivision of Land;
no greater than a 6 o grade; drainage designed to accommodate two kinds of flow; existing
water line located at intersection of Salem St. and Campbell Rd. ; grater line will be
a 10 in. diameter for overall plan to loop Salem St. with Rte. 114; 500 ft. between
hydrants; a temporary cul--dc---sac is proposed to coordiante with future planning; site
characterized by 3 major features (as shown on topographic plan: high areas, extremely
large wetlands to the south and i:est, and wetlands within the subdivision. There is
no flow from this subdivision going into the wetland behind it, sheet flow is existing
now and will not be altered, no planned alteration of the largest wetlands, smaller
wetland will be dredged for storm control and increased run-off will flow into a >>;et-
lp.nd in the middle. At this point a letter from the Conservation Co-mmission dated
July 2, 1979 was read and applicant is aware that he will have to file under Ch. 131.
Charles Label, abutter, asked questions regarding his land--locked piece of 1<)nd and
desired assurance that he would have a right-of-way to his property.
Letters from BPVI and Highway Surveyor were read and also letters from Fire Dept. and
Board of Health. All on file.
Letter from citizens on Campbell Rd. and Salem St. was read.

On August 6, 1979 the Board voted to approve the definitive subdivision plan of Campbell
Forest subject to conditions listed on attached sheets (2) and the following: that
the record owners of the subject land forthwith execute and record a "covenant running
with the land", or otherwise provide security for the construction of ways and the
installation of municipal services within said subdivision, all as provided by G.L.
c. 41 , S. 81--U; that all such construction and installations shall in all respects
conform to the governing rules and regulations of this Board. VOTE: William
Chepulis, Joyce A. DiTore and John J. Prfonteiro in favor; Paul Hedstrom opposed upon
motion of Mr. Monteiro and second by Firs. DiTore.

4. That, individual septic system permits must be obtained prior to the issuance of
a building permit from the Board of Health under the rules and regulations of Title 'IV"
of the state sanitary code; and that the developer shall, prior to the sale of indivi-
dual lots to individual owners, submit to the Board of' Health percolation tests showing
the suitability of said lots for the installation of subsurface disposal systems for single
family dwellings_,_.,however, such restriction shall not prevent the mortgage of said lots or
the sale to developers or home builders against whom this condition shall also remain
applicable and enforceable until complied with;
5. That, no work shall be done in the subdivision until security in the form of a
bond or covenant has been duly recorded and the plans are signed and recorded;
6. That, any changes made to the definitive plan by other town agencies or officials
shall be submitted to the Planning Board by the applicant;
7. That the recommendations of the Highway Surveyor's letter dated July 2, 1979 shall
be adhered to as follows:
a. all drainage pipe shall be R.C.P. with a minimum of two (2) feet of cover
on pipe sizes eighteen (18) inches of cover and thirty (30) inches of cover on
pipe sizes less than eighteen (18) inches. No metal or squashed pipe shall be
allowed within the subdivision drainage system;
b. two additional catch basins shall be located at approximately station 10+50
on Road B (Donna Dr.);
o. manhole at station 19+00 and 20+00 on Road A (Mary Ann Dr.) shall be a
catch basin;
d. all drainage shall be tied into a continuous drainage easement throughout
the entire subdivision;
e. Cape Cod Berm to be required where and when deemed necessary, to be deter-
mined in the field; where berm is required, the paved road width and gravel
base shall be widened two feet in total to accommodate the berm base;
f. no house drainage systems shall be allowed to drain into the street, all
such drains, (if any), shall be incorporated into street drainage with a permit
being required and Town specification complied with;
g. cul-de-sac shall be 100 foot radius with the required land area to be under
ownership of the developer of the road network until such time as the:road is
extended;
8. That the hydrants (17) shall be located in accordance with the Fire Dept. 's
letter dated June 19, 1979 and as marked on said plan, including an additional
hydrant on lot 39 at the intersection of Road A and B;
9. That all water improvements shall be in accordance with the recommendations of
the Board of Public Works letter dated July 2, 1979;
10. That a Notice of Intent shall be submitted by the applicant to the Conservation
Commission pursuant to M.G.L. Ch. 131 (Wetlands Protection Act);

11. That the applicant shall obtain a Certificate of Compliance from the North Andover
Conservation Commission with regard to any Order of Conditions issued by said Commission
under M.G.L. Ch. 131 prior to the final release of any bond or covenant;
12. That a right—of—way shall be provided on either lot 16 or 17 to ensure Mr. Charles
Label access to his property which abuts said subdivision,
13. That no work shall commence within the entire subdivision until detailed plans
and specifications for a control structure at the so called !!Myers Pond" (which fronts
lots 1, 2, 3, 4, 5, 6, 71 81 & 9) are furnished by the developer to the Conservation
Commission which ensures that the elevation of the said pond is controlled and that the
existing drainage conditions in said area are not aggravated;
14. That the development of said subdivision and the construction of structures shall
not violate the drainage flow calculations computed by Frank C. Gelinas, Registered
Professional Engineer, which were submitted to the Planning Board on July 6, 1979;
15. That approval of said subdivision encompasses pages 1 through 7 and 1A through 7A
inclusive of the Definitive Campbell Forest Subdivision-Plan dated May 11, 1979.
