An Environmental Notification Form has been submitted for this project .
According to MGL Chapter 30, Section 62, the Secretary of Environmental
Affairs must issue a determination regarding the significance of the
potential environmental impacts of this project, and must determine
whether an Environmental Impact Report should be required to document
these impacts and all feasible means to reduce damage to the environment .
A consultation meeting will be held to receive advice and comment from
agencies, officials, and citizens regarding which environmental issues,
if any, are significant for this project .
The meeting is scheduled as follows :
DATE: September 14 , 1998
TIME: 10 : 00 a.m.
LOCATION: Meet at the site near the intersection of Salem Street and
Campbell Road in North Andover
The meeting will include a brief presentation of the MEPA process by the
staff, a brief presentation of the project change by the proponent, with
periods for questions, answers, and open comment and a discussion of
environmental issues . Additional comments will be welcome (preferably in
writing) until September 15, 1998 .

MEPA staff at (617) 727-5830 ext . 234 .
Pursuant to the requirements of the Americans With Disabilities Act this Meeting Notice

RE: Campbell Forest Subdivision
Dear Mr.Masterson;
It has been brought to my attention that your company did not request an inspection of the sub-grade prior to fill
being placed in the roadway. This is a very serious problem. Since we have not observed the sub-grade we cannot approve the
placement of fill or any utilities in the fill areas of the roadway. Since these portions,of the roadway,affect the total roadway
we will not be able to approve any of the roadway and will require a 100%bond if a bond is requested.Inspections such as
these were discussed at a meeting several months ago,a Mr. Bill Peach was in attendance.
Also,I understand an extra Sewer Manhole was added without Town approval and in fact,after I informed the Staff
Engineer that this was not acceptable.My understanding,is that you did not want to enter Campbell Road and this was a
matter of convenience for you. The Town will ultimately assume the maintenance of this sewer system and we do not need
unnecessary structures. This is a change from the approved plan,all changes MUST be approved by this Department and/or
the Planning Board prior to the change being made.
These two items are very serious and need to be addressed immediately.I would suggest a meeting of all concerned
parties be established at once.Please,schedule regular and required inspections with Mr.Tim Willett, Staff Engineer,

Dear Mr. Scott:
I wish to confirm that I represent MPG Realty Corp. with regards to the above approved
Subdivision and which property is currently deeded to Campbell Forest, LLC. I wish to confirm
that a modification to said Subdivision was approved and recorded with the Town Clerk on May
21, 1998, a copy of which I am enclosing herewith, and which further required a revised Form M
to be recorded at the Registry of Deeds. Please find enclosed a proposed Form M Revision of
Conveyance of Easements and Utilities that my client intends to execute and record although I
did want to make sure it is satisfactory to you and the Planning Board. Please confirm same so
that I might record the modification documents and the revised Form M as quickly as possible.
It is my understanding that all necessary plans on such modifications are presently with
the Planning Board which I would intend to record with all required recording documents,

Re: Campbell Forest Estates
I am in receipt of a request for a bond figure for Campbell Forest Subdivision made to your office on
October 1, 1999 by Mesiti Development Corp. We must inform you that we cannot supply you with a
bond figure at this time,for the following reasons.
1. The offsite drainage for the Campbell Forest Subdivision on Campbell Road has not been
designed, reviewed or approved at this time.Also,there are questions if the drainage system can
be installed without relocating existing utilities. The developer has known of this situation for
several months and has not taken any action on this matter.
2. Campbell Forest subdivision is dependent on two (2) large offsite sewer projects neither of which
are complete and may not get completed this year. They both have serious issues that must be
addressed prior to their being acceptable and are as follows:
CAMPBELL FOREST OFFSITE SEWER EXTENSION
A. The contractor has encountered a considerable amount of ledge, which has delayed his
progress. As of this date, the contractor has 300 LF +/- of gravity sewer, 16 +/- sewer
services, 2,300 LF +/- of force main and one pump station to install. Also, the gravity sewer
system,the 2,300 LF of force main and the pump station need testing.This volume of work to
be completed may prove impossible to finish prior to the stopping of all non-emergency
roadwork for the winter. I believe that the developer may want to install a gas main on
Campbell Road.
FOREST VIEW OFFSITE SEWER EXTENSION
A. The contractor is progressing slowly and it appears that he may complete the road
construction prior to the ending of roadwork for the winter. Testing may not be completed and
if deficiencies are found repairs cannot be made until spring. However, the two most critical
outstanding issues follow.
a. The developer is moving the Boston Ski Hill Pump Station. This Department has not
received any plans to review. Therefore, if this pump station cannot be built in the
approved location,the developer does not have an approved plan.

b. Some of our staff traveled to the manufactures' construction site to review the Forest
View Pump Station and found differences from what was approved and what was built. I
informed Mr. Richard Pelletier of this and other than a phone call, which was
inconclusive, no action has been taken.This is a very important matter.
c. I could not even begin to predict when this line would be operational.
Also, I feel that the following questions need to be addressed prior to bonding and the issuing of any
building permits.
A. Will this be a cash or paper bond?
B. Will credit be given for work completed?
C. Length(time)of bond?
D. Should all offsite improvements be completed and operational prior to bonding and/or building
permits being issued?
E. If permits are issued, how do we insure that Certificate of occupancies are not issued, prior to
all offsite work being completed.
F. Have all sewer mitigation been paid?
We are very concerned about allowing connections to our water distribution system, if there is no
means to discharge the water. This department would welcome discussion and comments on these
concerns from you and the Planning Board.

Please firid attached a certified cop),of the confirmatory lot release document recorded today at the
E.N.D.R.D. at instrument#45489. The lots released are on the document as 1,2,3,4,5,6,7,8,8B,
9,10,11,12,13,14,14B, 15,16,17A, 18,19,20B,20C,21A,22,23,24,25,26C,27B,27C,28B,28C,29A,30A,
31A and 32A. This confirmatory lot release was used to correct an incorrect page citation of an earlier
recorded confirmatory lot release that cited the earlier covenant.
For your convenience I've included an earlier note requesting the renewed confirmatory lot release
below:
"please see an attached note from an Attorney Russell Bodnar relative to a wrong page number
reference on a Confirmatory Lot release document recorded at Book 6761 Page 261.Atty. Bodnar is a
closing attorney involved with the sale of Lot 20C which is occurring today. The confirmatory lot release
document at Book 6761 Page 261 refers to a Covenant recorded at Book 4452 Page 51 when the actual
Covenant is recorded at page 47 in the same Book. 1 am attaching both page 47 and page 51.As you can
see Page 47 refers to a covenant whereas page 51 refers to a dedication of easement. I will appreciate any
assistance you can render on this matter. If tl-iis document is still on the Planning departments word
processor,just changing the page# from 51 to 47 should suffice to cure this matter."

guardrails to steel. The areas of change are limited to railing that is proximate to retaining walls.
In all other areas the guardrails will remain entirely wood. Additionally, these areas were the
change is proposed, the horizontal bars will also remain wood. It is reported that the installation
will reduce long-term maintenance cost and meet or exceed safety factors in these areas.
Based on the above, it is my opinion that the change is minor in nature and does not require a
modification of the subdivision approval. If you have any further questions,please do not hesitate

In pursuing a Certificate of Compliance at Campbell Forest,the Conservation Commission requested an As-Built Drainage study
to determine the impact of 4 addittional homes within the Campbell Forest subdivision may have on the original approved plans and
drainage study. To my surprise,and I'm sure many others,we discovered 3 culvert detail discrepancies between those in the drainage
report from those depicted on the approved plans.We built the drainage according to the approved plans. Dan Koravos P.
E. of DK Engineering has proposed a remedy for these particular 3 culverts discrepancies to match the design for the approved
project..At this time I am primarily concerned with your review of a particular medlod for remedy for this discrepancy.There is an
attached 3 sheet detail for steel plates to reduce the size of the opening to 3 culverts attached. The Conservation Commission is
going to send the new Drainage study out to there consulting engineer after your office approves only in the method of remedy. In
other words, assuming everth ing in the drainage study is accurate and true and the method of remady actually does what it says it
does,at the end of the day does the anchoring of the galvanized steel plates not offend the DPW acceptable methodology.At this
time we are not asking for your acceptance of the new Dranage study findings or remedy accuracy.We are asking if you do not
object to the galvanized steel method prior to our sending the new drain study and appurtenant documents to the Con Comm.'s
consulting engineer.
Despite the foregoing limited request,ultimately you may need to advise the Planning Board on this matter.Therefore Iam attaching
the following:
Please find attached the July 31,2003 Drainage Study by DK Engineering;
3 sheet detail of steel plate attachment tp 3 culverts;
Some summary pages of the July 31,2003 and April 23, 1997 Drainage study for comparison;
13 sheets of Plans that you already possess but in separate groupings. In this package I have grouped together the following for
relevance to the matter at hand: Campbell Forest Definitive Subdivision Cover Sheet,Conditions Sheet,Sheets 13 -21 of the
Campbell Forest Definitive Subdivision Approved Plans. Of the aforesaid sheets,sheets 17 -21 are also called sheets 1 to 5 of 5.
These 1 thruogh 5 sheets were give the name "Record Copy MDH 5/20/98 Mod." following the addition of sewer on the site.

Also in the grouping is the As-Built drainage at the Campbell Rd and Salem St intersection dated 9/21/01.This plan shows the
additional 7'x 5' box covert under Salem St. and the control structure and an additional 18" drain line we installed that outlets to the
east side of Salem St. after the outfall of the 7'x 5' culvert. The pre-existing drain lines are also shown.Lastly there is a Composite
Site Plan by DK Engineering Assoc. dated 7/7/2003' showing the 5 distinct drainage collection areas and the control points that
connect these interacting drain areas.
I can provide the Approved Record Drainage study(Record Copy 5/5/97) and the Notice of Intent documents should you
determine their necessity at some future date.
