The Forest View Estates Development Public Hearing Continuation is scheduled
for Tuesday, December 16, 1997. In addition, we have requested to be heard relative
to the establishment of a mutually agreeable extension of the latest date by which the
Public Hearing on our Application for Definitive Subdivision Plan approval is to
conclude. Basically, given the size and scope of the over-sizing of the Off-Site Sewer
(as requested by the Town of North Andover), it is fairly evident that the appropriate
level of sewer design, review and analysis by the Town and the Town's consultants, as
well as mutually satisfactory resolution of final design details, will entail a reasonable
arnount of additional time to conduct the Public Hearings oil our Application.
For the benefit of the Board, we outline below a design and approval
chronology to illustrate where we are in the process. Additionally, Mr. Hmerciak of
the DPW has prepared a letter detailing tine status of the design/approval of the Off-Site
Sewer with the Town's engineering consultants (Guertin & Associates).

4/11/97 Eastern Topographies flew the 114
Corridor Topography.
4/23/97 Aerial Photos received by MHF Design
for field survey work to be completed.

5/15/97 Aerial Photos with Survey Control Data
returned to Eastern Topographics for the
Preparation of Planimetric Topography for
the Rt. 114 Corridor.
6/10/97 Meeting with M. Gross/D. Pelletier/T.
Laudani/W. Hmerciak - Initial meeting to
discuss the Off-Site Sewer with DPW and
the Towns consulting engineers, Guertin
& Associates
6/11/97-7/3/97 MHF Design located all existing utilities
including drainage, sewer, water, gas,
overhead electric, and telephone on the Rt.
114 Corridor and forwarded them
promptly to Roger Norton of CDM.
7/25/97 Meeting held with DPW - Attendees R.
Pelletier/T. Laudani/W. Hmerciak/R.
Norton, B. Fehen to discuss the planning
reports prepared by Guertin & Associates
and establish design considerations and
standard for CDM to follow during the
design of the 114 pump station and
pipelines.
8/15/97 MHF Design sent the wetlands
determination for Rt. 114 to CDM
identifying 8000 Ln. Ft. of wetland
flagging, with reference to existing
utilities and drainage.
9/15/97 CDM provides MHF Design and DPW
with a design submittal for review and
comment by Guertin and Associates of the
entire 114 Corridor Sewer and Pump
Station Layout.
9/23/97 Meeting was held at DPW with B. Fehen,
R. Norton, D. Pelletier, T. Laudani, W.
Hmerciak to discuss the relocation of
certain sections of the Rt. 114 sewer to the
north side of Rt. 114 to avoid utility
conflicts.

10/1/97 CDM provides revision plans to MHF and
DPW based on the 9/23/97 designs change
meeting.
The Extension requested is based on time required by DPW and Guertin to
complete a review of the Off-Site Sewer and incorporate final design changes if
necessary. All other engineering revisions by MHF as requested by Coler &
Colantonio in letters dated 11/7/97 and 11/13/97 (exclusive of items 6 through
11 which are Conservation Commission requirements) will have been completed
and submitted by 12/15/97 in writing to Coler & Colantoni, with copies to K.
Colwell & M. Howard.
It should be noted that additional comments from Coler & Colantoni may be
received by MHF and planning staff subsequent to these dates. Those
comments, if necessary, will be addressed during the Extension period.
In conclusion, it is important to remember that the Off-Site Sewer design
process which the Applicant has been requested to participate in serves not only
the Applicant's interests in its proposed Project, but also serves the interests of
the Town of North Andover by providing that section of town with a rational
and comprehensive sewering program for the general benefit of the Town,
including the other occupants and property owners along Rt. 114. Obviously,
conducting a comprehensive sewering program will eliminate future repetitive
requests to the Planning Board by other land owners, and certainly has
environmental benefits along Title V lines. The Applicant has understood from
the beginning of the process that it was certainly reasonable for the Town of
North Andover to suggest that the Applicant over-size the Off-Site Sewer so as
to accomplish the Town's purposes mentioned above.
It is also fairly evident that such a process involves a great deal more of design
effort, and especially time. Consequently, it is respectfully suggested that the
requested Extension of Time within which the Planning Board is to conclude the
Public Hearings on the Application for Definitive Subdivision Plan approval be
extended to a reasonable and mutually agreeable date. It is for the foregoing
reasons that the Applicant has suggested March 28, 1998 as a reasonable
extension date.

At their meeting of December 16, 1997, the Planing Board voted to accept your request that the
Board extend their time for review of the Definitive Subdivision until March 24, 1998. The
Board will extend the time for review of the off site sewer in Rt. 114 until March 24`h however all
on-site issues must be substantially resolved by the January 20, 1998 Planning Board meeting.
