HomeMy WebLinkAbout1968-10-21Monday - October 21, 1968 Regular Meeting & Hearing The BOARD OF APPEALS held a meeting on Mondayevening, October 21, 1968 at --7:30 P.M. in the Town Office Building with the following members present and voting: James A. Deyo, Chairman; Donald J. Scott, Arthur R. Drummong, Daniel T. O!Leary and Philip Arsenault, Esq. There were over 75 people present for the hearing and the Board adjourned the meeting to the Fire Station meeting room. 1. HEARTK~: Thomas J. Flatle¥ and Daniel J. Puccio. Mr. Drummond read the legal notice in the appeal of Thomas J. Flatley and Daniel J. Puccio who requested a Special Permit under Section &o7 of the Zoning By-Law so as to permit the construction of 49 Town House type apartmentst containing a total of 588 units on land consisting of 75 acres more or less as shown on a plan submitted, located at the east side of Turnpike Street, 2,000 ft. distant from the corner of Andover Street. Atty. John J. Willis represented the petitioners who stated that the proposed apart- ment development would permit utilization to the highest and best use of the 75 acres of land. He presented pictures and architectural drawings of the proposed buildings. He introduced Mr. Frykberg, a real estate appraiser, who testified from research and actual observation to the nature and character of the land involved in the petition. Mr. Flatley was also introduced and Kave oral testimony concerning his previous experience with building apartment dwelldngs in other communities, together with his opinion of a need for such a complex existing locally. A letter was read from Reverend Father Keuney, Treasurer of Merrimack College, located directly across the street from the proposed apartment development. They did not object to the development, but recommended that the permit be granted. It was indicated that to the immediate south of the location was a substantial area of land presently zoned for general business. The nearest dwellings are more than 800 feet from the proposed development. The Town of North Andover ha~ an ele- mentary grammar school to the northeast and to the north is a vacant parcel of land of approx. 40 acres. To the northwest several homes abut the proposed develop- ment. The land is bordered on the west by Route ll4 for a distance of approximately 1850 feet. Letters had been submitted to the Board from all town departments involved in such a development. The Planning Board indicated that all of the requirements ~ith respect to the construction of the roadway to service the development together with the drainage requirements had met the regulations as established for the development of a minor street. The Board of P~lic Works stated that the enbineering design with respect to the sewerage and water was satisfactory and had met all their re- quirements. The Highway Surveyor indicated that his department had no concern about the development since the developer proposed to enter a State Highway drain and the streets within the development were not to be the concern of the Town but his own responsibility. The Board of Health indicated they were not concerned since sewerage was available. The Fire Department made certain recommendations concerning the installation of fire alarms and ~ fire alarm system which the petitioner indicated he would accept and implement. The~ Police Chief indicated no specific problems. October 21, 1968 - cont. There were many abutters of the general vicinity present. Only one immediate abutter objected (Mrs. Robert Leyland, 312 Turnpike St.) Several persons objected to apartments in general. Several abutters indicated they were in favor of the development since it was residential in nature and their residences would be least affected by a development of this sort. Statistics were presented concerning the economic effect that such a development would have on the town of North Andover indicating that it would be financially beneficial. Evidence was given by the Board of Assessors that apartment dwellings returns as part of the town's tax base was beneficial. The petitioners said the town would not have to assume any of the costs of maintenance within the development ~tself and that basically the only town services that would be required would be that of Police and Fire protection. Mr. O'Leary made a motion to take the petition under a~visement. Mr. Arsenault seconded the motion and the vote was unanimous. The petitioners were requested to present engineering drawings and profiles of the street showing the installation of utilities, water, sewerage and drainage. He agreed to do so.
