NAME: Jean Fogarty DATE:3/10/99 ADDRESS:33 Harold St. PETITION: 051-98 North Andover, MA 01845 HEARING: 2/9/99&3/9/99 The Board of Appeals held a regular meeting on Tuesday evening, March 9, 1999 upon the application of Jean Fogarty, 33 Harold St., North Andover, MA requesting a variance from the requirements of Section 7, paragraph 7.1 & 7.2 for relief of lot dimension and street frontage to subdivide one lot into two lots in order to build a single family dwelling. The following members were present: Walter F. Soule, Raymond Vivenzio, John Pallone, Ellen McIntyre, Scott Karpinski. The hearing was advertised in the Lawrence Tribune on 1/21/99 & 1/26/99 and all abutters were notified by regular mail. Upon a motion made by Walter F. Soule and 2nd by John Pallone, the Board voted to GRANT a Variance for the lot at 33 Harold St. for street frontage of 25'and front setback of 23' and for relief of lot dimension in order to sub-divide the lot from 15,000 sq. feet into 7,500 sq. feet in order to construct a single family dwelling. Condition#1. That the lot be used to construct a single family dwelling only. Condition#2 . that the existing dwelling remain a single family dwelling. Condition#3 that the existing garage be razed. The construction must be in accordance with the Plan of Land certified by Scott L. Giles,#1397 2, Registered Land Surveyor, dated 10/8/98. Voting in favor: Walter F. Soule, Raymond Vivenzio, John Pallone, Scott Karpinski.. Ellen McIntyre voted in opposition. The petitioner has satisfied the provision of Section 10, paragraph 10.4 of the Zoning Bylaw and that the granting of these variances will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. Note: The granting of the Variance and/or Special Permit as requested by the applicant does not necessarily ensure the granting of a Building permit as the applicant must abide by all applicable local, state and federal and building codes and regulations,prior to the issuance of a building permit as requested by the Building Commission.
