the official form of the Planning Board. Every application shall be filed with

absolve the applicant from this responsibility. The petitioner shall be
responsible for all expenses for filing and legal notification. Failure to

Dear Board Members:
I have been asked to comment on the extension of the special permit for the
above referenced project. This project is a large & complex project that will remain
private. I have restricted my review to potential impacts of the project's entrance on
residents' safety and on public ways within the town.
The project entrance, as first proposed, was located at the intersection of
Johnson St. and Rte. 114 apparently in compliance with sections 6.7.3 "Topography
and Location", and 6.8.9 "Intersections" of the North Andover Rules and Regulations
Governing the Subdivision of Land. The proposed entrance has been moved east
along Rte 114 and now is no longer in compliance with those two regulations. I have
asked for the engineering rationale for this revision.
The potential future widening of Route 114 is of major interest to the town and
region; the Merrimack Valley Planning Commission is presently studying it. A copy of
the approved Mass Highway permit extension, dated August 31, 2007, has been
forwarded to me. It refers questions to District Permit Engineer Michael Formichella.
On Sept. 25 and 26, 2007, 1 called Mass Highway asking to speak with Mr.
Formichella. On Sept. 26, 2007, 1 spoke with Mr. Steve MacVickers(sp?). He advised
me that the potential future widening of Route 114 would not have been within the
scope of the review Mass Highway performed when issuing this permit. I have
requested information from the applicant, showing how a potential widening could be
accomplished with the entrance located as presently proposed as opposed to as first
proposed.
Thirdly I have requested an analysis as to the possible necessity for a vertical
curve at the grade change in the entrance as proposed. I believe vehicular traffic may
have difficulty with the presently designed entrance.

Route 114 is an east/west road with speed limits of 45 mph through this
section. The sun is low on the horizon in the Fall, Winter, and Spring. It shines into
the windshield of eastbound traffic during the morning and westbound traffic during
the evening commutes. For these reasons, I feel that particular attention should be
paid to how the project enters and exits this roadway. I have requested more
information in order to provide a recommendation to the board. In the absence of the
applicant's providing this information, I recommend the board not extend the special
permit.

Dear Board Members:
The project entrance, as first proposed, was located at an existing entrance
onto Rte 114 at the intersection with Johnson St. This is presumably the preferred
location. The proposed entrance has been moved east and is no longer entering Rte
114 at an existing intersection. I have asked for the engineering rationale for this
revision.
I have met with the applicant's engineer, Paul Marcionda, on Tuesday Oct. 9,
2007. At that meeting he stated neither he, nor his traffic consultant, could find the
requested traffic signal warrant study, done in June 2001, for the intersection as
originally proposed. Therefore he could not provide it to me for review. Merrimack
Valley Planning Commission's capacity analysis of the intersection indicates signal
warrants # 1 B, 2, and 3 are met. This analysis was done in May of 2005. It is not
possible to determine if the intersection relocation was necessary for the reasons
stated by the applicant, without the project's original analysis.
The potential future widening of Route 114 is of major interest to the town and
region; the Merrimack Valley Planning Commission is presently studying it. At the
above meeting, Mr. Marcionda did not adequately address the potential widening of
Rte 114. Of specific concern is how the acceleration and deceleration lanes for the
project will be accommodated if a lane is added to Rte 114 in the future. The negative
4% driveway slope entering onto Rte 114 begins at the edge of these lanes and is in
deep cuts. I have requested information from the applicant, showing how a potential
widening could be accomplished with the entrance located as presently proposed.
This does not appear to be an issue with the entrance designed as first proposed.
I have been in contact with Mass Highway and have been informed that the
original permit issued was for an existing driveway location. The permit issued on
June 11, 2001 references relocation. It is unclear if the necessary information was
provides to the right of way division for analysis or if this requirement was overlooked.
Mass Highway is researching this for me and I'm awaiting a response.

Thirdly I have requested an analysis as to the possible necessity for a vertical

is not an issue and that other engineers have reviewed it and agree also. This does
not appear to be an issue.
I find I am not in a position to recommend extension of this special permit with
the information I have been provided to date.
