On-Going Conditions
l. (Condition #35): The NACC finds that the intensive use of the upland areas and buffer zone
proposed on this site will cause further alteration of the wetland resource areas. |n order to
prevent any alteration of wetland resource areas twenty-five foot (25') No-Disturbance Zone
and a fifty foot (50') No-Construction Zone shall be established from the edge of the wetland
resource areas. The Conservation Administrator and/or other agents nf the NACCdo not have
the authority to waive these Seth8Ck3 as established under the local 8y|8vv. No disturbance of
existing grade, soils or vegetation is permitted in the no-disturbance zone. Future work within
the wetland or within 100 feet of the wetland shall require separate permitting with the
Conservation Commission.
2. (Condition #51): The existing wetland markers on site, incorporating the following text:
"Protected Wetland Resource Area" and the associated rules shall remain. These markers will
designate the sensitivity of the resource area and assure no further inadvertent encroachment
into the wetland. The applicant shall instruct all agents tO explain these markers to
buyers/lessees/landscapers and all persons taking over the property from the applicant. These
markers shall remain posted and be replaced as necessary in perpetuity. Markers are available
from the Conservation Department /$Z round and $3square\.
3. (Condition #57): All stOrn0vvgter best management practices shall be continually maintained a3
specified in the Operation and Maintenance Plan (submitted as part of DEP File #242-1550) and
incorporated in the Order ofConditions. The approved Operation & Maintenance Plan iSfully
binding upon the applicant and/or owners, successors, agents, associations, heirs and assigns
and must be adhered toin perpetuity. Maintenance o[thesto[rnxvaternnan8gennentsystennshall
be conducted OD8nannual basis bya Registered Professional Civil Engineer. Maintenance bills
submitted by cleaning contractors (catch basins, Stornncepters, etc.) shall be maintained with
annual engineering reports. A log/proof of annual maintenance activities as required by the
Operation & Maintenance Plan shall be maintained for not less than the prior 5 year period. The
NACC reserves the right to request documentation of maintenance activities for purposes of
verification of this Order.
4. /[ondition #7l\: There shall beno discharge or spillage of fuel, or other pollutants into any
wetland resource area. If there is a spill or discharge of any pollutant the NACC shall be notified

by the applicant within one (1) business day. No construction vehicles are to be stored within 100
feet Vfwetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance
is to be done within I00 feet ofo resource area.
5. (Condition #72): No underground storage of fuel oils shall be allowed within one-hundred /1U0\
feet Of any wetland resource area.
6. (Condition #73): Fertilizers utilized for landscaping and lawn care shall be slow release, low-
nitrogen types (< 5%), and shall not be used within 25 feet oFa resource area. Pesticides and
herbicides shall not be Used within 100 feet of wetland resource area.
7. (Condition #74\: There shall ben0 dumping 0f leaves, grass clippings, brush, dog waste, o[other
debris into g wetland resource area or beyond the No-Disturbance Zone demarcated by the posts
and/or wetland markers. This condition shall survive the issuance ofa Certificate ofCompliance.
