The stream runs through a culvert under the shared driveway. In addition, as you are aware, portions of the property and abutting properties are subject to a conservation restriction. I have attached recent email correspondence from Brig Leland, the parking plan submitted with the Limited Site Plan application, and an aerial overhead photo of the property with my markups. Based on the parking plan, it appears that parking will be kept outside the I O�0' buffer None and Zoo-Foot F iverfront Area,, particularly if cars are kept within the stonewall enclosure shown on the aerial and highlighted in pink. with this information in mind, parking logistics do not require permitting with the conservation Commission at this time. Considering Mr. Leland's written narrative submitted for a recent TF c meeting as well as what is included in the site plan review application, farming operations on the site have not taken place for forty 40 years prior to 2020 when vineyard operations started. Pursuant to the Massachusetts Wetlands Protection Act Regulations, 310 CIVIR 10.04 (Agriculture Definitions) (a),: Land in agricultural use may lie inactive only up to five 5 consecutive years. If agricultural uses stop for greater than five years, then the property loses the agricultural exemption status that is granted under the Massachusetts Wetlands Protection Act, tI GL chapter 131 Section 40. Land under the jurisdiction of the Wetlands Protection Act and the North Andover wetlands Protection Bylaw that has been out of production for longer than five gears is considered new land. Farming ,activities {as well as any appurtenant activities} proposed for such areas are not exempt and therefore require a permit with the conservation commission.. Therefore, if llr"lr., Leland proposes to expand the vineyard or associated operations into wetland jurisdictional areas, a formal application with the Conservation commission will be required and activities will be held to the usual current standards of both sets of regulations. This layout Was intentionally designed to ensure that no parking activities occur within jurisdictional areas governed by the Massachusetts Wetlands Protection Act or the North Andover Wetlands Protection Bylaw. As a result, filing a Request for Determination of Applicability with the North Andover Conservation Commission is not required. Greg Hochmuth of Epsilon Associates Will be on site Friday, September 12, 2025, to delineate the applicable resource areas near the proposed parking zones. He will also stake out the 100-foot Buffer Zone and Zoo--foot Riverfront Area, as appropriate, to facilitate installation of a rope barrier that will prevent vehicle access into jurisdictional areas.
