NEGATIVE #2 & #3 DETERMINATION OF APPLICABILITY
FINDINGS
488PIeasant Street, North Andover
At the January 28,2026 public hearing, the North Andover Conservation Commission (NACC) voted to
issue an after-the-fact Negative #2& #3 Determination of Applicability for work at 488 Pleasant Street
that includes after-the-fact permitting for:
1. A circa 2008 pre-existing 223 s.f.floating dock consisting of two attached wooden floating
sections (10'x4' and 17x4') attached to an aluminum floating section (23x5). The wooden end of
the dock rests upon the bank of Stevens Pond,remainder floats within the pond. The dock is
anchored by two mushroom anchors and two helical anchors and is not removed seasonally.
2. Circa 2025 pre-existing granite steps,48 s.f. consisting of eight rectangular granite slabs,I'x6'
each. Steps are outside the 25' NDZ.
The Commission issued an Enforcement Order that required after-the-fact permitting of these structures.
After due discussion and consideration,the NACC voted to issue the Negative #3 DOA with no special
conditions as work has already been undertaken.

The applicant,homeowner and their contractors are advised that NO other work on the property is
allowed under this permit. The NACC has jurisdiction over all of the wetlands and associated 100-Foot
buffer zones on site and any work that involves ground disturbance or changing the current conditions
in these areas will require permitting with the NACC. This includes,but are not limited to,house
additions,pools,patios, decks, sheds,fences, garden beds,landscaping and bridge installation, tree or
vegetation cutting/pruning. These activities shall be held to the current standards under the Bylaw and
WPA.

Vegetation Management Plans which are valid for the duration of the Plan). This Determination does
not relieve the applicant from complying with all other applicable federal, ahaha, or local statutes,

D. Appeals
The applicant, owner, any person aggrieved by this Detennination, any owner of land abutting the land
upon which the proposed work is to be done, or any ten residents of the city or town in which such land
is located, are hereby notified of their right to request the appropriate Department of Environmental
Protection Regional Office (see
ional-offices-bv-
coMnLunity) to issue a Superseding Determination of Applicability. The request must be made by -
certified mail or hand delivery to the Department, with the appropriate filing fee and Fee Transmittal
Form (see Request for Departmental Action Fee Transmittal Form) as provided in 310 CMR 10.03(7)
within ten business days from the date of issuance of this Determination. A copy of the request shall at
the same time be sent bycertified mail or hand delivery to the Conservation Commission and to the
applicant if he/she is not the appellant, The request shall state clearly and concisely the objections to
the Determination which is being appealed. Tothe extent that the Determination io based ono
municipal ordinance or bylaw and not on the Massachusetts Wetlands Protection Act or regulations, the
Department ofEnvironmental Protection has no appellate jurisdiction.
