Sean F. McDonough arrived at the meeting at: 7:15 P.M.
Albert P. Manzi,Jr., arrived at the meeting at: 8:20 P. M.
Pledge of Allegiance
Meeting came to Order at: 7:10 P. M. Quorum Present.
A motion to approve the minutes as revised 9/10/08, 9/24/08, 10/8/08; 11/5/08 was made by
Ms. Feltovic, seconded by Mr. Masse. Unanimous.
General Business

No one was present A motion to continue to February 11, 2009 meeting was made by Ms
Feltovic, seconded by Mr Napoli Unanimous
242-1261,Extension Request, Cotuit & Leyden Street (Burke)(New England Engineering
Services, Inc.)
The applicant Mr John Burke was present Ms Hughes discussed the stormwater management
plan the applicant needs to send in information about the maintenance of the dention pond on the
site Mr Lynch discussed this project has come out great because of the soft market on selling
houses has caused a problem for this phased projects maybe the Conservation Commission
would consider doing an Enforcement Order to allow work to continue because the project is
80% done A motion to issue a one-year extension to 1/12/10 hold till stormwater management
plan submitted was made by Mr Lynch, seconded by Ms Feltovic Unanimous

Tony Capachietti of Christiansen & Sergi, Inc was present Mr Napoli left the room conflict of
interest Mr Capachietti discussed there had been 6 days of lapse in time from 1 St enforcement
order to insurance of the seconded enforcement order Ms Hughes discussed the project has been
completed and site looks good the applicant was very proactive to correct the errors that was
done wrong Mr McDonough discussed the fine of 300 00 a day from then on October 8, 2008
the Conservation Commission did not have a quorum for the meeting to vote and stop the fines
Mr McDonough discussed the amount of the fine is 2,100 or 1,8009 Ms Hughes discussed the

amount of the fine $1,800 Mr McDonough discussed the fine amount the Conservation
Commission would accept is an amount of$1,500 A motion to issue the COC and release the
bond contingent the fine in the amount of$1,500 is paid before releasing any thing to the
applicant was made by Mr McDonough, seconded by Ms Feltovic Unanimous
Mr. Napoli returned to the meeting.
242- 1440, COC Request, 1430 Great Pond Road (Muldoon)(Merrimack Engineering
Services, Inc.)
No one was present Ms Hughes discussed the applicant found out the Planning Department and
the Health Department denied his building permit because the applicant is in the watershed
protection district and the health department required the applicant to tie into sewer Ms Hughes
discussed another problem with were the wetland markers are placed right on the lawn area the
applicant requested the move them onto trees The Conservation Commission was fine with
reinstalling the wetland makers on the trees A motion to issue the COC and release the bond was
made by Mr McDonough, seconded by Ms Feltovic Unanimous
Small Project
NACC#48 & 242-1412, 24 Crossbow Lane (Manning)(AHO Surveying)
No one was present Ms Hughes discussed the applicant request at a last meeting to cut down
four trees but was denied by the Conservation Commission because they were within the 25-foot
No-Disturbance zone Mr McDonough discussed about no stumping of the trees at all A motion
to accept this as small project was made by Mr McDonough, seconded by Ms Feltovic
Unanimous Mr Mabon discusses the Conservation Commission needs to reconsider the vote to
require no stumping of the trees A motion to reconsider the previous vote was made by Mr
McDonough, seconded by Ms Feltovic Unanimous Conservation Commission had a discussion
about stumping of the trees the applicant would not be able to stump trees within the ground to
stabilize the site A motion to accept this, as a small project J and no stumping of the trees must
leave roots in the ground was made by Mr McDonough, seconded by Ms Feltovic Unanimous

interest Ms Hughes discussed the applicant has requested a waiver of the fines incurred when
original enforcement order lapsed and a new one was in place Mr Lynch discussed the site has
been completed and stabilize brought back to original filing that was approved by Conservation
Commission Mr Capachietti discussed there was a modification issued for the site A motion to
require the fine of$1,500 has to be paid was made by Mr McDonough, seconded Mr Lynch
Unanimous
Mr. Napoli returned to the meeting.

Greg Hochmuth of The Neve-Morin Group, Inc was present Mr Masse read the legal notice
Mr Napoli discussed showing the soil stockpiling area on the plan Mr Hochmuth discussed
there would be installation of riprap by the driveway, wetland markers on the side of driveway
A motion to continue to February 11, 2009 meeting for revised plans was made by Mr Lynch,
seconded by Mr Masse Unanimous

The applicant Donna Lind and Thomas J Keough Jr , of Hancock Associates were present The
Conservation Commission discussed the size of the deck needs to be cut down in size to make
this approval thru Conservation Commission The Conservation Commission discussed the
applicant should install a picket fence The Conservation Commission discussed there is not a P
E stamp on the plans needs to be stamped by P E A motion to continue to February 11, 2009

The applicant Anthony Mesiti of Mesiti Development Corporation and James Buchannan of
Mesiti Development Corporation were present Mr Masse discussed this filing is under the
jurisdiction of Zoning Board of Appeals the applicant would have to check with Zoning
department to see if the smaller units would trigger refilling with the Zoning Board of Appeals
Mr Buchannan discussed about the Enforcement Order would be for testing of the fire hydrants
location of the water lines, heating blankets on the existing foundations putting in some footing
within the next 3 weeks also West Environmental has been hired to be Environmental Monitor
on the site A motion to issue a Enforcement Order to allow work to continue on the site till
Order of Conditions would be issued was made by Mr Masse, seconded by Ms Feltovic
Unanimous A motion to continue to February 11, 2009 meeting was made by Mr Masse,
seconded by Ms Feltovic Unanimous
A motion to adjourn the meeting at: 9:30 P. M. was made by Mr. Masse, seconded by Mr.
Manzi. Unanimous.
