M. Quorum Present. General Business A motion to approve the minutes of October 22,2008 was made by Ms. Feltovic, seconded by Mr. Masse. Unanimous. NACC#27, COC Request, 80 Holly Ridge Road (Marroni)(Hayes Engineering, Inc.)(cont. from 1/21/09)(Reguest to cont. to 3/25/09) No one was present A motion to continue to March 25, 2009 meeting was made by Mr Manzi, seconded by Ms Feltovic Unanimous 242-1353, COC Request, 2163 Turnpike Street (Adams)(Giles Surveying) The applicants Mr & Mrs David Adams were present A motion to issue the COC and release the bond was made by Mr Manzi, seconded by Ms Feltovic Unanimous 242-1347,Extension Request, 492 Sutton Street (Lawrence Municipal Airport)(Stantec Consulting Services, Inc.) Randall P Christensen of Stantec Consulting Services, Inc was present Ms Hughes discussed the monitoring report comprehensive monitoring report by September 30, 2009 and co-ordinate installation of the wetland markers by June 30, 2009 A motion to issue the one-year extension was made by Mr Manzi, seconded by Mr Lynch Unanimous 242-1438, COC Request,32 Stonewedge Circle (Johnson)(Eugene T. Sullivan Consulting Engineers,Inc.) No one was present A motion to issue the COC and release the bond was made by Ms Feltovic, seconded by Mr Masse Unanimous 1 242- 834, Request for a Partial Bond Release (Merrimack College)(Kaminski & Associates, Inc. Richard F Kaminski of Kaminski & Associates, Inc was present Mr Manzi discussed the Conservation Commission should issue an Enforcement Order to allow the applicant to work on the site the Order of Conditions has expired Ms Hughes discussed there was an Enforcement Letter sent out to Merrimack College A motion to issue a friendly Enforcement Order was made by Mr Lynch, seconded by Ms Feltovic Unanimous A motion to issue a partial bond release in the amount of$11,000 only was made by Mr Lynch, seconded by Mr Manzi Unanimous 242-1376, Conservation Restriction 1275 Turnpike Street (Boston Hill)(The Gralia Group) Cynthia A Redm, Esq of The Gralia Group, Town Counsel Thomas J Urbelis, Matthew Linden of Marchionda Associates, Inc , Christopher Ward of the Trustees of Reservation, and Adam Rolfs of the Trustees of Reservation were present Mr Ward discussed the Trustee of Reservation would like the trail connected to Ward Reservation trail along top of the hill Mr Urbelis discussed this would be something we can work on with this group to connect the trails Mr Lynch discussed this has to be put on a Town Meeting Warrant so the Town of North Andover can change the Conservation Restriction this would have to be sold at Town Meeting attendees Then goes the State of Massachusetts Legislatives would have change the Conservation Restriction also after all the Town of North Andover Boards approve of the Conservation Restriction This is a long process depends what Town Meeting attendees feel about the change within the Conservation Restriction Mr Manzi discussed about trials and maintenance of the trails habitat along the trails`this trail system differently needs to be connected the Ward Reservation trail owned by the Trustees of Reservation Come back some language change run by Town Counsel then the Conservation Commission might give ok to go forward with this plan Mr. Manzi left the room at: 8:00 P. M. and returned to meeting at: 8:05 P. M. No Recess Public Hearings: 8:05 P. M. The applicants Mr & Mrs Nicholas Leonardi were present Ms Feltovic read legal notice Ms Hughes discussed the project is similar to what was approved for 1430 Great Pond Road Muldoon Mr Manzi discussed the shed has to be moved enhancement planting plan request a waiver for plan requirement A motion to continue to February 25, 2009 meeting was made by Mr Manzi, seconded by Ms Feltovic Unanimous 242-1449, 80 Dale Street(New England Power Company)(VHB) The applicant Andrea Desilets of Nationalgrid and Marc Bergeron of Vanasse Hangen Brustlin, Inc were present Ms Feltovic read the legal notice A motion to close and make a decision within 21 days was made by Mr Lynch, seconded by Ms Feltovic Unanimous Decision 242-1448, 506 Boston Street Mr Manzi discussed the bond amount that the Conservation Commission with these filing for bond case by case for septic replacement because there could be some serious ground disturbance with some of the filings A motion to accept the Order of Conditions as drafted was made by Mr Lynch, seconded by Ms Feltovic Unanimous A motion to adjourn the meeting at: 9:00 P. M. was made by Ms. Feltovic, seconded by Mr. Manzi. Unanimous. 3
