HomeMy WebLinkAbout2009-02-25 Conservation Commission Minutes Conservation Commission Meeting Minutes February 25, 2009 Members Present: Sean F McDonough, Vice Chairman, Deborah A Feltovic, Albert P Manzi, Louis A Napoli Members Absent: John J Mabon, Chairman, Scott L Masse, Joseph W Lynch, Jr Staff Members Present: Jennifer A Hughes, Conservation Administrator, Donna M Wedge, Conservation Secretary Pledge of Allegiance Meeting came to Order at: 8:20 P. M. Quorum Present. General Business 242-1376, Conservation Restriction (Boston Hill)(The Gralia Group)(cont. from 2/11/09) The applicant Cynthia A Redin, Esq of The Gralia Group and Paul Marchionda of Marchionda Associates, Inc were present Ms Hughes discussed the Conservation Commission should vote to approve the Amendment to the Conservation Restriction in concept, assuming all other necessary approvals are granted town meeting, state legislature A motion to vote in favor to put on Town Warrant for Town Meeting was made by Mr Manzi, seconded by Ms Feltovic Unanimous A motion to approve as amended the Conservation Restriction for Town Meeting was made by Mr Manzi, seconded by Ms Feltovic Unanimous Enforcement Order(s) 242-1447, 2357 Turnpike Street(Valley Realty Development, LLC)(Merrimack Engineering Services, Inc.)(cont. from 2/11/09) No one was present Ms Hughes discussed to issue a new Enforcement Order to allow work to continue on the property to allow clean up stumps from trees, leaves and other debris that has accumulated over the years no work has been done Enforcement Order would expire 3/25/09 West Environmental, Inc is the Environmental Monitor and submitting weekly reports Mr Manzi discussed if any thing goes wrong on the site issue a stop work order A motion to issue a new Enforcement Order was made by Mr Manzi, seconded by Ms Feltovic Unanimous No Recess Public Hearings: 8:40 P. M. Notice of Intent(s) 1 i 242-1447, 2357 Turnpike Street(Valley Realty Development, LLC)(Merrimack Engineering Services,Inc.)(cont. from 2/11/09) No one was present Ms Hughes discussed the applicant is requesting a continuance to March 25, 2009 meeting because the applicant has filed for minor modification to the comprehensive permit(40B) with the Zoning Board of Appeals there meeting is not until March 19, 2009 A motion to continue to March 25, 2009 meeting was made by Mr Manzi, seconded by Ms Feltovic Unanimous 242-1450, 61 Johnson Circle (Leonardi)(New England Engineering Services,Inc.)(cont. from 2/11/09) The applicants Mr & Mrs Nicholas Leonardi were present Ms Hughes discussed the applicant is doing 346 s f of restoration which is a large gam of replication area with plantings to stabilize the site there would only be hand dug sono tubes for the installation the three season sunroom A motion to close an issue a decision within 21 days was made by Mr Manzi, seconded by Ms Feltovic Unanimous Decisions 242-1446, 575 Winter Street (Lind)(Hancock Associates) The applicant Donna Lind was present Ms Hughes discussed the homeowner would install post and rail fence, replication area of plantings Mr Manzi discussed the monitoring of the plantings should be monitoring for 3 years instead of 2 because the Order of Conditions expires in three years A motion to accept the Order of Conditions as-drafted option 2 and as amended for three years growing seasons for the monitoring of the planting plan was made by Mr Manzi, seconded by Ms Feltovic Vote 3-0-1 Mr McDonough abstained from voting 242-1449, 80 Dale Street No one was present A motion to accept the Order of Conditions as-drafted was made by Mr Manzi, seconded by Mr Napoli Vote 3-0-1 Mr McDonough abstained from voting A motion to adjourn the meeting at: 9:00 P. M. was made by Mr. Manzi, seconded by Ms. Feltovic. Unanimous. 2
