Lynch, Jr., arrived at the meeting at: 7:30 P. M. Pledge of Allegiance Meeting came to Order at: 7:05 P. M. Quorum Present. General Business NACC929,Modification Request, 12 Bonny Lane (Grasso)(Cammett Engineering) The applicant Anthony Grasso and Donald F Borenstem, Esq of Johnson& Borenstem, LLC were present Mr Borenstem discussed the house would be moved closer to the roadway on Bonny Lane the project now is 65-feet away from any resource areas on this site A motion to issue the modification was made by Ms Feltovic, seconded by Mr Napoli Unanimous 242-1394,Modification Request, 89 Milk Street (Highview,LLC)(Merrimack Engineering Services, Inc.) John Murphy of Merrimack Engineering Services, Inc was present Ms Hughes discussed the proposed modification moves the house closer to the resource area 50 6-feet away with the modification Mr Murphy discussed the builder was ask to build a ranch house with one floor verses two story home like colonial home The buffer zone would be enhanced with planting 17 trees on the site, also installation two recharge areas for water run off would be captured within the site The installation of dry set boulder wall along the 25-foot No-Disturbance zone A motion to issue the modification was made by Ms Feltovic, seconded by Mr Masse 4-0-1 vote Mr Lynch abstained from voting 242-634, PCOC Request, 43 Oxbow Circle (Broadhurst)(Haves Engineering, Inc.)(Request to coat. to 4/22/09) No one was present A motion to continue to April 22, 2009 meeting was made by Ms Feltovic, seconded by Mr Lynch Unanimous 242-1352, Extension Request, 1600 Osgood Street (VMP)(Ozzy Properties)(Epsilon Associates, Inc.) Julie Vondrak of Epsilon Associates, Inc was present Mrs Vondrak discussed this is for an extension to the vegetated management plan this plan is for removing vegetation along fences, headwall cleaning, weeds and grass removal from drainage areas, cleaning catch basins, 1 sweeping parking lots This spring and fall would send in reports what work has been completed during the season Mrs Vondrak would set up a site walk with Jennifer Hughes this summer The O &M plan is a plan that stays in place for perpetuity on the property This area was developed in the 1950's and the site was not maintained at all for many years The applicant if any work would be done in the future development on the property there would be a separate filing for that project right now there is no plans to do any project with the property for now A motion to issue a one-year extension was made by Mr Masse, seconded by Ms Feltovic Unanimous Enforcement Order 242-1279, Follow up, 189 Willow Street (Chatteriee) No one was present Ms Hughes discussed the site has been stabilized as of 4/7/09,the dirt piles were removed off site, silt fence installed only the site finally looks better than before The monitoring report has not been submitted that was requirement of the Enforcement Order Mr Mabon discussed the fine total today is $3,000 dollars Friends of North Andover Trails (Annual Vegetated Management Plan) Thomas Powers of the Friends of North Andover Trails was present Ms Hughes discussed this is a friendly Enforcement Order to allow 2009 trail maintenance as last year on the Open Space Parcels in the Town of North Andover Mr Mabon discussed the Friends of North Andover Trails have been very helpful cleaning brush by using lawn mowers, chain saws and cleaning access to keep the trails accessible to residents to be able to enjoy the trails in the Town of North Andover A motion to issue a friendly enforcement order to allow the Friends of North Andover Trails to do trail maintenance for 2009 season was made by Ms Feltovic, seconded by Mr Lynch Unanimous 242-1354, 10 Inglewood Street (Xenakis)(EPA) No one was present Ms Hughes discussed there was an Enforcement Order issued per the US EPA reported the violation and agreed to have us resolve the problem Mr John Xenakis of 11 Inglewood Street has already backfilled the trenches and proposed to reseed with wetland mix from Pierson Nurseries of New England Wetland Plant final restoration by May 1, 2009 A motion to ratify the Enforcement Order was made by Mr Masse, seconded by Ms Feltovic Unanimous Small Project NACC#, 70 Wesley Street (Nye) (Sewer Tie-In)(ARCO Excavators, Inc.) The applicant Raymond Nye was present Mr Lynch discussed an alternative and less expensive route for proposed sewer line The new proposed route would extend up Adrian Street to Saville Street, which would require less piping to be installed Mr Napoli agreed and urged the applicant to explore the Adrian Street alternative with his contractor and the Sewer Department A motion to accept the filing as a small project under 4 4 2D, sewer line installation was made Mr Lynch, seconded by Ms Feltovic Unanimous A motion was made by Mr Lynch, seconded by Ms Feltovic to allow the sewer connection from Wesley Street with following conditions 1) The applicant rule out the feasibility of the alternative pump chamber location via Adrian Street 2 2) If alternative is not feasible, the installation of a sewer will be allowed according to the proposed plan 3)No work the stone retaining wall will be allowed under the small project Unanimous Note The Applicant has determined the alternative pump chamber location and sewer connection route via Adrian Street is feasible A permit from the NACC is not necessary for this work A permit will be necessary for removal of the stonewall Renewal of Agricultural Leases Mr Masse discussed this project would Mr Manzi project Post storm event site inspections 57 Long Pasture Road Ms Hughes discussed there was major runoff from the long driveway into the catch basins and thru the run-off pipe These areas need to be cleaned up The Conservation Commission discussed there would need to be an Enforcement Order issued to cease and desist immediately because of sedimentation run-off into stormwater management system the area would have to be cleaned up right away A motion to issue an Enforcement Order was made by Mr Lynch, seconded Ms Feltovic Unanimous Redgate Lane Ms Hughes discussed there has been a problem with run-off of water to abutters property Stephen P Cyr of 895 Salem Street The Town Planner has been the one mostly handling this problem of major run-off on to the street The erosion controls need to be refreshed the catch basins need to be cleaned out and, severe siltation of the detention ponds The ponds have not been maintained The large amounts of accumulated sediments in the ponds have decreased their storage capacity and reduced their function untreated stormwater is leaving the site during rain events and flooding of the abutting property 895 Salem Street A motion to adjourn the meeting at: 9:30 P.
