Masse arrived at the meeting at: 7:25 P. M. Pledge of Allegiance Meeting came to Order at: 7:05 P. M. Quorum Present. General Business A motion to approve the minutes of 12/3/08 was made by Ms. Feltovic, seconded by Mr. Lynch. Unanimous. NACC#27, Modification Request, 80 Holly Ridge Road (Marroni)(Haves Engineering, Inc.)(cont. from 2/11/09) The applicant Kimberly Marrom was present Ms Hughes discussed the modification is for various walkways, patio larger, fencing rod iron fencing, pool house larger than approved Ms Marrom discussed the boulder wall can we install a split rail fence Mr Manzi discussed the split rail fence can be knocked over very easy The Conservation Commission would require a boulder wall installed only Mr Lynch discussed the paver walkway can stay there is not much disturbance in this area Ms Marrom discussed there is 450 s f of impervious surface but we are planning to due a planting plan to increase the buffer zone and plant Highbush blueberry and bearberry to mitigate for the increases of impervious areas Ms Hughes recommendation of monitoring for one year A motion to issue the modification and new record plan dated March 17, 2009 was made by Mr Manzi, seconded by Ms Feltovic Unanimous 242-1395, COC Request, 59 Appleton Street (Vellante)(Sullivan Engineering Group, LLC) No one was present Ms Hughes discussed the shed was removed the perimeter drain was installed but perimeter drain outlets in to crushed stone pit within the yard, wetland makers should be installed on the property A motion to issue the COC and release the bond but hold till wetland makers are installed was made by Mr Lynch, seconded by Ms Feltovic Unanimous 242-1279, Extension Reguest, 189 Willow Street (Lot 4)(Chattergee)(Joseph D. LaGrasse & Associates, Inc.) No one was present Ms Hughes discussed this site is a mess the erosion controls falling apart, two soil stockpiling area on the site without proper erosion controls on the site There was an Enforcement Order issued in 2008 for not meeting pre-construction requirements The flagging 1 needs to be refreshed on the site A motion to deny the Extension Request was made by Mr Manzi, seconded by Ms Feltovic Unanimous Mr Manzi discussed there would be an Enforcement Order issued with a deadline to get the site cleaned up and stabilized within 7 days on the eight day if site not stabilized there would a fine of$300 per day till the site is stabilized from any erosion on the site A motion to issue an Enforcement Order to require the site to be stabilized within 7 days was made by Mr Lynch, seconded by Mr Napoli Unanimous 242-1398, Modification Request, Grading Plan, 575 Osgood Street, (Edgewood Retirement Community, Inc.)(Marchionda & Associates, L.P.)(cont. from 3/11/09) The applicant Kevin Tremblay of Edgewood Director of Development and Construction, and David M Mermelstem of Trident Project Advantage Group were present Ms Hughes discussed Edgewood has submitted a revised grading plan for area G also the applicant would like have approve a soil stockpiling areas on the site A motion to accept the modification for the grading plan dated 3/16/09 was made by Mr Lynch, seconded by Mr Napoli Unanimous The current soil stockpiling area is on the proposed house lot and will need to be used Ms Hughes discussed the applicant must sweep the street two times weekly to control the soil on the roadways Mr Mabon discussed 2 plans to pre-school area along the roadway there is crushed pipe within the roadway so this would be fixed this is in the area of the Milk Barn Mr Lynch discussed the spot grades should be shown on the plan the grade here at the highest point 166-173 feet to the east A motion to accept the modification for the soil stockpiling area was made by Mr Manzi, seconded by Ms Feltovic Unanimous 242-809, Modification Request, 115 Sherwood Drive (Lot 11)(Messina Development Corporation)(Christiansen & Sergi, Inc.) The applicant Robert Messina was present Mr Messina discussed this has been 10 years the house has been sold a couple of times Mr Masse discussed on the other lot 12 we made a deal that the site would be left as built no further work would be able to been done on the site The Conservation Commission never accepted this lot because the builder here caused his own problem The Conservation Commission would only allow the builder to work with the homeowner now to allow him to cantilever the deck and cut the portion of the driveway that was extended without the Conservation Commissions permission to do this work on this lot A motion to continue to April 22, 2009 meeting to see if the applicant can work the homeowner now to bring the site in compliance was made by Mr Manzi, seconded by Mr Lynch Unanimous 242-1317, Extension Request, 99 Ogunquit Road (Lot 5)(Breen)(The Neve-Morin Group, Inc. Notice of Intent (s) 242-1445, 674 Turnpike Street (Londi)(Mistry Associates, Inc.)(cont. from 2/11/09)(Reguest to cont. to 4/22/09) No one was present A motion to continue to April 22, 2009 meeting was made by Mr Manzi, seconded by Mr Napoli Unanimous 242-1447, 2357 Turnpike Street (Valley Realty Development)(Merrimack Engineering Services, Inc.)(cont. from 2/11/09) The applicant Anthony Mesiti of Mesiti Development Corporation and James Buchannan of Mesiti Development Corporation were present Ms Hughes discussed the Zoning Board of Appeals has heard the modification and has been signed by Zoning Board of Appeals A motion to close and issue a decision within 21 days was made by Mr Manzi, seconded by Ms Feltovic Unanimous Decision 242-1447, 2357 Turnpike Street(Valley Realty Development) The applicant Anthony Mesiti of Mesiti Development Corporation and James Buchannan of Mesiti Development Corporation were present A motion to accept the Order of Conditions as drafted was made by Mr Manzi, seconded by Ms Feltovic Unanimous Discussion Beetle Release Program in the Shawsheen River Watershed No decision Airsoft on Open Space Parcels No vote by the North Andover Conservation Commission 120 Duncan Drive Project can be done by small project filing for a water line installation with the Conservation Commission 10 Inglewood Street Issue an Enforcement to fix the trenching done on the site A motion to adjourn the meeting at: 9:45 P.
