M. Quorum Present General Business 242-1398,Modification Request, 575 Osgood Street (Edgewood Retirement Community, Inc.)(Marchionda & Associates, L. P.) Benjamin C Osgood, Jr, of Pennoni Associates, Inc was present A motion to issue the one- year extension was made by Mr Manzi, seconded by Ms Feltovic Unanimous Enforcement Order(s) 242-1279, 189 Willow Street (Lot 4)(Chatteriee) Leah Basbanes of Basbanes Associates was present Mr Manzi discussed the Conservation Commission would reduce the fine to $1,800, and require as-built plan for boxed culvert installed, and require the restoration plan be installed by June 10, 2009 meeting give the applicant 30 days to install the planting plan A motion to issue a new Enforcement Order for the applicant pay the fine and to allow plantings to be planted was made by Mr Manzi, seconded by Mr Lynch Unanimous 57 Long Pasture Road (Lot 5) No one was present Ms Hushes discussed the applicant has been very pro-active in cleaning up the site, the two catch basin have been cleaned within the subdivision Redgate Subdivision (Map 65 Parcel 21 & 164)(Chongris) The applicant Dean Chongris and Benjamin C Osgood, Jr , of Pennom Associates, Inc were present Ms Hughes discussed the detention basin confirmed that it is the correct size Mr Osgood discussed that the detention basin has not been cleaned out there is a lot of silt sedimentation within the basin and the applicant needs to stabilize the site with grass, install extra erosion controls install some spread some hay mulch to keep sedimentation and silt running in the Town of North Andover catch basins within the street Mr Osgood discussed this is being watched by EPA and DEP also Mr Osgood discussed last spring New England Engineering Services stopped monitoring site because the company was being paid for monitoring the site Mr Manzi discussed the site needs to be stabilized by May 11, 2009 seeded loamed and dewatering plan for the site Ms Hughes discussed the Planning Department is getting weekly monitoring reports on the site this was non jurisdictional subdivision with the Conservation Commission because the houses being built are outside of 100-foot Buffer Zone A motion to accept to have the area cleaned up and plan in place for dewatering was made by Mr Lynch, seconded by Ms Feltovic Unanimous Emergency Certification Bradford Street (Division of Public Works) Eugene Willis P E , of The Division of Public Works and Tara E McManus, P E , of Weston& Sampson Engineers, Inc were present Ms Hughes discussed this is by Carter Field Subdivision which the Division of Public Works needs to clean up sand and sedimentation within the Swale which over time has built up excessive amounts of silt from sanding operations this area just needs to cleared of debris within the resource area cleaning out treatment swale A motion to issue an Emergency Certificate was made by Ms Feltovic, seconded by Mr Manzi Unanimous 2 r , Small Project NACC#50, 55 Peach Tree Lane (DeMont)(Marchionda & Associates, L. Request for Determination of Applicability 1212 Salem Street (Hanley)(Sullivan Engineering Group, LLC) Jack Sullivan of Sullivan Engineering Group, LLC was present A motion to issue a negative determination with requirement of wetland markers was made by Mr Lynch, seconded by Ms Feltovic Unanimous ' Notice of Intent(s) 242-1451, Autran Avenue (Division of Public Works)(Weston & Sampson, Inc.) Eugene Willis Town Engineer of the Town of North Andover and Tara E McManus P E of Weston & Sampson Engineers, Inc was present Mr Willis discussed reduce amount of riprap and jute mat, 2 trees dead would be removed The outfall rock bed paved and gravel installed Ms McManus discussed there would be 7 blueberry plantings were the trees would be removed Mr Willis discussed the neighbor flooding out lawn areas along the street this filing would correct the problem A motion to close and issue a decision within 21 days was made by Mr Lynch, seconded by Ms Feltovic Unanimous Land Conservation 0 Lacy Street(Kittredge) Windrush Farm A motion to take favorable action for Town Meeting vote was made by Mr Lynch, seconded by Mr Napoli Unanimous A motion to adjourn the meeting at: 10:00 P.
