Meeting came to Order at: 7:10 P. M. Quorum Present.
General Business
242-1398, Modification Request, 575 Osgood Street (Edgewood Retirement Community,
Inc.)(Marchionda & Associates, L. P.) (cont. from 5/20/09)
The applicant Marlene Rotering Director of Edgewood Retirement Community, Inc , Kevin
Tremblay Director of Development and Construction of Edgewood Retirement Community, Inc ,
and David M Mermelstein of Trident Project Advantage Group, Anthony Capachietti of
Christiansen& Sergi, Inc were present The Conservation Commission discussed submit a new
plan showing all the modifications that have been done on the site Mr Capachietti discussed this
is general modification for razing the barn impervious driveway and side walks areas This
modification is only for razing the barn and drainage improvement on 21 Carolina Way Mr
Manzi discussed the stormwater runoff in this area needs be corrected Mr Capachietti needs to
talk to Lisa Eggleston about 3 & 5 in her report to correct the drainage problem on the site Mr
Capachietti discussed report#2 has been fixed also the collapsed culvert on the Day School
property has been fixed Mr Lynch discussed there number 4 has been completed define the
channel with soil stockpiling area within the channel area that would have to be cleaned out to
make sure the water keeps flowing all the time fix the other collapsed culverts on the site A
motion to issue the modification for the milk barn razing and 21 Carolina Way G3 area for
drainage improvement was made by Mr Lynch, seconded by Ms Feltovic Unanimous

Inc.
The Applicant Mr & Mrs O' Mahony was present Ms Hughes discussed there are 7 wetland
makers installed on posts in the proper area also the shed has been moved outside of 50-foot No-
Build The front yard has not been mowed and growing back to the natural state Mr Lynch
discussed the Conservation Commission also likes stonewalls because they protect the resource
areas Mr Manzi discussed they can do planting plan should be submitted to the Administrator
for review and acceptance Also sketch on the plan the areas of the deviation on the site so the
Conservation Commission can approve a plan as record A motion to continue to June 24, 2009
meeting was made by Mr Manzi, seconded by Ms Feltovic Unanimous

Patrick Bower of Andover Consultants was present Mr Lynch discussed Jennifer Hughes did
you put plan on light table to compare Ms Hughes states yes did check the plan on the light
table Mr Bowers discussed the house is going to be constructed smaller than approved The
driveway would be a little longer than approved The driveway would constructed with honey
comb concrete which would allow water to seep thru the cracks to allow ground water to be
captured with in the ground and would not allow any sheet flow on the driveway Mr Bowers
would submit a new landscaping plan A motion to issue the modification was made by Mr
McDonough, seconded by Ms Feltovic Unanimous

No one was present Ms Hughes discussed the deck constructed smaller the railroad ties were
removed and grant stairs were installed near Stevens Pond the area is stabilized and looks fine A
motion to issue the COC and release the bond was made by Mr Manzi, seconded by Mr
McDonough Unanimous
242-683, PCOC Reguest, 106 Weyland Circle (Lot38)(Zimmerman)
The applicant Mrs Zimmerman was present Ms Hughes discussed this is not a jurisdictional lot
this is inside lot there area no wetlands on this site at all A motion to issue the PCOC was made
by Mr Lynch, seconded by Ms Feltovic Unanimous
Small Project
NACC953, 281 Blue Ridge Road (Skowronek)
The applicant Christopher Skowronek was present Ms Hughes discussed this is for the
replacement of an exiting deck in the same footprint A motion to accept as in kind replacement
4 4 2B was made Mr Lynch, seconded by Mr Napoli Unanimous Mr Lynch, seconded by Mr
Napoli, made a motion grant as a small project Unanimous
Enforcement Order Update
242-1279, 189 Willow Street (Lot 4)(Chatter6ee)
Leah Basbanes of Basbanes Associates was present The Conservation Commission discussed
they would have to re-file a new Notice of Intent if they want to do any more work on this
property, also the monitoring on the replication area would have to be monitored for 2 years
spring and fall The applicant can also submit a COC request because of the box culvert installed
and no other work took place on this property down the road this lot may not be build able
because the box culvert was created and could cause the land turn into total wetlands over time
Enforcement Order Ratification
47 Moody Street, (Moody), 58 Colgate Drive, (Winne)
No one was present Ms Hughes discussed the applicant Mr Robert Winne is in violation on this
site he was told to move the mulch outside of the streambed to allow water to still move Ms
Hughes discussed the wetland would be flagged by myself to see how far the mulch would have
to moved outside of 25-foot No-Disturbance zone and outside the 50-foot No-Build zone A
motion to ratify the Enforcement Order was made by Mr McDonough, seconded Mr Lynch

Patrick Bower of Andover Consultants, Inc was present Mr Bower discussed the stormwater
management plan would be swale and infiltrators put in the ground to prevent sheet flow Ms
Hughes discussed the there should be no-snow stockpiling signs and no-salt signs installed on
site and long term pollution prevention plan should be in place A motion to continue to June 24,
2009 meeting was made by Mr Manzi, seconded by Ms Feltovic Unanimous

No one was present Ms Hughes discussed this form just need to be signed to move forward
with the Conservation Restriction on this property
Land Grant for Windrush Farm
Lacy Street(Windrush Farm)(Land Grant)
Ms Hughes discussed this is applying for grant money to help the Town of North Andover with
more funding for buying the Open Space parcels A motion to accept the grant money and send
in form to proceed to apply for the grant money was made by Mr McDonough, seconded by Mr
Lynch Unanimous
A motion to adjourn the meeting at: 9:30 P. M. was made by Ms. Feltovic, seconded by Mr.
Manzi. Unanimous.
