Manzi,Jr., left the meeting at: 9:20 PM Pledge of Allegiance Meeting came to Order at: 7:07 P. M. Quorum Present. General Business 242-745, COC Request, 143 Lacy Street (O' Mahony)(Merrimack Engineering Services, In_c.)(cont. from 6/10/09) The applicant Mr & Mrs O' Mahony were present Ms Hughes discussed the plantings have been installed every 8-feet spruce trees and evergreen total planting 33 trees and shrubs A motion to issue the COC and release the bond was made by Mr Manzi, seconded by Mr Napoli Unanimous 242-1203, COC Reguest, 10 Stiles Street(Willis) Eugene Willis the Town Engineer was present Ms Hughes discussed the deck was built smaller in size than approved, there is a long gravel driveway which is fine The site is totally stable and wildlife crossing thru the site no issues A motion to issue the COC and release the bond was made by Mr Manzi, seconded by Mr Lynch Unanimous 242-140, PCOC Request 55 Vest Way (Lot 39)(Middleton) Mr & Mrs Middleton was present Ms Hughes discussed this site is in an upland location with no wetland within 100-feet of the property A motion to issue the PCOC was made by Mr Napoli, seconded by Mr Manzi Unanimous Small Project NACC#54, 136 Bridle Path (Lonilato)(New England Engineering Services, Inc) The applicant Stephen Lopilato was present Ms Hughes discussed this small project is for the installation of sewer tie in line but this goes over drainage pipe under the driveway Mr Lynch discussed that there should some kind protection from the piping freezing Mr Lopilato discussed there would two pump chambers installed on this system with an alarm A motion to accept this as 4 4 2D was made by Mr McDonough, seconded by Mr Manzi Unanimous A motion to accept as a small project was made by Mr McDonough, seconded by Mr Lynch Unanimous 1 A motion to have a 29-minute recess was made by Mr. Manzi, seconded by Mr. McDonough. Unanimous. Public Hearings: 8:01 P. M. Request for Determination of Applicability Chestnut Street, (North Andover Division of Public Works) Eugene Willis Town of North Andover Town Engineer and Abutter Sarada Kommareddi of 470 Chestnut Street was present Ms Hughes discussed Mr Napoli reviewed the site few weeks ago Mr Manzi discussed this would be an improvement in the backyard path down to Mosquito Brook Mr Mabon discussed the roadway binder with crown inch '/2 of overlay Mr Willis discussed installation of catch basin, manhole drainage and installation of sidewalks from 450 to 470 Chestnut Street, extension of drainage improvements A motion to issue a negative determination with conditions, pre-construction, final plan showing all drainage structures and berms shall be submitted for approval to the Stormwater Subcommittee was made by Mr Manzi, seconded by Mr Napoli Unanimous Route 495 between Exit 43 and 44 (MAHighway) The applicant Tara Mitchell of MA Highway was present Ms Hughes discussed the site has not been reviewed because safety and access reasons Mr Manzi discussed the problem with spraying would the drainage areas may be affected may be erosion controls should be installed when they spray herbicide within the area A motion to issue a negative determination was made by Mr Lynch, seconded by Mr Manzi Unanimous Route 125, Route114-Salem/Turnpike, Chickering Road, Osgood Street (MAHighway) No one was present The Conservation Commission had a discussion that there is no one present at the meeting A motion to continue to July 8, 2009 meeting was made by Mr Lynch, seconded by Mr McDonough Unanimous The applicant Andrea Norton of MAHighway was present A motion to reopen the hearing was made by Mr McDonough, seconded by Mr Napoli Unanimous Ms Hughes discussed there should be protection of the drainage structures Mr Lynch discussed there should be silt sacks place within the catch basins so no grinding dust does not get into the drainage structures A motion to issue a negative determination was made by Mr Lynch, seconded by Mr Napoli Unanimous Notice of Intent (s) 242-1452,North Ramp Road, 492 Sutton Street (M.E.M.L.V., LLC)(Andover Consultants, Inc.)(cont. from 6/10/09) Patrick Bower of Andover Consultants, Inc was present Mr Napoli left the room abutter to the property Ms Hughes discussed Town Engineer has know more concerns should close and issue a decision within 21 days A motion to close and issue a decision within 21 days was made by Mr McDonough, seconded by Mr Lynch Unanimous 2 242-1451,Autran Avenue (North Andover Division of Public Works)(Weston & Sampson Engineers, Inc.)(cont. from 6/10/09) Eugene Willis Town of North Andover Town Engineer and Tara E McManus of Weston& Sampson Engineers, Inc was present Mr Napoli returned to the meeting Ms Hughes discussed the Division of Public Works would like to add Bay State Gas work to be included within the scope work presented by the Division of Public Work A motion to close and issue a decision within 21 days was made by Mr McDonough, seconded by Mr Manzi Unanimous 242- , Annual Road Maintenance (North Andover Division of Public works) Eugene Willis the Town of North Andover Town Engineer was present Ms Hughes discussed no DEP number or Natural Heritage comments A motion to continue to July 8, 2009 meeting was made by Mr Lynch, seconded by Mr Napoli Unanimous 242-1454, Sutton Street and High Street(North Andover Division of Public Works)(Weston & Sampson Engineers, Inc.) Tara E McManus of Weston& Sampson Engineers, Inc was present Ms McManus discussed there is some contaminated soil on the site this is located on the Clean Harbor site off of Sutton Street thru the sewer easement area Mr Lynch for dewatering you would need to use dewatering tank incase you hit high ground water Ms McManus discussed the sewer pipe would be increased in size from 12"to 24"pipe would installed 8 to 10 feet deep this project would only take about one week to complete A motion to close and issue a decision within 21 days was made by Mr Lynch, seconded by Mr Napoli Unanimous 242-1453, Brook,Elmwood,Fernwood, Harwood, and Jetwood (North Andover Division of Public Works)(Weston & Sampson Engineers, Inc.) Tara E McManus of Weston& Sampson Engineers, Inc was present No Quorum No Action Election of Conservation Commission, Chairman, Vice Chairman A motion to vote to elect John Mabon as Chairman was made by Mr Manzi, seconded by Mr Lynch Unanimous A motion to vote to elect Louis A Napoli as Vice Chairman was made by Mr Lynch, seconded by Mr Manzi Unanimous A motion to adjourn the meeting at: 10:30 PM Mr. Napoli, seconded by Mr. McDonough, Unanimous. 3
