Meeting came to Order at: 7:20 P. M. Quorum Present.
General Business
A motion to approve the minutes of 8/12/09 was made by Mr Napoli, seconded by Mr
McDonough

• Administrator presents the site is not in compliance
• A motion to grant the request for a continuance was made by Mr Lynch, seconded by Mr

• Administrator presents the work on the detention basin has been completed
• Mr Kaminski discusses the snow stockpiling area designated also purple loosestrife would
hand pulled on an on going bases The O & M plan would be maintenance for perpetuity on
the site
• A motion to grant the COC and release the bond was made Mr Lynch, seconded by Mr
Napoli

strange they want to not make handicap accessible now The applicant would not intend
occupy the structure when built The applicant is requesting a withdrawal of the modification

• Administrator presents this was a major project a lot of paper work trying to go the filing as
much as possible before the meeting I did walk the some of the sites with Samantha Hard of
TRC
• Mr Lychwala when the filing came in at first the Conservation Commission had hired
Seekamp Environmental Consulting was interim till you hired Julie Parrino Conservation
Administrator in 2002
• Mr Lynch discusses this was very big project lots of areas of ground disturbance in different
areas of the Town of North Andover
• Administrator make a summary list for this filing

• Administrator presents this is the second extension request filed to just allow few other areas
need work done before COC can be granted
• A motion to grant the 1-year extension was made by Mr McDonough, seconded by Mr

Request for Determination of Applicability

• Mr McDonough read the legal notice
• Administrator presents filing is for installation of solar panels and connection to existing gas
line
• Mr Napoli discusses the applicant would be saving a lot of money on the changing to solar
power
• Mr Weare discusses the saving would quite a bit because the electric bill is 4 million dollars
a year with the solar power should be 1 million a year
• A motion to issue a negative determination with conditions pre-construction,post-
construction and loam and seeding was made by Mr Lynch, seconded by Mr Napoli
• Vote unanimous

• Administrator presents the applicant has revised his proposal of only one tree in the 50-foot
No-Build zone would be removed
• Mr Hochmuth discusses the applicant would just pruning the other trees in the area The
vegetation on the slope and there would extra erosion control along the slope when the tree is
removed
• Mr Mabon discusses I did a site visit today there was 14-inch maple tree being removed
• Mr Napoli discusses to the left of phasing plan on the pond change the arrow
• A motion to grant the continuance for revised plans was made by Mr Napoli, seconded by
Mr Lynch

• A motion to accept Hancock Associates as the review for stormwater review of the site was
made by Mr Lynch, seconded by Mr Napoli

• A motion to set up outside escrow account in the amount of$1,500 was made by Mr Lynch,
seconded by Mr McDonough

• Administrator presents the bond amount$3,000, wetland markers on trees, 20 extra haybales
