Meeting came to Order at: 7.21 P. M. Quorum Present.
General Business
242-1414, COC Request, 226 Stevens Street (Mittelstaedt)(The Neve-Morin Group,
Inc.)(cont. from 9/23/09)
• The applicant Mr & Mrs Mittelstaedt of 226 Stevens Street
• A motion to grant COC and release the bond was made by Mr Lynch, seconded by Mr
Napoli
• Vote unanimous
242-1184, COC Request, 2060 Turnpike Street(Proulx)(The Neve-Morin Group, Inc.)
• Administrator presents the negotiated fine has been paid and the previous owner removed
erosion controls as requested
• A motion to grant COC and release the bond was made by Mr Napoli, seconded by Mr
Manzi
• Vote unanimous
Enforcement Order
• Administrator presents the owner is before you to present his restoration plan
• Administrator presents the brush storage area to an existing pathway run through the 50-foot
No Disturbance zone to a vernal pool
• The applicant would be filing and RDA for the other work he wants to do on the property
• Mr Lynch discusses restoration and maintenance for the property to keep the area clear of
grass clippings and brush build up throughout this area in the pathway is a on going
maintenance for perpetuity
• A motion to grant to accept the restoration plan and maintenance plan for the disturbed area
was made by Mr Lynch, seconded by Mr Manzi
• Vote unanimous

Request for Determination of Applicability
Old Chestnut Street, Ward Hill Reservation,North Andover (The Trustees of
Reservations)
• The applicant Chris Ward of The Trustees of Reservations and Adam Rolfs of The Trustees
of Reservations
• Administrator presents the proposed boardwalk would cross short expanse of wetland and
prevent widening of the trail as users create new trials in an attempt to avoid the wetland
areas
• Mr Lynch discusses this is a very boggy areas
• A motion to grant a negative determination#2 was made by Mr Manzi, seconded by Mr
Napoli
• Vote unanimous
Notice of Intent(s)
242-1463, 40 Webster Woods Lane (Canning)(Merrimack Engineering Services, Inc.)
• The applicant Mrs Canning and John Murphy of Merrimack Engineering Services, Inc
• Mr Napoli discusses needs to be soil-stockpiling area shown on the plan also any dewatering
should be shown on the plan
• Mr Mabon discusses the silt fence should be shown 75-feet on the plan and add fence on
plan
• Administrator discusses need results of Natural Heritage
• Mr Lynch discusses the apron around the pool is only 2foot wide need to know where access
area for entering into the area where the pool would be installed needs to be shown on the
plan
• A motion to grant the request for a continuance was made by Mr Manzi, seconded by Mr
Napoli
• Vote unanimous
Decision

• Administrator presents the bond amount set at$3,000, wetland makers, 24-inch boulder wall
along the property line, dewatering and crushed stone entrance way from the road
• A motion to accept the Order of Conditions as drafted was made by Mr Lynch, seconded by
Mr Napoli
• Vote unanimous
A motion to adjourn the meeting at: 8:30 PM was made by Mr. Manzi, seconded by Mr.
Napoli.
