Meeting came to Order at: 7.35 PM Quorum Present.
General Business
Approval of Minutes of 9130109
• A motion to grant the special meeting minutes 9/30/09 accepted as drafted was made by Ms
Feltovic, seconded by Mr Napoli
• Vote unanimous

• A motion to grant the request for a continuance was made by Ms Feltovic, seconded by Mr
Napoli
• Vote unanimous
242-115, PCOC request,261 Carlton Lane (Lot 44)(Curtis Law Office)
• Administrator presents the single-family dwelling is 150-feet to 175-feet away of any
resource areas, also no as-built plan required because this was amended Order of Conditions
from the State of Massachusetts There are no as-built plans with Conservation, Planning,
and Health no record plan in anyone files
• Mr Napoli discusses sewer was never installed in this area
• Mr McDonough discusses there is request for COC here the Conservation Commission
would have to deny the COC request then issue the PCOC for this lot
• A motion grant to issue the COC was made by Mr Napoli, seconded by Ms Feltovic
• A motion to grant the withdrawal the previous vote for COC was made by Mr Napoli,
seconded by Ms Feltovic Unanimous
• A motion to grant the denial of the COC request was made by Mr McDonough, seconded by
Ms Feltovic
• Vote unanimous
• A motion to grant the PCOC was made by Mr Napoli, seconded by Ms Feltovic

Other Business
• NACC signs- we are almost out of wetland markers Mr Lynch had shown me makers with
additional guidance on the new makers Mr Mabon discusses the wetland markers are fine
The Conservation Commission would like the Administrator bullet a list of conditions on the
new markers with Town of North Andover Seal
• No Recess

Request for Determination of Applicability

• Mr McDonough read the legal notice
• Administrator presents this is an after the fact filing for the fill placed to level a yard for the
placement of a swing set and play area
• Mr McDonough discusses the project is 80-feet at the closest point
• Administrator presents this is correct the wetland is approximately 80-feet away from
resource areas a discharge pipe is there and releases water thru this property offsite
• A motion to grant and issue a negative #3 determination was made by Ms Feltovic, seconded
by Mr Napoli

• Administrator presents the wetland line reviewed and a few changes made
• Mr Hochmuth discusses the grease trap tank 4,500-gallon tank
• Mr Mabon discusses the size of the piping would 6-inch to 8-inch check the buoyancy with
the high water table in this area there could be freezing pipes in the winter time

• Mr Napoli discusses can they tie into the existing grease trap
• Mr Mabon discusses the grease trap would have to be cleaned out because the Town of
North Andover would not want that grease entering within the sewer system this could very
serious issue by ruining the sewer lines O& M Plan needs to be followed very closely
• Mr McDonough discusses grease trap interceptor 2/3 inches capture wash water outlet T
3,000 to 1,000 gallons in the first chamber how fast would tank fill up before it needs to be
cleaned out
• Mr Mabon discusses this would be the same as having a septic tank pumped every year
• Mr Mabon discusses maintenance would a yearly cleaning out or more because if the tank
becomes overloaded this would back up into the building
• Mr Napoli discusses the old French drain outside could be used as dewatering basin only
eighty feet to the swale for dewatering area, catch basin protection when construction is
going on the site

• Administrator presents the delineation and a new area of wetland was added new plans would
be submitted at the next meeting also no DEP#

• Mr Patrick Seekamp of Seekamp Environmental Consulting, Inc
• Mr Napoli discusses the house was razed on Veterans Day which was a surprise to me the
work would preformed on a holiday
• Mr Seekamp discusses this was big lot of farmland years ago this has quiet a bit of acres
here on this lot
• Administrator discusses there is additional wetlands on the Airport Land which would be
shown on the revised plans
• Mr Mark H Lewis of 272 Sutton Street an abutters discusses the engineer needs to make
sure there is no stormwater runoff coming off this development of the property
• Ms Kathryn A Makowski of 290 Sutton Street an abutter discusses there can not be any
stormwater water runoff within this area
• Mr James J Robinson of 35 Wood Avenue an abutter discusses there has been a problem in
this area for years with water runoff
• Ms Laurie M Duffy of 3 Ellis Street and abutter discusses there has to be something to fix
the water problem within this area will there be development of this property with housing
prof ect
• Administrator discusses the wetland areas are found thru soil testing
• A motion to grant the request for a continuance was made by Ms Feltovic, seconded by Mr
Napoli.
