Conservation Commission Meeting Minutes

Meeting came to Order at: 7:05 P. M. Quorum Present.

242-1393, COC Request, 26 Turtle Lane (Dickey)(Merrimack Engineering Services, Inc.)
No one was present Ms McKay stated the Order of Conditions was issued April of 2007 for the
razing of an existing sunroom and deck in order to construct a 14' x 38' addition within the
Buffer Zone to a Bordering Vegetated Wetland Norse Environmental was retained as the
Environmental monitor and reports were submitted throughout construction The addition was
built exactly as what was originally proposed and measurements were taken in the field to
confirm this The wetland markers were placed in the field in accordance with the Order All
disturbed areas have been stabilized with no possibility for erosion runoff A motion to deny the
COC request was made by Mr Lynch, seconded by Ms Feltovic Unanimous Mr Lynch stated
the shed is within the 50-foot No-Build zone and within the drainage easement The shed has to
be moved where it was approved with the building permit in 2005 for the installation of the shed
this was not placed where the shed shows on the building plan this must be moved by November
10, 2007 if not moved by this date $25 Is'day, $50, 2nd day, and $100/day thereafter
A motion to ratify the Enforcement Order was made by Mr Lynch, seconded by Ms Feltovic
Unanimous
NACC#34-Small Project-350 Summer Street
The applicant Nancy Alibrandi of 350 Summer Street was present Ms McKay stated this is a
4 4 2A small project 7 s f of disturbance at the closest point only 76-feet from wetland resource
area only 170-feet for squaring off a deck with stairs A motion to ratify this as a small project
was made by Mr Lynch, seconded by Ms Feltovic Vote 4-0-1

No one was present Ms McKay stated the applicant received a variance from Zoning Board of
Appeals requirement tying in to sewer Ms McKay stated the bond amount set at$3,000,
wetland markers, foundation as-built plan stacked P L S ,the pitch of the driveway would have
to be parallel to the house to north side of the property, only shoveling driveway or snow blow
driveway only no snow plowing with a truck, well drilling would need protection of soil
movement thru out an area need erosion controls within area when work is completed remove
erosion controls, environmental monitor weekly then once a month A motion to accept the
Order of Conditions as amended was made by Mr Masse, seconded by Mr Lynch Unanimous

No one was present Ms McKay stated the bond amount set at$3,000, cleaning debris out the
dention basin, the recharge of the drainage should be online before pre-construction meeting, the
O & M plan for perpetuity on the property, the cleaning vegetated pond very large should be
cleaned for the perpetuity on the property A motion to accept the Order of Conditions as
amended was made by Mr Lynch, seconded by Mr Masse Unanimous

No one was present Ms McKay stated the applicant is requesting to continue to October 24,

242-1406,New England Power Company Right of Way Easement- (New England Power-

The applicant James F Hannigan of Nationalgrid and Steven P Damiano of TRC was present
Ms McKay stated full size plans remain at a scale of 1" = 200' The revised plans include 11
sheets at a 40' scale The plans have been stamped by a P E , TRC stated that the wetland flags
#'s would be added The wetland flag numbers are not depicted on the revised plans, but located
in the field all set The buffer zones have been added The revised plans show current date all set
Additional details have been provided in the revised Notice of Intent and revised tables The
project will result in 20 s f of permanent impact and thus 40 s f 2 1 mitigation should be
proposed in addition to mitigation efforts for temporary impacts Not addressed, but can
condition A detailed legend has been added to the plan The final revised plans show proposed
access route along the corridor, which were verified in the field as preferred route Many areas in
which temporary impacts and placement of swamp mats were originally proposed can now be
avoided I indicated that the applicant should try and avoid the placement of swamp mats where
avoidable I believe TRC still hold this position No comments from DEP No further issues The

Conservation Commission discussed the best months that area dry would be July and August
Mr Damian stated these replacement of high-tension wires 15,000 voltage and there would be
outages during replacements of the poles Also cannot have outages within the peak usage of
electricity We would need some pick and choose what times are the best Mr Napoli stated
mitigation of vernal pools cannot be done the critters are on the move we need to protect the
areas when they are on the move A motion to close and issue a decision within 21 days was
made by Mr Lynch, seconded by Ms Feltovic Unanimous

was present Ms McKay stated the plans were revised to more adequately clarify proposed work
and possible compensation/mitigation areas as discussed at the last meeting and as a second
subcommittee meeting Natural Heritage revised letter dated 10/1 0/07-review conditions-100%
with required conditions Mr Lynch stated the 2 to 1 replication areas were agreed with the
Subcommittee and the applicant Mr Borenstien stated the Conservation Restriction with
convinces would last 30 years on the property with State of Massachusetts Conservation
Restriction would take 3 months to 6 months and would be for perpetuity on the property A
motion to close and issue a decision within 21 days was made by Mr Lynch, seconded by Ms
Feltovic Vote 4-0-1

Greg Hochmuth of The Neve-Morin Group, Inc was present Ms McKay stated no comments
from DEP A the last meeting, the Commission requested plan revisions depicting a detail of the
5 leanto, the retaining wall gravity blocks, a soil stockpiling area, more substantial stormwater
better management plan's and specific construction and better management plan measures The
plans were revised as requested to incorporate and infiltration trench instead of a vegetated
swale, drip trenches along the proposed patio and under roof line of the proposed shed, a
temporary soil stockpiling area, a compost area for the previously noted yard waste and debris
area a gravity block wall detail, and detail on the leanto, which has been changed to a standard
shed and rotated slightly but remains outside to 50-foot No-Build zone A large native planting
area is also proposed along the base of the proposed patio and behind the proposed shed In
addition, the applicant is requesting a permit to allow the existing float to remain in place under
section 10A of Chapter 91 and with annual renewals A motion to close and issue a decision
within 21 days was made by Mr Lynch, seconded by Ms Feltovic Unanimous

No one was present Ms McKay stated the bond amount set at $2,000, no back wash from pool
water within the resource areas, construction sequence, stake corners of the patio around the pool
close to resource areas, should have cartridge filter for the pool, dewatering if needed,
environmental monitor while work is going on weekly then monthly until site is the stabile 100
s f of restoration area by the driveway monitoring plantings for 1 growing season spring and

fall A motion to accept the Order of Conditions as amended was made by Mr Lynch, seconded
by Ms Feltovic Unanimous
242-1404, 210 Holt Road (TBI)
The applicant William Thomson was present Mr Thomson stated yes we were doing
replacement of the fencing yes I was on the airport property but I lease land from Airport
Enterprise Commission Ms McKay stated the bond amount would set at $3,000, O & M plan is
recorded on the property for perpetuity, the maintenance of the fencing for perpetuity of the
property, the installation of a testing well before work starts on site the test water yearly for 3
years baseline testing of water, no snow stockpiling on the site, the 36 " catch basin would have
to be cleaned of all debris within Holt Road before construction begins, flag maintenance A
motion to accept the Order of Conditions as amended was made by Ms Feltovic, seconded by
Mr Lynch Vote 4-0-2
Discussion of Harbor Master
Mr Manzi stated the Conservation Commission would set up a subcommittee would be Mr
McDonough and Mr Napoli to inquire information of section l0A Chapter 91 and give us a
report on what they find out about the Harbor Master for docks on Stevens Pond and Lake
Cochichewick
A motion to adjourn the meeting at: 9:30 P. M.was made by Mr. Lynch, seconded by Ms.
Feltovic. Unanimous.
