(Condition #2 .The applicant, owner,their successors in title and their contractors are advised that No other work within wetland jurisdiction on the property is allowed without a permit from the NACC. The NACC has Jurisdiction over all of the wetlands, and associated too-Foot buffer zones and Zoo Foot Riverfront on site and any work that involves ground disturbance or changing the current conditions in. these areas rill require permitting with the. NACC.This includes, but are not limited to, house additions, pools, patios, decks, sheds,fences,garden beds, paving, repaving, landscaping and bridge installation, tree or vegetation or vegetation or tree cutting/pruning. These activities shall be held to the current standards under the Bylaw and WPA and must be reviewed under a separate application submitted to the Conservation Commission. 2. (Condition #33 :The NACC finds that the intensive use of the upland areas and buffer zone proposed on this site will cause further alteration of the wetland resource areas.. In order to prevent any alteration of wetland resource areas a t reat -five foot s` No-Disturbance Zone and a fifty foot so` No Construction Zone shall be established from the edge of the wetland resource, areas. The Conservation Administrator and/or other agents of the NACC do not have the authority to waive these setbacks as established under the local Bylaw. No disturbance of existing grade,,soils or vegetation is permitted in the no-disturbance zone. Future work within the wetland or within 100 feet of the wetland shall rewire separate permittingwith the Conservation Commission. 3. (Condition #40):The existingwetland markers attached to 4x4 pressure treated posts along the edge of lawn, incorporating the following text. "Protected Wetland Resource Area" and the associated rules shall remain.These markers will designate the sensitivity of the resource area and assure no further inadvertent encroachment into the wetland. The applicant shall instruct all agents to e cpl'ain these markers to buyerslessees,/landscapersand all persons taking over the property from the applicant. These markers shall remain posted and be replaced as necessary in perpetuity. Markers are available from the Conservation Department. 4.. (Modification special Condition#1): A triangular area of lawn between Wetland Flag s and Wetland Flag in the easterly corner of the backyard shall remain undisturbed (prohibiting activity such as mooring, vegetation removal, planting, mulching, residential landscape maintenance etc.), allowing it to return to a natural vegetated state in perpetuity. s. (Modification Special Condition# ) A physical post alind rail fencing shall remain installed in front of the mitigation area so as to connect WF5 and WF ,to delineate same and wetland markers shall be installed on said barrier delineating the mitigation area. (Condition #64): There shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant the NACC shall be notified by the applicant within one (1) business day. No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 100 feet of a resource area. 7. (Condition #65): No underground storage of fuel oils shall be allowed within one-hundred (100) feet of any wetland resource area. 8. (Condition #66): Fertilizers utilized for landscaping and lawn care shall be slow release, low-nitrogen types (<5,%), and shall not be used within 25 feet of a resource area. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. 9. (Condition #67)1: There shall be no,dumping of leaves,grass clippings, brush, dog waste,, or other debris into a wetland resource area or beyond the No-Disturbance Zone demarcated by the posts and/or wetland markers. This condition shall survive the issuance of a Certificate of Compliance. 10. (Condition #68):The use of coal tar-based pavement sealants is prohibited oin the property, as they have been determined to contribute high level's of polycyclic aromatic hydrocarbons (P,AHs) to storm rater runoff.
