PROJECT HISTORY
On September 19,2019 the Planning Board approved a Site Plan Review&Modification of Parking
Standards Special Permit and a Common Driveway Special Permit to allow construction of a 2-story, 13,550
SF of Gross Floor Area Senior Center with associated amenities,parking,stormwater management facilities
landscaping,signage and other site improvements. The project is located within the Business 2(B-2)and
Residential 4(R-4)Zoning Districts,
General Condition 65 (SPR&Modification of Parking Standards Special Permit)and General Condition 28
(Common Driveway Special Permit)state, "Pursuant to the North Andover Zoning Bylaw Section 195-10.7
(3)this Special Permit shall be deemed to have lapsed September 17,2021 (two years from the date the
permit is granted)exclusive of the time required to pursue or await determination of any appeals,unless
substantial use or construction has commenced within said two-year period or for good cause as determined
by the Planning Board.
Under Section 195-10.7(3)of the Town of North Andover Zoning Bylaw,"...If an applicant can show good
cause why substantial use or construction has not commenced within the two-year period,the special permit
granting authority,at its discretion,may extend the special permit for an additional one-year period,"
FINDINGS
On July 20,2021 the Applicant requested to extend the Special Permits for an additional six month period
(March 17,2022) due to delays caused by the COVID-19 pandemic and the process of executing legal
agreements between the Town and Sutton Street Redevelopment,LLC.
DECISION
At a regularly scheduled meeting of the Planning Board, duly posted, and held on July 20, 2021, the North
Andover Planning Board voted upon a motion by J. Simons and second by A. Koenig to approve a one year
extension for the Special Permits issued on September 19,2019 to the Town of North Andover for the Common
Driveway and construction of a 2-story, 13,550 sf of gross floor area Senior Center with associated amenities,
pat-king,storinwater management facilities,landscaping,signage and other site improvements, and based upon
and subject to the following conditions.The vote was 4-0 in favor of the extension.
This extension is granted pursuant to Massachusetts General Law, Chapter 40A, Section 9 and Section 195-
10.7(3)of the North Andover Zoning Bylaw,and will extend the above referenced Special Permits for a period
of one year. This permit is now due to expire on September 17, 2022.
