So as to allow for the construction a 2 story, 13,550 SF GFA Senior Center with associated amenities, parking,stormwater management facilities,landscaping,signage and other Site improvements. The project is located within the Business 2(B-2)and Residential 4(R-4)Zoning Districts. After a public hearing given on the above date, and upon a motion by P.Boynton and 2nd by J. Simons to APPROVE the Site Plan Review Special Permit and a Modification to Parldng Standards to allow for separate lot/satellite parldng Special Permit. as amended, and based upon and subject to the following conditions.Vote was 5—0 in favor of the application. The project is located within the Business 2(B-2)and Residential 4(R-4)Zoning Districts. This Special Permit was requested by the Town of North Andover. The application was filed with the Planning Board on June 10,2019. The public hearing on the above referenced application was opened on July 18,2019,and closed by the North Andover Planning Board on September 17,2019. The Applicant submitted a complete application,which was noticed and reviewed in accordance with Part 3. Site Plan Review,Article 8,Part I Off-Street Parking and Loading,and 195-10.7 of the Town of North Andover Zoning Bylaw and MGL c.40A, Sec.9. The Planning Board voted unanimously (by a vote of 5-0) to grant the Site Plan Review Special Permit,and Modification to Parking Standards Special Permit to allow for separate lot/satellite parking. A Special Permit issued by the Planning Board, as Special Permit Granting Authority requires a vote of at least four members of a five-member board. The Applicant is hereby notified that should the Applicant disagree with this decision,the Applicant has the right,under MGL Chapter 40A, Section 17,to appeal to this decision within twenty days after the date this decision has been filed with the Town Clerk. The Planning Board makes the following findings as required by the North Andover Zoning Bylaws Article 8 Part 3,Article 8 Part 1, and Section 195-10.7: FINDINGS OF FACT 1. The specific Site is an appropriate location for such a use, structure or condition due to its location that allows for this use and it is at the junction of town major roads,Route 125 and Sutton Street. The site is within close proximity to the downtown area,commercial corridor and within walking distance to a public park. 2. The use as developed will not adversely affect the neighborhood character.The Project provides appropriate building, landscaping and screening set back from the adjacent properties.The character of the architectural style of the proposed new building will complement the architectural style of existing buildings located along Sutton Street. 3. There will be no nuisance or serious hazard to vehicles or pedestrians: The'driveways and the three(3) existing Sutton Street curb cuts will be consolidated into one(1)curb out,improving vehicular circulation and pedestrian safety on the public way. 4. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The project is adequately and appropriately serviced by municipal water,sewer and other utilities that adequately address the needs of the Project. Stormwater management facilities will provide adequate treatment of stormwater in accordance with applicable requirements 5. The use is in harmony with the general purpose and intent of the Zoning Bylaw. 6. The proposed Senior Center use is compatible with other nearby residential and commercial uses along Route 125 and Route 133. 7. At the May 2018 North Andover Town Meeting,the Town voted to Amend the Zoning Map to rezone 505 Sutton Street(Map 74 Parcel 23)and 0 Sutton Street(Map 74 Parcel 54)from General Business (GB)to Business 2(B2) and 477 Sutton Street(Map 74 Parcel 24)from Residential 4(R4)to Business 2 (B2). 2 I Surrey Drive,477,505,and 0 Sutton Street—Senior Center Site Plan Review and Modification of Parking Standards Special Permits Page 3 of 10 8. The Owner of a series of parcels of land on Sutton Street, Sutton Street Redevelopment,has agreed to donate a portion of that land for the construction of a new Senior Center. At the May 2018 Annual Town Meeting the Town voted to authorize the Board of Selectmen to accept a donation or gift of a parcel of land located on Sutton Street consisting of approximately 57,300 square feet more or less as shown on the plan entitled"Plan Showing Division of Land for a Town Meeting Warrant Article in North Andover,Massachusetts 477&505 Sutton Street", dated April 11,2018,prepared by The Morin-Cameron Group,Inc. for the purpose of construction of a Senior Center and necessary parking spaces or any other public purpose on terms and condition the Board deems to be in the best interest of the Town. 9. Per Section 195-8.3 Special Regulations, Section 195-8:3.C: "If the Inspector of Buildings is unable to identify a use with one or more of the uses in the schedule below, an application shall be made to the Planning Board for the purpose of determining a sufficient quantity of parking spaces to accommodate the vehicles of all customers,employees,visitors, occupants,members or clients consistent with the provisions contained in the schedule below". An application for determining a sufficient quantity of parking spaces was made by the Applicant. The design of 81 dedicated parking spaces is consistent with the parking facilities of the current Senior Center, which operates with a shared parking lot. The Board finds that 81 parking spaces is sufficient to account for the increase GFA of the proposed building(an increase of approximately 6,150 SF). The submitted current Senior Center programming schedule of activities and attendance levels has a peak activity of 64 attendies. Eight-one spaces will account for this activity level, employees, and still allow for growth. 10. The proposed landscaping and signs have been designed as not to impede the site distances. 11. Special Permit off-site/satellite parking, Section 195-8.8: The proposal is an allowed use by-right in the B2 zoning district and by Special Permit(ZBA SPGA) in the R4 zoning district and the parking spaces proposed are a dramatic improvement to the existing condition. The request for a Special Permit is in accordance with 195-8.8 Subsecion D(4)(b) and(c)as: • Parking is proposed on another lot where the Applicant does not own such other lot,the Applicant shall provide executed instruments establishing to the satisfaction of the SPGA that sufficient legal interest has been acquired in such premises to assure their availability for required parking as long as the use served is in existence; • The satellite parking spaces will be used soley by employees and the clientele of the proposed use; • The off-site parking spaces are located to adequately serve the proposed use and are within 600 feet of the proposed use measured from property line to property line. The findings and determinations consistent with 195-10.7 are provided below: • The specific site is an appropriate location for such a use; • The use as developed will not adversely affect the neighborhood; • The will be no nuisance or serious hazard to vehicles or pedestrians; • Adequate and appropriate facilities will be provided for the proper operation of the proposed use; • The use is in harmony of the general purpose and intent of this bylaw The request for relief does not cause detriment to the surrounding neighborhood based upon the following applicable criteria: 3 I Surrey Drive,477,505,and 0 Sutton Street—Senior Center Site Plan Review and Modification of Parking Standards Special Permits Page 4 of 10 • Access to the Site will be from a shared drive off of Sutton Street.Traffic will exit the Site via a right-hand turn only onto Surrey Drive to prevent an increase in traffic volumes on the abutting residential street; • There will be no increase in traffic congestion or queuing of vehicles as access will be.via a shared driveway off of Sutton Street, curb cuts on Sutton Street are reduced,and peak traffic volumes for the Senior Center will not compete with peak commuting traffic; • Sutton Street is a main connector road,thus there will be no change in types of traffic; • There will be no change in traffic patterns; • There will be no reduction in on-street parking and/or; • Unsafe conflict of motor vehicle and pedestrian traffic; 12. The Plan reflects extensive discussions with the Planning Board,Peer Review Consultants,the Planning Department,other Town Departments, and the Applicant with respect to Site design and stormwater management. 13. The stormwater management is designed in accordance with the Town Bylaw requirements and Best Management Engineering and Practices,and the most recent version of the MA DEP Stormwater Handbook, and the Plan reflects extensive discussions and review by the Town's outside consultant engineer,Horsley Witten Group.The proposed runoff from the impervious areas of the Site will be drained through a closed drainage system to subsurface storage/non- infiltrating detention systems. The Project's permanent stormwater measures include: A catch basin with a sump and hood;three onsite rain gardens providing low impact stormwater management in addition to subsurface infiltration/detention system;two subsurface infiltration systems to manage stormwater runoff from the building parking area. There were extensive discussions between the Town's outside consultant engineer and the Project Engineer related to the overall design and Operations&Maintenance Plan dated March 27,2019. (See correspondence from Horsley Witten Group, dated July 10,2019,July 30,2019 and August 28, 2019 and DeVellis Zrein,Inc.,LLC response comments dated July 17,2019 and August 27, 2019). 14. The Plan reflects extensive discussion and review with TEC,Inc.,the Town's civil peer review consultant and meets the requirements of the Town for Site Plan Review as stated in Article 8 Part 3 of the Zoning Bylaw. (See emails dated July 11,2019 and August 29, 2019,and DeVellis Zrein,Inc.,LLC response comments dated July 24,2019 and August 27,2019). 15. The Town Engineer,John Borgesi,has reviewed the Project and has confirmed that all Engineering Department comments have been adequately addressed(See email dated August 29, 2019). 16. Lieutenant Michael Beirne of the North Andover Fire Department reviewed the Plans and determined that the final design addresses all of the concerns the Fire Department had over the additional hydrant and access to the Project for firefighting and rescue operations. (See email dated August 8,2019). 17. The Town Director of Public Health,Brian LaGrasse,reviewed the Project and confirmed that there were no concerns(see email dated July 2,2019). i 18. The Zoning Board of Appeals granted the following Special Permit and Variances from the Town of North Andover Zoning bylaw on September 10,2019: • A Special Permit for a municipal building or use in the R4 zoning district under Section 195-4.3(J) 4 1 Surrey Drive,477,505,and 0 Sutton Street—Senior Center Site Plan Review and Modification of Parking Standards Special Permits Page 5 of 10 • Table 2 footnote 2: adjacent to residential zone and additional 15' side or rear setback shall be required. The first 15' of the total setback abutting the residential district shall remain open and green,be suitably landscaped,un-built upon,unpaved and not parked upon. , • A Minimum parking space setback from a Lot line variance of 3 ft..under Section 195- 8.5(A). WAIVERS 19. Town of North Andover requests the following waivers under Section 195-8.14.E from the site plan review submission requirements: • Locus map is at a scale of 1"=500' instead of 1"= 1,500' to provide greater clarity of the site context within the surrounding road network; • (5)Not showing contours within 50' of the parcel boundary. Land within 50' of the parcel boundary is private land to which the Applicant has not been granted access to conduct a survey; • (19)A traffic impact study has not been commissioned.It is our understanding that the proposed multi-family development will be conducting a traffic study. Peak activity at the Senior Center is anticipated to be between the hours of 9:00 am—3:00 pm and therefore,not competing with peak commute times; • (2 1)A sewer and drainage profile waiver is requested as short and direct connections are proposed. The Planning Board grants the above waiver request. 20. Town of North Andover requests the following waivers from the Zoning Bylaw from the Planning Board: • 195-8.5A& 195-8.5.C(3): A waiver to allow a 36' wide curb cut where 25' is the maximum allowed. .The increased width will allow for 3 exit lanes and 1 entrance lane associated with the common driveway special permit.The additional turning lane will minimize queueing of vehicles on-site and improve intersection safety on Sutton Street. The Planning Board grants the appove waiver request as the design provides for a safer intersection and minimizes potential queueing of vehicles. 21. Finally the Planning Board finds that this Project generally complies with the Town of North Andover Zoning Bylaw requirements Article 8 Part 1,Article 8 Part 3, and Section 195-10.7, but requires conditions in order to be fully in compliance. The Planning Board hereby grants an approval to the Applicant provided the following conditions are met: PERMIT DEFINITIONS 22. The "Locus" or "Site" refers to the 1.89 acres of land fronting on Sutton Street as shown on a portion of Assessors Map 74 Lots 23,24,25&54,and also known as 505 Sutton Street,477 Sutton Street and 1 Surrey Drive,North Andover,Massachusetts. 23. The"Plans"refer to the plans prepared by DeVellis Zrein,Inc. dated May 28,2019 and revised to August 27, 2019 consisting of 8 Sheets, titled "Site Development Plans North Andover Adult Center 1 Surrey Dr. (Map 74/25) 477-505 Sutton Street., (Map 74 Parcel 23, 24 and 54) North Andover,Massachusetts.. 24. The "Project" refers to construction a 2 story, 13,550 SF GFA Senior Center with associated amenities, parking, stormwater management facilities, landscaping, signage and other site 5 , I Surrey Drive,477,505,and 0 Sutton Street—Senior Center Site Plan Review and Modification of Parking Standards Special Permits Page 6 of 10 improvements. The project is located within the Business 2(B-2)and Residential 4 (R-4)Zoning Districts. 25. The"Applicant"refers to Town of North Andover, 120 Main St.,North Andover,MA 01845,the Applicant for the Special Permit, its successors and assigns. 26. The"Project Owner"refers to the person or entity holding the fee interest to the title to the Locus from time to time,which can include but is not limited to the Applicant,Developer, and Owner. SPECIAL,CONDITIONS 27. Any revisions to the approved Plans shall be submitted to the Town Planner for review. If these revisions are deemed substantial,the developer must submit revised plans to the Planning Board for approval,all of which is in accordance with Section 195-8.17 (Revisions to Approved Site Plan). 28. Applicant shall submit draft documentation concerning a declaration of cross-easements, restrictions and covenants, or equivalent,between the Project Owner 505 Sutton Street and Project Owner Senior Center which shall identify obligations for construction,maintenance, management and other requirements for access/egress driveways to the Planning Department, DPW and Town Counsel for review and approval. 29. All special permits granted under,Article 2 Definitions,Article 8 Supplementary Regulations, and Article 10 Administration for this Site shall also be considered as part of this Decision. PRIOR TO ISSUANCE OF SITE WORK,BUILDING PERMIT, OR CONSTRUCTION 30. Two (2) copies of the signed, recorded decision and the recorded plans must be delivered to the Planning Department. 31. Applicant shall provide executed instruments.establishing to the satisfaction of the SPGA that sufficient legal interest has been acquired in 1 Surrey Drive to assure the availability for required parking on the satellite lot as long as the use served is in existence. i 32. The Applicant shall submit to the Planning Department the recorded ANR Plan endorsed by the Planning Board on July 30,2019. 33. The Applicant and/or Project Owner shall submit documentation concerning a declaration of cross-easements,restrictions and covenants, or equivalent,between the Project Owner 505 Sutton Street and Project Owner Senior Center which shall identify obligations for construction, maintenance,management and other requirements for access/egress driveways. The document shall be recorded with the Northern Essex Registry of Deeds, and the Applicant shall provide the Planning Department with two copies of the recorded documents. 34. In consultation with the Staff Planner,the Applicant shall designate an Independent Construction Monitor.The monitor shall read,sign,and return to the Planning Director the Letter of Agreement for Independent Monitors.The Construction Monitor must be available upon four(4)hours'notice to inspect the site with the Planning Board designated official. The monitor shall make weekly inspections of the project, provide monthly reports to the Planning Department throughout the duration of the Project, and detail any areas of non-compliance and corrective actions. 35. In consultation with the Director of Planning, the Applicant shall designate an Independent Environmental Monitor. The monitor shall read, sign, and return to the Planning Director the Letter of Agreement for Independent Monitors.The Environmental Monitor must be available upon 6 I Surrey Drive,477,505,and 0 Sutton Street—Senior Center Site Plan Review and Modification of Parking Standards Special Permits Page 7 of 10 four (4)hours' notice to inspect the site with the Planning Board designated official. The monitor shall make weekly inspections of the project,provide monthly reports to the Planning Department throughout the duration of the Project, and detail any areas of non-compliance and corrective actions. The monitor will also provide reports following heavy rain events. 36. A construction schedule shall be submitted to the Planning Staff for the purpose of tracking the construction and informing the public of anticipated activities on and off the Site. 37. Site grading shall be reasonably coordinated by both Sutton Street Redevelopment,LLC and the Town of North Andover along the Senior Center and Multifamily site interface. Coordination efforts shall be intended to maintain safe vehicular access between the Sites and shall include reasonable measures for public safety during construction and after occupancy, should one Project be completed prior to the other. 38. The property Owner shall sign the illicit discharge statement on page 19 of the Drainage Report and submit to the Planning Department prior to Site work. 39. The property Owner shall sign the Operation and Maintenance (O&M) Plan and submit to the Planning Deparment prior to Site work. The O&M must include a simple sketch and maintenance log. 40. A bond in the amount of twenty thousand dollars($20,000.00) shall be posted for the purpose of insuring that the Site is constructed in accordance with the approved plan and that a final as-built plan is provided, showing the location of all on-site structures (Site utilities, structures, curb cuts, parking spaces and drainage facilities, including invert elevations of all stormwater structures). This bond shall be in a form acceptable by statute. 41. A copy of all local, state and federal permits required for the project must be submitted to the Planning Department. 42. All stormwater management best practices shall be maintained as specified in the approved Stormwater Operations and Maintenance Plan. 43. All applicable erosion control measures must be in place and reviewed and approved by the Planning Department. 44. Yellow"Caution"tape must be placed along with the limit of clearing and grading as shown on the Plan. The Planning Staff must be contacted prior to any cutting and or clearing on site 45. A pre-construction meeting must be held with the developer, their construction employees, and the Planning Department (and other applicable departments) to discuss scheduling of inspections to be conducted on the Project and the construction schedule. DURING CONSTRUCTION 46. Dust mitigation must be performed weekly, or more frequently as directed by the Planning Director, throughout the construction process. 47. Any stockpiling of materials (dirt, wood, construction material, etc.) must be shown on a plan and reviewed and approved by the Planning Staff. Any approved piles must remain covered at all times and fenced off to minimize any dust problems that may occur with adjacent properties. 48. It shall be the responsibility of the developer to assure that no erosion from the construction Site shall 7 i I Surrey Drive,477,505,and 0 Sutton Street—Senior Center Site Plan Review and Modification of Parking Standards Special Permits Page 8 of 10 occur which will cause deposition of soil or sediment upon adjacent properties or public ways,except as normally ancillary to off-site construction. Off-site erosion will be a basis for the Planning Board making a fmding that the project is not in compliance with the plan; provided, however, that the Planning Board shall give the developer written notice of any such finding and seven days to cure said condition. PRIOR TO A CERTIFICATE OF OCCUPANCY 49. The Applicant must submit a letter from the project engineer and/or architect of the Project stating that the building,landscaping,lighting and Site layout substantially comply with the plans referenced at the end of this decision as endorsed by the Planning Board and that the stormwater management structures are functioning as designed. Alternatively,the Applicant and/or Project Owner may provide a bond,determined by the Planning Board,to cover the full amount of the landscaping materials and installation if weather conditions do not permit the completion of the landscaping prior to the use of the building. 50. The Applicant must submit a letter from the engineer certifying that the lighting provided meets . minimum Illuminating Engineering Society(IES)standards. 51. An as-built drawing of the Site sewer system shall be submitted to the Department of Public Works. 52. All stormwater structures shall be cleaned,in accordance with the approved Stormwater Operation &Maintenance Plan. 53. All signage shall conform to the signage regulations contained within the North Andover Zoning Bylaw, Article 6 Sign and Sign Lighting Regulations, unless a Variance;is issued by the North Andover Zoning Board of Appeals. PRIOR TO THE FINAL RELEASE OF ALL SECURITY AND ESCROWED FUNDS 54. The Planning Staff shall review the Site. Any screening as may be reasonably required by the Planning Staff will be added at the Project Owner's expense.Additionally, all pedestrian warning signage will be reviewed and any additional signage deemed necessary at non-controlled locations such as mid-block crossings and at the roundabout shall be added at the Project Owner's expense. 55. The Applicant shall submit an as-built Plan stamped by a Registered Land Surveyor in Massachusetts that shows all construction,including stormwater structures'and other pertinent site features. A Professional Engineer shall review the submitted as-built plan an submit an affidavit that it substantially conforms (or notes the deviations)to the drawings. This as-built Plan shall be submitted to the Town Planner for approval and must be provided in paper'form as well as in SDF (Standard Digital File)format.Any variance to the Plan shall be specified in memo format. 1 56. The Planning Board must by a majority vote make a fmding that the Site is in conformance with the approved Plan. GENERAL CONDITIONS 57. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation. 58. Any plants, trees, shrubs, or fencing that have been incorporated into the Plan approved in this decision that die or fall into disrepair must be replaced by the Project owner in perpetuity. 59. Gas, Telephone, Cable and Electric utilities shall be installed underground as specified by the respective utility companies, except for so-called"green utility boxes" as may be required by the utility companies. 8 1 Surrey Drive,477,505,and 0 Sutton Street—Senior Center Site Plan Review and Modification of Parking Standards Special Permits Page 9 of 10 60. The hours for construction shall be limited to between 7:00 a.m. and 5:00 p.m. Monday through Friday and between 8:00 a.m. and 5:00 p.m. on Saturday. 61. No open burning shall be done except as is permitted during burning season under the Fire Department regulations. 62. The provisions of this conditional approval shall apply to and be binding upon the Applicant, its employees and all successors and assigns in interest or control. 63. Any action by a Town Board, Commission, or Department,which requires changes in the plan or design of the building, as presented to the Planning Board, may be subject to modification by the Planning Board. 64. Any revisions shall be submitted to the Town Planner for review. If these revisions are deemed substantial,the developer must submit revised plans to the Planning Board for approval using the process outlined in Section 195-8.17 (Revisions to Approved Site Plan)of the Zoning Bylaw. 65. Pursuant to the North Andover Zoning Bylaw Section 195-10.7.A(3)this Site Plan Review Special Permit shall be deemed to have lapsed after September 17,2021 (two years from the date the permit is granted),exclusive of the time required to pursue or await determination of any appeals,unless substantial use or construction has commenced within said two-year period or for good cause as determined by the Planning Board. 66.
