Regular Meeting & H~arings
The BOARD OF APPEALS held their regular meeting on Monday evening, January 13,
1969 at 7:30 P.M. in the Town Office Building with the following members present and
voting: James A. Deyo, Chairman; Daniel T. O'Leary, Donald J. Scot~, Arthur R.
Drummond and ~. Philip Arsenault, Esq.
There were 20 people present for the hearings of the evening.
MELAMED PETITION:
A letter was received from Atty. Trombly requesting withdrawal of the petition
for a special permit, without prejudice; and that it will not be necessary for the
Board to hold a hearing on January 13, 1969. Mr. Trombly explained that in view of
the action taken at the Special Town Meeting that strikes out the apartment section
of the Zoning By-Law completely, it is uncertain as to whether the Board could
officially hold a hearing or take proper action. The request was accepted by the
Board.
~E~RING: Margaret L. Legault:
Mr. Drummond read the legal notice in the appeal of Margaret L. Legault who
requested a variance under Section 7.3 of the Zoning By-Law so as to permit the
extension of the present dln~ng area on the premises located at the east side of
Osgood Street, known as 1211 Osgood St. He also read the Building Inspector's
refusal.
Atty. Anthony Randazzo represented the petitioner who stated that the applicant
needs to expand the facilities to provide better and more adequate service. To
accomplish this expansion the most practical approach would be to the northwest as
indicated on the plot plan. The relocation of Route 125 had in effect given a sub-
stantial distance between the road and the proposed addition. Efforts were being
made to procure a portion of this land so as to increase the lot sizeS however,
no assurances could be made that this could be effected. There was ample parking
area available to accomodate such increased patronage that could result from the
expansion. Traffic would not be hazardous as there were and would continue to be,
two entrances and/or exits. The denial of the requested variance would cause
financial hardship in not permitting fullutilization of facilities and the site.
Mr. George Barker, an immediate abutter, asked several questions relative to
boundaries, distance, etc. and said he would be opposed if the addition was to be
only 8 feet from his land.
Mr. Drummond made a motion to take the petition under advisement. Mr. O'Leary
seconded the motion and the vote was unanimous.
FINOCCHIARO PETITION:
The members had viewed the site and further discussed the petition. Mr.
O"Learymade a motion to grant the variance; Mr. Scott seconded the motion and the
vote was ~n~lni~lous.
The following reasons are given for granting the petition.
January 13, 1969 - cont.
1. The particular configuration and bounds of the lot make it unsuitable for use as
part of a larger lot.
2. The proposed use will not be out of keeping with the land uses as might be ex-
pected in an Industrially zoned area.
3. Granting the variance will not deviate from the intent and purpose of the Zoning
By-Laws.
4. This variance is granted with the condition that the building to be erected must
be brick faced at least on the front side.
L~GAULT PETITION:
The board discussed the Legault petition will hold up on making any decision
until the next meeting at which time further information maybe forthcoming as to
the acquisition of land from the state.
The meeting adjourned at 9:00 P.M.
