As Interim Zoning Enforcement Officer, I have determined that the proposed detached ADU is considered an accessory
dwelling unit use, and is subject to MGL Ch. 40A Section 3, otherwise known as the"Dover Amendment." As such, the
Planning Board's authority is limited to reasonably regulating the bulk and height of structures and determining yard sizes,
setbacks, open space, parking and building coverage requirements.
