Contact the Owner in writing at least seven (7) days prior to the start of construction. 2. Place the site sign (with DEP assigned project number and contact numbers) prior to any work on site. 3. Install the erosion control BMPs as shown on the construction documents. 4. The silt fence and silt sock line shall be inspected on a weekly basis; any breaks in the line shall be repaired as soon as possible. 5. All erosion and sedimentation controls shall be in accordance with the DEP's Erosion and Sedimentation Control Guidelines and the USDA SCS Erosion and Sedimentation Control during site development. 6. All temporary stockpile areas shall be protected by silt socks, and shall be covered with a tarp to prevent moisture intrusion and dust concerns. 7. All areas within the limits of work no receiving a surface treatment and any disturbed areas outside of the limit of work shall be stabilized with mulch or seed immediately upon completion of construction activity. In no case, shall an area be left unstabilized for more than 14 days after the construction activity in that area has ceased. 8. All erosion control measures shall be inspected after any rainfall of 0.5" or greater. 9. All catch basins downstream of works areas shall be ringed with silt socks and covered with a sediment filter until all up-gradient disturbed areas are stabilized. 10. Any outlet orifices shall be ringed with silt socks until the detention structure or infiltration area is stabilized, if applicable 11. All slopes greater than 3:1 shall be stabilized with an erosion control blanket. 12. The contractor shall keep additional silt fence and straw bales on site to be able to respond immediately to any emergency condition. 13. All proposed drainage structures (catch basins, manholes, outlet control structures and detention systems) should be cleaned at the end of construction and at any time the sediment within the structures equals 12" deep. 14. The contractor shall confine activities to the limit of work and only disturb the minimum area necessary. 15. All illicit discharges are prohibited. 16. The entire project area shall be stabilized with vegetation upon completion of construction and prior to the removal of the erosion control devices. 17. The Order of Conditions issued by the North Andover Conservation commission shall be incorporated in the construction contract documents. 1IPage OPERATION AND MAINTENANCE PLAN TOWN OF NORTH ANDOVER NORTH ANDOVER HIGH SCHOOL ATHLETIC CAMPUS IMPROVEMENTS SECTION II: POST-DEVELOPMENT ACTIVITIES PART A-GENERAL • It shall be the responsibility of the owner to implement the procedures outlined in this plan. • The closed drainage system shall be inspected every 6 months and any excess sediment within the structures or detention systems shall be properly disposed of. • Any problems found with the drainage system shall be repaired within one week of discovery. • The Owner shall employ a qualified professional to perform periodic maintenance, as described in this plan. • All maintenance personnel shall be trained annually on the operation and maintenance procedures. A training log shall be maintained for the record to document the annual training of employees. • Inspection logs are included with this O&M Plan. The qualified professional shall provide the Owner with maintenance logs after each inspection or corrective action. The Owner shall keep record of these logs for at least three (3) years and shall provide copies to the DEP and Conservation Commission if required. • In the event that an infiltration BMP (stone/pipe trenches, synthetic turf fields) fails to drain within 72-hours of a storm event, a qualified professional shall be consulted to determine what corrective actions may be necessary. • All illicit discharges are prohibited. PART B - BMP MANAGEMENT Each Best Management Practice shall be maintained per the below requirements: SYNTHETIC TURF FIELD—Est.Annual Cost- $8,000 • Perform regular grooming of the synthetic turf to redistribute infill as recommended by the turf manufacturer, typically every two to four weeks cluing active seasons. • Perform regular trash/litter cleanup as needed. • Perform visual inspection of turf seams twice a year. • Perform visual inspection of areas surrounding the turf field for the presence/spread of crumb rubber infill four times a year. • Inspect cleanouts and outlet control structure after every major storm during the first 3 months of operation and twice a year thereafter. CATCH BASINS/AREA DRAINS— Est.Annual Cost-$15,000 • Inspect and clean at least four times per year (quarterly). • Sediment shall be removed when the depth is greater than one half the distance from the bottom invert to the manhole floor. 2 1 P a g e OPERATION AND MAINTENANCE PLAN TOWN OF NORTH ANDOVER NORTH ANDOVER HIGH SCHOOL ATHLETIC CAMPUS IMPROVEMENTS • Use of a vacuum truck is the preferred cleaning method. SUBSURFACE DETENTION GALLEY—Est. Annual Cost- $5,vOOO • Inspect annually using the access frame within the turf surface SECTION III: LONG TERM POLLUTION PREVENTION PLAN GOOD HOUSEKEEPING PRACTICES • Prevent or reduce pollutant runoff by performing periodic landscape maintenance, trash clean up, erosion control measures, and site cleaning. STORING MATERIALS AND WASTE PRODUCTS • All materials stored on site shall be stored in a neat and orderly fashion, in their appropriate containers, and under a roof or other secure enclosure. Waste products should be placed in secure receptacles until they are emptied by a licensed solid waste management company. ROUTINE INSPECTIONS AND MAINTENANCE OF STORMWATER BMPS • Follow the guidelines outlined above. MAINTENANCE OF GRASS AREAS • The Owner will be responsible for these activities. Maintenance typically involves mowing using small, motorized equipment and the application of commercial fertilizer. Grass cuttings are typically left in place for nutrient retention. Wind blown leaves are removed until late fall. LITTER AND DEBRIS • The entire property, including the athletic fields and tennis courts, is subject to periodic litter and debris removal. Trash receptacles shall be placed at all athletic venues, and they shall be emptied periodically. Damaged or missing trash receptacles shall be replaced promptly. The tennis courts shall be swept periodically and the accumulated debris disposed of. Wind blown litter accumulating in resource areas shall be removed periodically. OIL AND GASOLINE DRIPS AND SPILLS FROM VEHICLES • The pathways around the athletic venues and the fields/courts themselves can be accessed by small maintenance and service vehicles. The risk of oil drips and spills is minimized by the regular maintenance of the equipment, the limited controlled access for vehicle, and a prohibition of vehicle storage at the athletic venues. PET WASTE MANAGEMENT 3 1 P a g e OPERATION AND MAINTENANCE PLAN TOWN OF NORTH ANDOVER NORTH ANDOVER HIGH SCHOOL ATHLETIC CAMPUS IMPROVEMENTS • Animals shall not be allowed on any of the athletic fields or tennis courts; appropriate signage shall be posted to inform the public • In areas surrounding the athletic facilities, any pet waste generated shall be bagged and shall be placed in secure receptacles until they are emptied by a licensed solid waste management company. Appropriate signage shall be generated to inform the public. PROPER MANAGEMENT OF DEICING CHEMICALS AND SNOW • Snow disposal shall be in accordance with the Department of Environmental Protection, Bureau of Resource Protection, Snow Disposal Guidelines, Guideline No. BRPG01-01. In general, snow will be plowed in accordance with standard operating procedures. Whenever possible, the use of environmentally friendly alternatives (e.g., calcium chloride and sand instead of salt for melting ice) will be considered. • Snow on athletic fields and tennis courts shall not be plowed on a regular basis. No sand, salt, or chemicals shall be spread on athletic fields or tennis courts. Natural seasonal snow melting will be the preferred method of snow removal.Any residual snow that interferes with seasonally scheduled activities will be removed by careful hand shoveling and deposited in small maintenance vehicles for removal from the area. Snow shall not be dumped in resource areas. The stormwater management system is the system for conveying, treating, and infiltrating stormwater on site, including stormwater best management practices and any pipes intended to transport stormwater to the ground water, a surface water, or a municipal separate storm sewer system. Illicit discharges to the stormwater management system are discharges that are not entirely comprised of stormwater. The Site is located within the Residential 2 zoning district.The Project is located at 43 0 Osgood Street,North Andover, Massachusetts, 01845,Assessor's Map 94 Lot 3. This Limited Site Plan Review was requested by the Forth Andover Public Schools,430 Osgood Street,North Andover,MA 01545. The Applicant submitted a complete application on January 23,2025,which was noticed and reviewed in accordance with the requirements of the North Andover Zoning Bylaw,Article S Supplementary Regulations,Part 3 Site Plan Review,Article 10 Administration Section 195-10.7 and MGL Ch.40A,Sec 9. The public hearing on the above referenced application was opened on February 25, 2025 and closed on April 15,2025. This decision specifically stated by the Planning Board makes the fallowing FMINGS OF FACT: FINDINGS OF FACT 1} The Project is considered an educational use, and is subject to MGL Ch. 40A Section 3, otherwise known as the"Dover Amendment"(see letter dated December 26,2025 from Paul Hutchins,Building Commissioner,to Pamela Lathrop, Superintendent of Schools). As such, the Planning Board's authority is limited to reasonably regulating bulk and height of structures and determining yard sizes, lot area, setbacks, open space,parking and building coverage requirements. 2) The specific Site is an gppropriate location for such a use structure or condition. The specific Site is an appropriate location for the Project as it is located in the Residential 2 zoning district and conforms with bath use and dimensional requirements of this district. 3) The use as developed will not adversely affect the neighborhood character. The proposed renovations are consistent with existing athletic campus conditions and the amenities currently provided. The Project provides appropriate landscaping, lighting,and screening from adjacent properties. Approximately 350--linear feet of 6--foot chain link fence with windscreen will replace a portion of the existing fence in disrepair on the easterly side of the track. Additionally,"No Trespassing" signs spaced at 1 a0--feet on center will be added. 4) There will be no nuisance or serious hazard to vehicles or pedestrians. The Applicant has demonstrated consideration for Site safety for pedestrians and emergency response access and movement. 5) Adequate and 4ppropriate facilities will be provided for the proper operation of the ro osed use. The Project is adequately serviced by necessary facilities and utilities to address the needs of the Project. 6) The use is in harmony with the general ourpose and intent of this Zoning Bylaw.. 430 Osgood Street Limited Site Plan Review Renovation of Athletic Facilities April 15,2025 The Project allows for the use of existing access/egress drives,provides adequate fire/safety access,protects resource areas, and the use is in harmony with the general purpose and intent of the zoning Bylaw. 7) The Applicant has filed a Notice of Intent with the Conservation Commission to ensure compliance with the North Andover wetland Protection Regulations and MassDEP State protection zones. S} The Applicant anticipates that the athletic lighting will be used up until 9:00 PM Mondays through Thursdays, and be shut off earlier on Fridays through Sundays. Spring athletics typically begin around March 15', and fall athletics typically end on or around November 15'. A final lighting schedule will require determination by and through the School Committee. As such, a formal schedule cannot be provided until that process has taken place. 9) The Applicant has communicated that the light closest to Lawrence Municipal Airport is over 3l4 mile away from the nearest point on a runway,and the North Andover High School athletic complex is not in line with either runway at the airport. 10) The Project will require a National Pollutant Discharge Elimination System (NPDES) Construction General Permit(CGP)to be filed with and obtained from the United States Environmental Protection Agency. 11) Item 4.b of Horsley Witten's April 1,2025 stormwater peer review letter has been deferred to the Conservation Commission. 12) with regard to the reconstruction of the tennis courts,the Planning Board recommends consideration of additional fencing height or the addition of netting above the fence to reduce the number of tennis balls exiting the courts into the wetlands area. The Applicant has agreed to discuss this recommendation with the Conservation Commission as part of the Notice of Intent process. 13) The Planning Board recommends consideration of the possibility of extending the limits of fencing reconstruction east of the Farese track beyond the 50--foot No Build Zone further within the resource area buffer zone to provide an additional property barrier for the abutters. The Applicant has agreed to discuss this recommendation with the Conservation Commission as part of the Notice of Intent process. 14) The stormwater management system includes a stone base system to capture and manage the stormwater from the artificial turf field and replacement of a failed culvert. The Project complies with Town Bylaw requirements and Best Management Engineering Practices,the most recent version of the MA DEP Stormwater Handbook, and has been reviewed by the Town's outside consulting engineer,Horsley Witten. FINDINGS OF FACTS and(DETERMINATIONS UNDER LIMITED SITE PLAN REVIEW The purpose of Limited Site Plan Review is to ensure that all religious and education uses, and all child care facilities are reasonably regulated in regards to bulk and height of structures and determining yard sizes, lot area, setbacks, open space,paring and building coverage requirements.The Planning Board has the authority to place reasonable conditions on child-care facilities, and developments proposing religious,or educational uses,but are not permitted to withhold approval of Limited Site Plan Review where there is an inability to satisfy proposed reasonable regulations. Per § 195--8.17.LB of the zoning bylaw, in reviewing a Limited Site Plan Review application for religious uses,educational uses and child care facilities,the following issues shall be considered: a) Relationship of the bulk of structures and adequacy of open spaces to the natural landscape, existing buildings and other community assets in the area and compliance with other requirements of this Bylaw,which includes,but is not limited to,building coverage requirements,yard sizes,lot areas and setbacks; The Board finds that the size,bulk and height of the proposed structures and adequacy of open space is consistent with the existing athletic campus,the natural landscape and other community assets. b) Physical layout of the plan as it relates to convenience and safety of vehicular and pedestrian movement within the site,the location of driveway openings in relation to traffic or to adjacent streets and,when necessary, compliance with other regulations for the handicapped,minors and the elderly; The Project utilizes the existing access/egress drive located off of Osgood Street and is situated along Chickering Road,which allows for pedestrian access only. The Project includes relocation of an existing cross-walk to the tennis courts. The Project utilizes existing pedestrian connectivity throughout the Site, establishing accessible routes from the building to the parking lot and to the athletic facilities. c) Adequacy of the arrangement of parking and loading spaces in relation to the proposed uses of the premises; With the exception of the parking area adjacent to the baseball field, all existing parking areas will remain. The gravel parking area adjacent to the baseball field will be eliminated due to encroachment into wetland buffer zones. d) Physical lighting of the site, especially the adequacy of the method of exterior lighting for convenience, safety and security within the site and for protection of neighboring properties,roadways and the night sky; 4 430 Osgood Street Limited Site Plan Review Renovation of Athletic Facilities April 15,2025 The Project includes new high-efficiency lighting on Site to ensure adequate lighting is provided for player use and safety. The proposed lighting will minimize spill and glare onto adjacent areas. Light pole heights of approximately 80-feet are designed to limit horizontal footcandle spillage and glare conditions outside of the field limits. In addition,pole heights of 80-feet will enable the Project to meet Dark Sky requirements. e) Protection of adjoining premises against seriously detrimental uses by provision for surface water drainage; The Project incorporates compliant stormwater drainage measures to protect adjoining premises. The stormwater management system is described in Finding of Fact 414. f) Adequacy of the methods of disposal of refuse and other wastes resulting from the uses permitted on the site; The Project does not include new dumpsters. g) Adequacy of fire protection measures, and; Adequate emergency access is provided to each of the playing fields and to the tennis courts, as confirmed by NAFD. h) Incorporation of sustainability and resiliency principles into the site design that results in a plan that is responsive to the environment and actively contributes to the development of a more sustainable community. This plan incorporates these principles into the site design. Energy efficient LED lighting on site will meet Dark-Sky lighting requirements,minimizing light pollution. Existing tennis courts are comprised of 6-battery bituminous asphalt courts with perimeter fencing; courts have existed over 30 years. The Project proposes full depth reclamation and reconstruction of asphalt courts,in existing location. Chamfering corners reduces impervious area. The material will be reclaimed and reused as part of the new base for the courts. The site is located within the Residential 2 zoning district. d) The"Applicant"or"Petitioner"refers to North Andover Public Schools in this Limited Site Plan Review Permit Notice of Decision,and its successors and assigns. e) The"Project Owner"refers to the person or entity holding the fee interest to the title to the Locus from time to time, which can include but is not limited to the Applicant, developer, and owner. 17) All Post-Development Activities (Construction Activities, Best Management Practices Management, and Long-Term Pollution Prevention Plan) shall be maintained as specified in the approved Operation&Maintenance Plan, dated January 22, 2025,revised to March 2025, as the same may be amended by the wetlands Order of Conditions for the Project. 18) Post construction pollution prevention and source control shall be implemented in accordance with the Long-Term Pollution Prevention Plan section of the approved Operations&Maintenance Plan and,if applicable the Stormwater Pollution Prevention Plan(SWPPP)required by the NPDES. 19) The Project Owner shall provide evidence of the required procedures outlined in the approved Operations and Maintenance Plan (Section II: Post Development Activities, Section III: Long- Term Pollution Prevention Plan and required Maintenance Logs for the synthetic turf field and stone/pipe trenches) to MassDEP, the Conservation Con nission and/or Planning Board upon request. 20) The Project owner shall allow members and agents of MassDEP,the Conservation Commission, and/or the Planning Board to enter and inspect the Site to evaluate and ensure that the responsible party is in compliance with the requirements for each Best Management Practice established in the approved operations and Management Plan. 21) Approximately one year after the issuance of a Certificate of Occupancy, the Project Owner shall conduct a photometric plan analysis to determine actual lumen intensity as compared with the planned intensity to confirm that light levels are at or below what has been represented in the lumen plans. This analysis shall be presented to the Planning Board. 22) The Applicant shall submit an as--built plan stamped by a Registered Professional Land Surveyor in Massachusetts that shags all construction,including stormwater structures and other pertinent Site features. This as-built plan shall be submitted to the Town Planner for approval and must be provided in paper form as well as in SDF (Standard Digital File) format. 23) Except as may be provided for in these conditions, all construction activities shall be in conformance with these conditions and the approved Plans referenced in condition 447. PRIOR TO SITE WORK,ISSUANCE OF A BUILDING PERMIT,OR CONSTRUCTION 24) If applicable,the Applicant will provide copies of all Decisions,Notification, and orders of Conditions from the North Andover Conservation Commission. 25) Two (2)copies of the signed,recorded Notice of Decision and with endorsed plans attached must be delivered to the Planning Department. 6 43 0 Osgood Street Limited Site Plan Review Renovation of Athletic Facilities April 15,2025 26) The Applicant shall contract with Gale Associates, Inc. as a Construction Monitor. The Monitor shall visit the Site weekly over an estimated twenty-eight-week construction period. The Monitor shall provide monthly reports detailing any areas of noncompliance and corrective actions to the Planning Department throughout the duration of construction. In the event that construction shall cease the Applicant shall notify the Planning Department and reporting shall not be required until the Applicant notifies the Planning Department that construction has re-commenced. 27) At least 14 days prior to the start of land disturbing activities, the Applicant shall provide to the Planning Department a copy of its signed SwPPP prepared in consultation with the Applicants' site contractor(s) and Project engineers. The SwPPP shall be prepared in accordance with the U.S Environmental Protection Agency's Stormwater Construction General Permit(USEPA,2017),as amended,and related guidance document entitled"Developing Your Stormwater Pollution Prevention Plan: A Guide for Construction Operators." 2 8) The Applicant shall provide the Planning Department a combined Operations &Maintenance Plan(O&M Plan),which combines the supplementary operations&Maintenance Plan specific to this Limited Site Plan Review Permit with the existing stormwater practices for the entire High School Campus. 29) The Project owner shall sign the operations & Maintenance Plan and provide a copy to the Planning Department. 3 0) The Applicant shall provide the Planning Department an Illicit Discharge Compliance Statement signed by the Project Owner. 31) Applicant shall submit to the Planning Department a copy of all local,state and federal permits required for the Project shall be submitted to the Planning Department. 32) A construction schedule shall be submitted to the Planning Department for the purpose of tracking the construction and informing the public of anticipated activities. 33) All erosion control measures as shown on the Plan must be in place and reviewed by the Planning Director. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. 34) A pre--construction meeting must be held with the developer,their general contractor,the Planning Department and other applicable departments to discuss scheduling of inspections to be conducted on the Project,and to review these conditions,and the construction schedule. DURING CONSTRUCTION 35) Dust mitigation must be performed weekly,or more frequently as directed by the Planning Director,throughout the construction process. Where the Department of Environmental Protection is requested to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before MassDEP. 12. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of Compliance(WPA Form 8A) to the Conservation Commission. 13. The work shall conform to the plans and special conditions referenced in this order. 14. Any change to the plans identified in Condition #13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing of a new Notice of Intent. 15. The Agent or members of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours to evaluate compliance with the conditions stated in this order, and may require the submittal of any data deemed necessary by the Conservation Commission or Department for that evaluation. 15. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland, the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or water body. During construction, the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission, which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. 9. The work associated with this order(the"Project") (1) E is subject to the Massachusetts Stormwater Standards (2) ❑ is NOT subject to the Massachusetts Stormwater Standards If the work is subject to the Stormwater Standards,then the project is subject to the following conditions: a) All work, including site preparation, land disturbance, construction and redevelopment, shall be implemented in accordance with the construction period pollution prevention and erosion and sedimentation control plan and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Construction General Permit as required by Stormwater Condition 8. Construction period erosion, sedimentation and pollution control measures and best management practices (BMPs) shall remain in place until the site is fully stabilized. b) No stormwater runoff may be discharged to the post-construction stormwater BMPs unless and until a Registered Professional Engineer provides a Certification that: i. all construction period BMPs have been removed or will be removed by a date certain specified in the Certification. Prior to requesting a Certificate of Compliance, or Partial Certificate of Compliance, the responsible party (defined in General Condition 1 8(e)} shall execute and submit to the issuing authority an operation and Maintenance Compliance Statement("O&M Statement) for the Stormwater BMPs identifying the party responsible for implementing the stormwater BMP Operation and Maintenance Plan ("O&M Plan") and certifying the following: i.) the O&M Plan is complete and will be implemented upon receipt of the Certificate of Compliance, and ii.)the future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management BMPs and implement the Stormwater Pollution Prevention Plan. d) Post-construction pollution prevention and source control shall be implemented in accordance with the long-term pollution prevention plan section of the approved Stormwater Report and, if applicable, the Stormwater Pollution Prevention Plan required by the National Pollution Discharge Elimination System Multi-Sector General Permit. e) Unless and until another party accepts responsibility, the landowner, or owner of any drainage easement, assumes responsibility for maintaining each BMP. To overcome this presumption, the landowner of the property must submit to the issuing authority a legally binding agreement of record, acceptable to the issuing authority, evidencing that another entity has accepted responsibility for maintaining the BMP, and that the proposed responsible party shall be treated as a permittee for purposes of implementing the requirements of Conditions 18(f) through 8(k)with respect to that BMP. Any failure of the proposed responsible party to implement the requirements of Conditions 18(f)through 18(k)with respect to that BMP shall be a violation of the Order of Conditions or Certificate of Compliance. In the case of stormwater BMPs that are serving more than one lot, the legally binding agreement shall also identify the lots that will be serviced by the stormwater BMPs. Procedural History:. On January 23, 2025, the NACC received a Notice of Intent and associated attachments, stormwater management report, and site plans for proposed work at the project site. The NACC held the public hearing at its February 12, 2025, February 26, 2025, March 12, 2025, April 9, 2025 and April 23, 2025 meetings. This project was subject to permitting with the Planning Board pursuant to Limited Site Plan Review Permit under Article S Supplementary Regulations, Part 3 Site Plan Review and Article 10 Administration 195-10.7 of the North Andover.zoning Bylaw. The Board issued an approval decision on April 15,2025. The project stormwater design has been reviewed by the Town's outside consulting engineer, Horsley Witten,for compliance with the Town Stormwater Bylaw requirements and Best Management Engineering Practices, the most recent version of the MA DEP Stormwater Handbook. There were extensive discussions between the Town's outside consultant engineer and the project engineer related to the overall design and Operations & Maintenance Plan (See correspondence from Horsley Witten dated February 25, 2025, March 14, 2025 and April 1, 2025 and response correspondence from Gale Associates, Inc. dated March 10, 2025 and March 26, 2025). Throughout the hearing process, the applicant's project engineer provided a number of materials, documents and interim revised plans in response to the NACC and Conservation Department staff s requests (as well as the Planning Board's requests) for information and plan revisions. Portions of the work will occur within the wetland stream resource areas as well as within the 25" NDZ and 50' NBZ. A waiver Request has been submitted seeking relief from the restrictions in these zones. After due consideration, the NACC voted in favor of granting,the waivers as the NACC finds: • Removal of the collapsed culvert and the entire asphalt walkway within the 25' NDZ and remaining buffer zone necessitates work within the resource area and the 25' NDZ. The NACC finds the complete restoration of the stream channel, associated bordering vegetated wetland and associated buffer zone to a naturalized state will improve and enhance the condition and function of these resources. • Removal of the gravel access drive and parking area from within the 25' NDZ and 50' NBZ necessitates work in these zones. Stormwater runoff will be infiltrated via a proposed stone infiltration trench as requested by the NACC and will improve recharge. The NACC finds this work to result in no further degradation, but slightly improved conditions of the buffer zone. At its April 23, 2025 meeting, having received sufficient information, and there being no further need for supplemental information and no remaining questions from the NACC or the public, the NACC voted 7-0 (7 in favor, 0 opposed) to close the hearing and issue an Order of Conditions within 21 days. The NACC reviewed a draft order of Conditions that same evening, and voted 7-0 (7 in favor, 0 opposed) to issue this order of Conditions, Findings of Facts and Special Conditions approving the project under the Massachusetts Wetlands Protection Act and the North Andover Wetlands Protection Bylaw. The NACC finds that the intensive use of the upland areas and buffer zone can cause further alteration of the wetland resource areas. Therefore, in order to prevent any alteration of wetland resource areas a twenty five foot 25' No-Disturbance zone and a fifty foot 5(') No-Construction zone shall be established from the edge of the adjacent wetland resource area. The Conservation Administrator and/or other agents of the NACC do not have the authority to waive these setbacks as established under the local bylaw. No disturbance of existing grade, soils or vegetation is permitted in the No-Disturbance zone notwithstanding proposed mitigation measures within the buffer zone and resource areas as approved under this Order of Conditions. (See Section 3.4 &Appendix F of the local Regulations). 32. This document shall be included in all construction contracts subcontracts and specifications dealing with the work proposed and shall supersede ally conflictin contract re uirements. The applicant shall assure that all contractors, subcontractors, and other personnel performing the permitting work are fully aware of the permits terms and conditions. Thereafter, the contractor will be held jointly liable for any violation of this Order resulting from failure to comply with its conditions. 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions order of Conditions Page 7 of 21 430 Osgood Street,North Andover High School-DEP FILE#242—1906 Findings&Special conditions 33. Unless otherwise arranged between parties, the owners of the project and their successors in title agree that the Order does not in itself impose upon the Town any responsibility to maintain the proposed drainage system and that said Town shall not be liable for any damage in the event of failure. By acceptance of this Order, the owners agree to indemnify and hold harmless to the Town and its residents for any damage attributable to alterations undertaken on this property pursuant to the Order. Issuance of these conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding, storm damage or any other form of water damage. Maintenance of the drainage system, if accepted by the Town as part of a public way, becomes the responsibility of the Town. 34. Issuance of these conditions does not in any way imply or certify that the site or downstream areas will not be subject to flooding, storm damage or any other form of water damage. 35. Any non-compliant features found as part of this Partial Certificate of compliance review will be rectified during work performed under this Order of Conditions, DEP File #242-1906. 36. A comprehensive as-built survey of the entire High School campus shall be performed at the conclusion of work under #242-1906 so as to request a full and complete Certificate of Compliance for both OOC's #242-1045 & #242-1906. PRIOR TO CONSTRUCTION 37. No work shall be undertaken until all administrative appeal periods from this order have elapsed or, if such an appeal has been filed, until all proceedings before the Department or Court have been completed. 38. This Order shall be recorded, in its entirety,by the applicant at the Registry of Deeds immediately after the expiration of all appeal periods. No work shall be undertaken until the Final order has been recorded in the Registry of Deeds or the Land court for the district in which the land is located, within the chain of title of the affected. property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final order shall also be noted on the Land court certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be submitted to the North Andover Conservation commission on the form at the end of this Order prior to commencement of the work. Any order not recorded by the applicant before work commences may be recorded by the NACC at the applicant's expense. 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions order of Conditions Page 8 of 21 430 Osgood Street,North Andover High School-DEP FILE#242---1906 Findings& Special Conditions 39. The contractor shall provide a check payable to the Town of North Andover shall be provided in the amount of fifty thousand dollars ($50,000), to serve as a performance bond, which shall be in all respects satisfactory to Town Counsel, Town Treasurer, and the NACC, and shall be posted with the North Andover Town Treasurer through the NACC before commencement of work. Said deposit of money shall be conditioned on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, and Town Counsel, and shall be released after completion of the project, provided that provisions, satisfactory to the NACC, have been made for performance of any conditions which are of continuing nature. The applicant may propose a monetary release schedule keyed to completion of specific portions of the project for the NACC's review and approval. This condition is issued under the authority of the local Bylaw. 40. The applicant shall designate a wetland Scientist (or other qualified environmental professional as approved by the NACC or its agent) as an"Erosion Control Monitor" to oversee any emergency placement of controls and regular inspection or replacement of sedimentation control devices. Proof of the retained monitor must be submitted to the Conservation Department on letterhead by the retained consulting firm in time for the sit-down meeting. Contact information for the erosion control monitor shall be forwarded to the Conservation Department in time for the sit-down meeting. This person shall be given the authority to stop construction for the purposes of correcting problems with erosion control. The Environmental Professional will immediately notify the Conservation agent of any matter that requires attention by the Commission or the agent. The erosion control monitor must be available during any 24-hour period, including weekends in case of an emergency. The erosion control monitor will be required to inspect all such devices and oversee cleaning and the proper disposal of waste products. Cleaning shall include removal of any entrapped silt. 41. Prior to work commencing on site and the on-site pre-construction meeting, the following documents and materials shall be submitted and then the contractor, applicant, project engineer, erosion control monitor, and wetland scientist shall arrange a meeting,with the Conservation Administrator [and Planning Department staff, if available] to review and establish the following: a. 100% construction drawings accompanied by a memorandum that details plan revisions versus the approved plan set referenced in this Order and shall be submitted to the Conservation Department. The memorandum shall provide a review of any revisions within the Commission's jurisdiction and resulting conflicts with the Special Conditions of this Order. The Conservation Department in consultation with the Chairman shall make a determination as to whether said revisions can be reviewed administratively or by way of modification or amendment with the Commission. b. 3.0 Ensuring-Limited Chemical Contamination in Turf Field Materials: The applicant and its design consultant, in coordination with the contractor [who 430 Osgood Street DEP File 4242-1906 NACC Findings&Special Conditions order of Conditions Page 9 of 2 1 430 Osgood Street,North Andover Nigh School-DEP FILE#242—1906 Findings&Special Conditions will assumedly be directly purchasing the turf and inf ill} must submit a certified letter and specifications sheet certifying that the products used in the turf and inf ill meet or exceed specified requirements including certification from the turf manufacturer that lead or lead chromate, or the PFAS regulated by MassDEP (PFHxS, PFHp& PFOA, PFOS, PFNA, PFDA), and on the most current European Union REACH and California Proposition 65 compound lists are not used in the manufacturing of the specified system. Prior to shipping the actual material to be installed at the project site, the contractor, in coordination with the synthetic turf and infill suppliers, shall deliver to the design consultant and the Conservation Commission for its review, three (3) copies of notarized letter addressed to the owner/applicant certifying that all products provided by them for incorporation into the system do not contain PFAS quantified by EPA Method 1633 or Engineer approved equivalent and do not contain any other hazardous materials exceeding current EPA and CPSC requirements. The PFAS testing method utilized must report at least 40 PFAS compounds including the 6 PFAS regulated by the MassDEP, and on the most current European Union REACH and California Proposition 65 compound lists. The Synthetic Turf Field System shall be non-detect (ND) for 40 PFAS compounds tested via EPA Method 1633 and have a statement from the vendor that the turf does not contain intentionally added PFAS. Materials that comprise the Synthetic Turf Field System shall be free of pesticides, heavy metals,VOCs, and all PFAS compounds quantified by EPA Method 1633 or ENGINEER.approved equivalent. It shall be the applicant's onus to provide industry standards for PFAS. c. A copy of the Order of Conditions, with each page bearing;the general contractor/site supervisor's initials to ensure acknowledgment/understanding of all conditions herein. d. The Stormwater Pollution Prevention Plan (SV\TPPP) shall be submitted and provisions therein shall be reviewed, to ensure their understanding and expectations for construction. The SWPPP shall be prepared in accordance with the U.S Environmental Protection Agency's Stormwater Construction General Permit and related guidance document entitled "Developing Your Stormwater Pollution Prevention Plan: A Guide for Construction Operators". e. Specifications for de-watering (excavation and surface) means and methods. f. Review of the entire Order of Conditions to ensure understanding by all parties. g. A contact list for all responsible parties for site development and monitoring phases. Contact list shall include names, role, cell and office phone numbers, marling addresses and email addresses. 42. Prior to construction and in time for the on-site pre-construction meeting the following shall be implemented/prepared for Conservation Department inspection: 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions Order of Conditions Page 10 of 21 430 Osgood Street,North Andover High School-DEP FILE#242—1906 Findings&Special Conditions a. A sign, visible from the public way at the main construction access, shall be displayed at the site, not less than two square feet or more than three square feet in size bearing the words "Massachusetts DEP, File Number 242-1.946." b. All erosion control measures shall be properly installed, by..survey in the field, between all construction areas and wetlands as shown on the approved plan set. c. The installed erosion controls shall be inspected and approved by the NACC or its agent prior to the start or continuation of construction (as appropriate per phase) and shall remain intact until all disturbed areas have been permanently stabilized to prevent erosion. All additional erosion prevention and sedimentation protection measures found necessary during construction shall be implemented at the direction of the NACC or its agent. The NACC reserves the right to impose additional conditions on portions of this project to mitigate any impacts, which could result from site erosion, or any noticeable degradation of surface water quality discharging from the site. For example, installation of erosion control measures may be required in areas not shown on the plan(s) referenced in this order of Conditions. Should such installation be required by the NACC, they shall be installed within 48 hours of the Commission's request. d. Prior to implementation in the field and in time for the on-site pre-construction meeting, dewatering BMP's shall be on site and reviewed and approved by the Conservation Department and shall be proposed outside the 100-Foot Buffer Zone. All dewatering activities shall be supervised and witnessed by the designated erosion control monitor. De-watering activities shall be monitored daily by the erosion control monitor to ensure that sediment laden water is appropriately settled prior to discharge toward the wetland resource areas. No discharge of water is allowed directly into an area subject to jurisdiction of the Wetlands Protection Act and/or the North Andover wetland Bylaw. If other emergency de-watering requirements arise, the applicant shall submit a contingency plan to the Commission for approval, which provides for the pumped water to be contained in a settling basin, to reduce turbidity prior to discharge into a resource area. e. wetland flagging shall be checked in the field prior to start of construction and shall be re-established where missing. All wetland flagging shall remain visible and enumerated per the approved plan(s) throughout the life of the project and until a Certificate of Compliance is issued so that erosion control measures can be properly placed and wetland impacts can be monitored. Such barriers shall be checked and replaced as necessary and shall be maintained until all construction is complete. f. Prior to any construction and in time for the on-site pre-construction meeting, all wetland resource areas and associated buffer zones shall be canvassed and cleaned of all trash (including errant tennis balls in and around the tennis court battery). 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions order of Conditions Page 11 of 21 430 Osgood Street,North Andover High School-DEP FILE#242—1.906 Findings&Special Conditions g. The existing shed slated for removal shall be moved to a location outside the 100-foot buffer zone, and its final permanent location shall be outside the 100- f oot buffer zone. h. The inverts and sumps of the existing catch basin on the west side of Wayne Street, directly down gradient from the proposed bituminous pavement driveway apron providing vehicle access to the southeast corner of the proposed synthetic turf field shall be verified. If not already, this existing catch basin shall be fitted with a water quality hood (see Condition #52). Applicant shall provide verification of same prior to construction. i. Prior to construction all existing catch basins shall be cleaned and the maintenance/bills of lading shall be provided to the Conservation Department upon immediate availability. Cleaning of these catch basins must be undertaken within a four weeks of construction commencement. j. All existing and proposed catch basins and any other stormwater inlets within the project limits or on the streets adjacent to the project shall be protected by erosion/sed.imentation controls to prevent sediment from entering the drainage system... Erosion/sedimentation controls shall be maintained and regularly cleaned of sediments until all areas associated with the work permitted by this Order have been permanently stabilized and the Commission has formally approved their removal. k. The applicant shall have on hand at the start of any soil disturbance, removal or stockpiling, an additional 100 feet of silt soc Lcompost filter tube silt fence and sufficient stakes for stakin covered from the elements &not less than 3 rolls of Z 00% biodegradable erosion control blanketi and shall be used only for the control of emergency erosion problems and shall not be used for the normal control of erosion. The NACC or its Agent shall have the discretion to require additional emergency erosion control BVIP's to be brought to the site if deemed necessary. 1. Prior to construction and/or as soon as logistically possible, the applicant shall permanently mark (or reestablish where missing throughout the site) the No Disturb zone/(No Build zone at gravel drive) with weather resistant monuments or on fencing as appropriate, installed at intervals agreed upon in consultation with the Commission or designated agent,bearing markers reading: "Protected wetland Resource Area" at a ratio of one square marker for every three round markers. This will designate the wetland resource sensitivity and assure no further inadvertent encroachment into the wetland. Prior to installation in the field, the placement of these permanent markers shall be subject to review and approval by the Conservation Administrator. The applicant shall instruct all agents to explain these markers to buyers/lessees/landscapers and all persons taking over the property from the applicant. These markers shall remain posted and be replaced as necessary in perpetuity. Said markers are available for purchase in the Conservation Department at Town Hall. 430 Osgood Street DEP Fite#242-1946 NACC Findings&Special Conditions Order of Conditions Page 12 of 21 430 Osgood Street:,North Andover High School-DEP FILE#242--1906 Findings&Special Conditions m. Prior to construction and/or as soon as logistically possible, "No Snow Stockpiling/No Salt" signs shall be installed in locations as agreed upon and in coordination with the conservation Department. These signs shall be maintained and replaced as necessary. n. The Project owner shall sign the combined Operations &Maintenance Plan and provide a copy to the conservation Department; o. The Applicant shall provide the Conservation Department an Illicit Discharge Compliance Statement signed by the Project Owner; p. Prior to any work commencing on site, it is the responsibility of the applicant to procure all other applicable federal, state and local permits and approvals required for this project, or phases of the project where appropriate, and no work within the Commission's jurisdiction shall commence until all other state or local permits, approvals, and variances have been obtained. This is to ensure that impact to jurisdictional areas are avoided in the case that any such permit is denied or withheld for any period of time, thereby maintaining the integrity of the resource area or buffer zone until such time all approvals are granted. 43. The erosion controls shall serve as the limit of work. All project personnel shall be informed that no use of machinery, storage of machinery or materials, stockpiling, of soil, or construction activity is to occur beyond this line at any time. 44. Once these above mentioned pre-construction requirements are complete, the applicant shall contact the conservation office prior to site activities and shall arrange an on-site conference with an NA.CC representative, the contractor and any other principal personnel, erosion control monitor, project engineer, wetland scientist and the applicant to ensure that all of the conditions of this Order are understood. A reasonable period of time shall be provided as notice of the pre-construction meeting (e.g. 72 hours). 45. At least once during each week in which construction activities occurs on-site and for as long thereafter as ground remains unstabilized, the applicant/erosion control monitor shall submit a written report with photographs to the NAcc certifying that, to the best of his/her knowledge and belief based on a careful site inspection, all work is being performed in compliance with this Carder of conditions and that approved setbacks are being adhered to. The erosion control monitor must visually inspect all sedimentation/erosion control measures and assume responsibility for their maintenance on a weekly basis and that they are functioning as intended. In addition, all wetland resource areas must be visually inspected for siltation, turbidity, and/or other water quality impacts. The Erosion control Monitor shall be on site during and following a major storm event of 1/2" inch of rain or greater (24 hour event) to ensure that soils remain stable, and erosion controls are adequate and secure. 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions order of Conditions Page 13 of 21 430 Osgood Street,North Andover High School-DEP FILE#242--1.906 Findings& Special Conditions 46. No than es to the a roved tan shall be implemented in the field until written a royal has been granted bv the NACC. Any changes in the submitted plans caused by the applicant, another Board's decision or resulting from this order of Conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds said changes to be significant, the NACC will call for another public hearing (at the expense of the applicant). Within 21 days of the close of said public hearing the NACC will issue an amended or new order of Conditions. Any errors found in the plans or information submitted by the applicant shall be considered as changes. 47. It is the responsibility of the applicant, owner, and/or successor(s) to ensure that all conditions of this order of Conditions are complied with. The project engineer and contractors are to be provided with a copy of this order of Conditions and referenced documents before commencement of construction. 48. The applicant and/or the legal owner of that portion of land upon which these orders of Conditions have been placed shall provide to the NACC prior to transferring,, or assigning any portion of said land to another party, subject to said orders of Conditions, the "Compliance Certification Form Affidavit" attached via "Appendix A" signed under the pains and penalties of perjury, stating that said applicant and/or owner has read these orders of Conditions and is in compliance with each and every condition. This document shall apply to each of the conditions referenced herein and shall be provided to the Conservation Department at least five (5) business days prior to the closing of said land transaction. STORMWAT'ER MANAGEMENT CONDITIONS 49. There shall be no increase in the post development discharges from the storm drainage system or any other changes in post development conditions that alter the post development watershed boundaries as currently depicted in the Notice of Intent and approved by this order of Conditions, unless specifically approved in writing by the Commission. 50. The proposed stormwater management facilities shall be constructed in compliance with the approved plans, and their preparation and installation shall be overseen by the design engineer or other qualified professional so as to certify compliance and correct means and methods for their construction. 51. water quality in down gradient Bvw's shall not differ significantly following completion of the project from the pre-development conditions. There shall be no sedimentation into wetlands or water bodies from discharge pipes or surface runoff leaving the site. 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions Order of Conditions Page 14 of 21 430 Osgood Street,North Andover High School-DEP FILE#242—1906 Findings& Special Conditions 52. All catch basins on site new and existing)- all contain hoods and it shall be a continuing condition of this order, even after a Certificate of Compliance is issued, that the hoods in the catch basins be maintained. All catch basins shall be cleaned of all accumulated silt and debris, and material disposed of per applicable regulations, before construction commences and before a Certificate of Compliance is issued and the owner or his/her agent shall so specify in the request for Compliance. 53. Prior to the issuance of the Certificate of Compliance, the applicant shall be responsible for cleaning all stormwater structures, in accordance with the approved Combined Operation and Maintenance Plan (O&M) approved herein and the associated stormwater management conditions mandated herein. Evidence of said cleaning (i.e. invoices/bills of lading) shall be submitted to the Conservation Department for its file. 54. The applicants, owners, and their successors and assignees, shall maintain all culverts, collections basins, traps, outlet structures, subsurface storage areas, and other elements of the drainage system, in order to avoid blockages and siltation which might cause failure of the system and/or detrimental impacts to on-site or off-site resource areas, and shall maintain the integrity of vegetative cover on the site. 55. All stormwater best management practices shall be maintained as specified in the Combined Operation and Maintenance Plan(O&M) submitted with this project application and incorporated in the Order of Conditions. Evidence of maintenance of the stormwater management system shall be provided to the NACC on an annual basis by a Registered Professional Civil Engineer or other qualified professional post construction. The first report shall be submitted to the NACC one year after the first stormwater structure goes on-line. The approved Combined operation & Maintenance Plans are fully binding upon the applicant and/or owners, successors, agents, associations,heirs and assigns and must be adhered to in perpetuity. DUR1:NG CONSTRUCTION 56. The gravel drive and parking area slated for removal and restoration shall be excavated to a depth so as to reach parent soils and backfilled with clean soils and appropriate growing media to receive the native seed mix. This work shall be directly supervised by the wetland scientist who shall document conditions and confirm compliance, and submit a report summarizing this work to the Conservation Department upon immediate availability. 57. Once the fencing along the 50' NBz at the edge of the gravel access drive is installed, signs indicating that area is a "No Mow" zone shall be installed on the fence at 50' 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions order of Conditions Page 15 of 21 430 Osgood Street,North Andover High School-DEP FILE#242--1906 Findings&Special Conditions intervals, in addition to the wetland markers. These markers shall remain in perpetuity. 58. Any temporary stockpiles of RCA/excavated asphalt and any other demotion materials shall be located outside of areas subject to protection under the Wetlands Protection Act and North Andover Wetlands Bylaw, including but not limited to the 100 foot Buffer Zone, Bordering Land Subject to Flooding or Riverfront Area. Said stockpiles shall be covered and protected so as to prevent any of their potentially impacted runoff from reaching the wetland resource areas. 59. All areas of buffer Zone and wetland restoration and planting/seeding shall be undertaken pursuant to "Wetland Replication and Restoration Area construction Sequence" as detailed on the Wetland Restoration Plan, sheet 16 of 37, Drawing No. L101, and shall be directly supervised a qualified wetland scientist who shall provide a written report of restoration preparation and plant installation immediately upon availability. 60. Any proposed landscaping within jurisdictional resource areas shall consist of species native to New England. Landscaping outside jurisdictional resource areas shall consist of species that are non-invasive in all respects. Prior to implementation, a final landscape plan with plant schedule, shall be submitted to the NACC/Conservation Administrator for review and approval. This plan may be included in the 100% construction drawings per Special condition#41.a. 61. Invoices for the purchase of native New England Seed Mixes/plantings referenced above in condition#59 above shall be provided to the conservation Department upon immediate availability and before install/seed application in the field. 62. Prior to final seeding, an invasive species inventory shall be performed by the wetland scientist to provide base-line documentation of invasive species that are either within restored areas or adjacent thereto. 63. Under the direct supervision of a qualified wetland scientist the restored areas within jurisdictional areas shall be monitored for at least two full growing seasons post installation (during the height of the growing season early-mid July) and reports shall be submitted to the Commission no later than November 15t of each year. Upon observation, dead or dying plantings or seeded areas shall be replanted, as seasonal conditions allow. Invasive species shall be monitored and removed manually upon observation. Detection of invasive species, an estimation of their coverage and management of same shall be included in said reports. The restoration planting areas shall exhibit an overall survivorship of at least 75% after two full growing seasons. 64. If deemed necessary, methods for more involved management of invasive species (such as root barriers for Phragmites or herbicide application) shall be discussed with 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions order of Conditions Page 1 of 21 430 Osgood Street,North Andover High School-DEP FILE#242--1906 Findings&Special conditions the Conservation Department and implementation of any proposed non-manual methods shall be reviewed and approved by the Conservation Commission, its Chairman or Administrator depending on type of methods proposed. 65. Upon beginning work, the applicant/wetland scientist/erosion control monitor shall submit written progress reports every month detailing what work has been done in or near resource areas, and what work is anticipated to be done over the next period. This will update the construction sequence and can be a part of the weekly erosion control reports. 66. Any imported and/or structural fill shall be certified clean fill, free of hazardous substances and meeting all applicable regulations. Notwithstanding, any imported fill used in connection with this project shall be clean fill,containing no trash, refuse, rubbish or debris, including but not limited to roots, concrete, other non-soil constituents, and other deleterious or compressible materials lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, glass, processed glass aggregate, concrete, recycled concrete aggregate, tires, ashes, refrigerators, motor vehicles or parts on any of the foregoing. An f ill im orted to the site must be accom anied b a certificate of on in or an anal sis certifying cleanliness -whichever is most applicable as determined b the Conservation Commission or its staff. 67. No outdoor fuel storage or construction equipment refueling shall occur within jurisdictional resource areas during construction. 68. All exposed soil finish grade surfaces shall be immediately landscaped and stabilized, or foamed, seeded and mulched,with a layer of mulch hay. All disturbed areas must be graded, loamed and seeded prior to November 1st of each year. outside of the growing season, beyond November 15th of any construction year, exposed soil finish grade surfaces shall be stabilized with a layer of mulch hay, straw, tackif ier or biodegradable erosion control blanket (as appropriate depending on slope, or other conditions etc...) until climate conditions allow for seeding. During construction, any area of exposed soils that will be left idle for more than 30 days shall be stabilized with a layer of mulch hay or other means approved by the NACC. 69. Associated pavement and roadways shall be swept at least weekly or as directed by the Erosion Control monitor, the Site Supervisor, Project Manager, or Conservation staff for as long as the site remains exposed and un-stabilized. If material is tracked beyond the construction entrance onto the adjacent public roadway, it will be swept up daily. 70. No re-grading in the buffer zone shall have a slope steeper than 2:1 (horizontal: vertical), unless otherwise shown on approved plans referenced herein. 430 Osgood Street DEP File#242-1906 NACC Findings&Special Conditions order of Conditions Page 17 of 21 430 Osgood street,North Andover High school-DEP FILE#242--1906 Findings& Special Conditions 71. Materials stockpiling shall occur outside jurisdictional resource areas. At no time shall be stockpiling of soil or any other materials occur on the wetland side of the erosion controls. 72. All waste generated by, or associated with, the construction activity shall be contained within the limit of work, and away from any wetland resource area. There shall be no burying, of spent construction materials or disposal of waste on the site by any other means. The applicant shall maintain dumpsters (or other suitable means) at the site for the storage and removal of such spent construction materials off-site. However, no trash dumpsters will be allowed within jurisdictional resource areas. 73. Accepted engineering and construction standards and procedures shall be followed in the completion of the project. 74. During and after work on this project, there shall be no discharge or spillage of fuel, or other pollutants into any wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant within one (1) business day. No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 1.00 feet of a resource area. [[:A::::F::ITER CONSTRUCTION 75. Following completion of construction, the applicant shall stencil, with appropriate weather resistant paint, all catch basin inlets to prohibit dumping and indicate that the inlet is for the disposal of stormwater only and discharges to waterways or wetlands. 76. All of the restored areas (both buffer zone and wetland resources) shall be left to naturalize and shall not be subject to routine landscape maintenance of any kind. 77. No underground storage of fuel oils shall be allowed on any lot within one-hundred (100) feet of any wetland resource area. This condition shall survive this Carder of Conditions and shall run with the title of the property. This condition is issued under the authority of the Town's wetland protection Bylaw. 78. Fertilizers utilized for landscaping and lawn care shall be slow release, low-nitrogen types (< 5%), and shall not be used within 25 feet of a resource area. Pesticides and herbicides shall not be used within 100 feet of a wetland resource area. This condition shall survive this Order of Conditions and shall run with the title of the property. No sodium.-based products shall be used for control of ice or snow within 100 feet of the wetland. 80. There shall be no dumping of leaves, grass clippings, brush, or other landscape debris into a wetland resource areas or the 25-foot No-Disturb Zone or the restored 50-foot No-Build Zone at the edge of the gravel access drive. This condition shall remain in perpetuity. 81. Upon completion of construction and grading, all disturbed areas located outside resource areas shall be stabilized permanently against erosion. This shall be done by foaming and seeding according to NRCS standards. Stabilization will be considered complete once full vegetative cover has been achieved. 82. The use of coal tar-based pavement sealants is prohibited on the property, as they have been determined to contribute high levels of polycyclic aromatic hydrocarbons (PAHs) to stormwater runoff. This condition shall survive the order of Conditions and shall run with the title of the property. 83. Upon approved site stabilization by Conservation staff, the erosion controls shall be removed and properly disposed of and all exposed unvegetated areas shall be seeded. 84. Upon completion of the project, as assured by Town management and purposefully budgeted for and confirmed in the NACCs January 24, 2025 Memorandum addressed to Town Management, the project proponent shall have a complete and comprehensive on the ground survey undertaken of the entire High School campus so as to secure a complete and final Certificate of Compliance to close out the outstanding order of Conditions, DEP File #242-1045, as well as this order of Conditions, DEP File #242-1906. 85. Upon completion of the project the applicant shall submit requests for a Certificates of Compliance as noted above in Condition #84: a. wPA.Forms 8A-- "Request for a Certificate of Compliance." b. Letters from the applicant requesting a Certificate of Compliance for respective DEP File #'s. c. The name and address of the current landowner. d. The name and address of the individual/trust or corporation to whore the certificate of compliance is to be granted. e. The street address and assessor's map/parcel number for the project. f. A complete and comprehensive "As-Built" plan depicting the entirety of the Nigh School campus, prepared and signed and stamped by a Registered Professional Civil Engineer and a Registered Professional Land Surveyor of the Commonwealth, for the public record. This plan will include: ➢ "As-Built" post-development elevations of all drainage & stormwater management structures constructed on site. ➢ "As-Built" post-development elevations and grades of all filled/altered or restored wetland resource areas including the encompassing buffer zone which is regulated as a resource area under the local wetland Protection Bylaw. ➢ Limits of wetland resources,buffer zones and subzones (25`NDZ/50-fNBZ/100"BZ). ➢ Distances from.ALL structures/project features to wetland resource areas. ➢ A line showing the limit of work and the extent of existing erosion control devices. "Work" includes any disturbance of soils or vegetation. ➢ Location of all subsurface utilities entering the property. 86. The following special conditions shall survive the issuance of a Certificate of Compliance (COC) for this project: ➢ 25' No-Disturbance zone and a 50' No-Construction zone. Future work within 100" of existing wetland resource areas will require a separate filing with the NACC of the Regulations for performance standards within these zones) The Conservation Administrator and/or other agents of the NACC do not have the authority to waive these setbacks as established under the local Bylaw (Condition #31); ➢ Resource Area Markers shall be maintained (Condition #42.1.); ➢ Snow management signs shall be maintained (Condition#42.m.); ➢ All catch basins on site to be equipped with hoods (Condition #52); ➢ Maintenance of stormwater BMP's and adherence to the "Combined Operation and Maintenance Plan"".
