Referring to the above petition for a Site Plan Review Special Perrmit from the requirements of the North
Andover Zoning Bylaw Sections 8.3, 10.3p 10.31 and 1 , and M.G.L. 640A, Sec. 9.
So as to allow to allow a contractor's yard and outside storage of landscape products and
landscape/contractors ec u* went located within the Corridor Development District (CDD3)Zoning

The Planning Board herein APPROVES the Site 'lazy Review Special Permit as to allow a.contractor's
card and outside storage of landscape products and landscape/contractors equipment located within the
Corridor Development District 3 CI 1 Zoning District. The project is located at 1429 Osgood Street,
North Andover Massachusetts, 0184 ,Assessors leap 3 4,Parcel 20.This Special I ennit was requested
by Oliver Enterprises, Inc. 5 Hancock Street, wobum,MA. 0 18 0 1, wobu -r,MA o 18 0 1. The application
was filed with the Planning Board on April 12, 2018.The public hearing on the above referenced
application was opened on June 5,2018 with additional hearing dates of June 19 and July 24,2018. The
public hearing was closed by the North Andover Planning Board on August 21,2018. The applicant
submitted a complete application,which was noticed and reviewed in accordance with Section 8.3, 10.3,
10.31 and 16 ofthe Town of North Andover Zoning Bylaw and M L Chapter 40A., See. 9.
The Planning Board vote was unam6mo s. A special permit issued by the permit granting authority
requires a vote of at least four members of a five-member b r board.
The Applicant is hereby notified that should the Applicant disagree with this decision,the
Applicant has the right, under MGL Chapter 4 A, Section 17,to appeal this decision within
Twenty days after the date this decision has been filed with the Town Clerk.
In accordance with 8.3, 1 .3, 10.3 i, and 16 the Flaming Board rakes the finding that the intent of the
Bylaw, as well as its specific criteria are met. This decision specifically stated by the Planning Board
makes the following MUGS of FACT:

1 The specific site is an appropriate location for the project.
2 The use as developed will not adversely affect the neighborhood.
3 There will be no nuisance or serious hazard to vehicles or pedestrians.
4 Adequate and appropriate facilitieswill be provided for the proper operation of the proposed use.
5) The project involved the modification of an existing structure.
6 The building contains 21,000 sq. feet of combined office and warehouse space.
7) The Conservation Administrator has received a Notice of Intent Filing. The Commission i
current reviewing the proposed project.
8 The Building Commissioner has deemed the use is allowed by special pert under yl w,
Section 16. The entry and parking must meet A.D.A.standards (see email from.Paul Hutchins
dated August 8,2018).

The Fire Department reviewed the project and has confirmed wing ability

Department apparatus. Any flanunable or combustible storage must comply with NFPA 30.
Mulch in excess of 3 00 cubic yards rust be permitted through the fire department and rust have
30 feet between piles, any storage rust comply with the occupancy classification allo vable
quantities according to the Building and Fire codes,documentation needed for the sprinkler
systems change in use of occupancy. (See memo from Chief McCarthy dated July 24, 2018

the amount of lot coverage from 93%to 85.3%. There are no new buildings proposed to be
constructed.

14.5 %. The minimum usable open space requirement is 3 0%. There are no now buildings
proposed to be constructed.

• The "Plans"refer to the plans prepared by Allen &Major Associates, Inc., 100 Commerce

Development District Plan for Mixed-Use Development", dated April 12, 2018 and revised to
August 7, 2018,prepared for Oliver nt i- rises,Inc.
0 The "Project" refers to allowing a contractor's yard and outside storage of landscape products

• The "Applicant" refers to Oliver Enterprises,Inc., 5 HancockStreet, Woburn,urn,MA 01801,the

* The "Project Owner" refers to the person or entity holding the fee interest to the title to the
Locus from time to time, which can include but is not limited to the applicant, developer, and
owner.
19 The Director of Plannixig shall approve any changes made to these plans.Any changes deemed
substantial by the Planning Department would require,a Public Hearing and Modification by the
Planing Board.
0 Any flammable and/or combustible storage must comply with NFPA 30.
21 The proposed development must not present a demonstrable adverse impact on the surrounding
area resulting from excessive noise, dust, smoke, or vibration which are higher than levels no
experienced from uses permitted in the surrounding area..

2 The commercial use shall comply with applicable state air pollution control regulations and
policies in connection with sound levels.
2 All outdoor lighting shall be designed so as not to adversely impact surrounding uses,while also r

providing a sufficient level of illumination for access and security purposes. Such lighting shall
}
not blind, flash, oscillate or be of unusually high intensity of brightness.
2 Any outdoor lighting fixture newly installed or replaced shall be shielded so that it does not
produce a strong, direct light beyond the property boundaries, and shall be directed toward the
object or area to be illuminated.
25) Lighting of the site shall be adequate at ground level for the protection and safety of the public in
regard to pedestrian and vehicular circulation. The glare from the installation of outdoor lights
and illuminated signs shall be contained on the property and shall be shielded from abutting
properties.

2 Two copies of the signed,recorded decision and plans must be delivered to the Planning

and conditions of this decision and to ensure that the as-built plans will be submitted.
28) A detailed construction schedule shall be submitted to the Planning Staff for the purpose o
tracking the construction and informing the public of anticipated activities on the site.
2 The developer shall provide the Planning Board with copies of permits, plans and decisions
received from all forth Andover land use Boards, including one copy of a recorded Wetlands
Order of Conditions issued sunder the Mate wetlands Protection Act and North Andover Wetlands
Protection Bylaw shall be delivered to the Planning Department.
30 The developer shall submit to the Planning Staff approved Septic Plans from the Department of
Health.
31 In consultation with the Staff Planner,the Applicant shall designate an independent construction
monitor. The monitor shall read, sign, and return to the Planning Department the Letter o
Agreement for Independent Monitors. Upon the start of site work the monitor shall make weekly
inspections of the project(any suspension in monitoring due to inactivity on the site shall be pre-
approved by the Town Planner),providemonthly reports to the Planning Department, and detail
any areas of non-compliance and corrective actions. The monitor will also provide reports
`o lo�Ing heavy rain events. The monitor must also be available upon notice to inspect the site
accompanying a Planning Department designated official.
3 Prior to the commencement of any work,the Applicant shall submit to the Planning Department a
copy of the approved NPDES Storm 'water Pollution Prevention Plan SWPPP .
33 The developer shall provide documentation for the sprinkler system due to the change In use of
occupancy.
3 A pre-construction meeting must be held with the developer,their construction employees,
Planning Department,artment, Conservation Department and Building Department(arid other applicable

{ departments)to discuss scheduling of inspections to be conducted on the project and the

construction.schedule. All erosion control measures as shown on the plan must be in place and

reviewed by the Planning Staff during the meeting.

5 All applicable erosion control measures must be in place and reviewed and approved by the
Planning Department.
3 6)All catch basins shall be protected and maintained with filter fabric to prevent siltation into the
dram* line during construction.
DURING CONSTRUCTION
37) Dust mitigation must be performed weekly, or more frequently as directed by the Director of
Planning, throughout the construction const-ruction process.
3 8) )Any stockpiling of materials (dirt, wood, construction material, etc.)must he shown on a plan
and reviewed and approved by the Planning Staff.An approved piles must remain covered at all
tines and fenced off to minimize any dust problems that may occur with adjacent properties. It
shall he the responsibility of the developer to assure that no erosion f om the construction site
shall occur which will cause deposition of soil or sediment upon adjacent properties or public
ways, except as normally ancillary to off-site construction.
9) Off-s ite erosion wi11 be a oasis for the Planning Board making a finding that the project is not in
compliance with the plan; provided, however, that the Planning Board shall give the developer
written notice of any such finding and three days to cure said condition.
PRIOR.TO A CERT CATE of OCCUPANCY
40) A final as-built plan showing final building design site improvements, on- site sti`uctur s, curb
cuts and parking spaces must he submitted to the Planning I epar neat must be submitted to the
Planning Department. The as-built must he provided in paper form as well as in S F Standard
Digital File)foi-m t.
1 The Applicant must submit a letter from the project engineer stating that the building and Site
layout substantially comply with the plans referenced at the end of this decision as endorsed by
the Planning board.

2 The Planning Board must by a majority Grote male a finding that the Site is in conformance with
the approved plan.
GENERAL CONDITIONS
43) The Planning Staff shall review the site.Any screening as may be reasonably required by the
Planning Staff will he added at the ProjectOwner's expense.
44) Any plants,tree, shrubs, or fencing that have been incorporated into the Landscape Plan approved
in this decision that die or fall into disrepair must he replaced by the project owner in perpetuity.
45 The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation.
6 Gas, Telephone, Cable and Electric utilities shall be installed underground as specified by the
respective utility companies.
47) The hours for construction shall he limited to between : oa.m. and 5:00p.m.Monday through
Friday and between 8:00a.m. and 5:00p.m. on Saturday.
48)No open buy ing shall be done except as is pe uitted during burning season under the Fire
Department regulations.
9 The provisions of this conditional approval shall apply to and be binding upon the applicant, its
employees and all successors and assigns in interest or control.

5 Any action by a Town Board, Commission,, or I epmxt e t,which requires changes in the plan or
design of the building, as presented to the Planning Board,may be subject to modification by the
Planning Board.

51 Any revisions shall be submitted to the Planning Director for review. If these revisions are
deemed substantial,the developer must submit revised plans to the Planning Board for approval.
52 Pursuant to the North.Andover Zoning Bylaw Section 10.3 1.3this Special Permit approval shah

be deemed to have lapsed August 21, 2020(two gears from the date of issuance)exclusive f the
time required to pursue or await determination of any appeals,unless substantial use or
co .stTuction has commenced within said two-year period. Substantial use or construction will b
determined by a majority Grote of the Planning Board.
