Denial of Minor Modification Site Plan Review Request and Approval of Temporary
Modification

HISTORY& BACKGROUND
The applicant contacted staff in the North Andover Community&Economic Development
Division relative to permits for an interior expansion of the dialysis center at 201 Sutton Street.
Renovations for additional treatment stations commenced. however, upon further research, the
1997 Site Plan Review—Special Permit had a Special Condition that limited the site to no more
than 19 dialysis stations and further required that any expansion would involve an approved
modification before the Planning Board. The applicant requested to meet with the Planning
Board.
DECISION
After a meeting of the Forth Andover Planning Board on the above date the Board denied the
request for a minor modification. Upon a motion made by L. Rudnicki seconded by P. Boynton,
the Board voted unanimously to approve a temporary modification to the 1997 Site Plan Review
Special Permit- Special Condition#1 to allow for an increase of 3 dialysis stations for a period
not to exceed three months. This decision was based on the findings of fact below and upon the
conditions stated below.
FINDINGS OF FACT
• without an application and full review,the Board is not able to determine if the increase
in treatment stations has an impact on the overall site plan.
o The proposed temporary modification in number of alloyed treatment beds from 19 to 22
should be granted due to the life and death nature of the operations conducted at the
facility.
The modification could be granted for a temporary period so as to allow for the necessary
medical licensing as may or may not be required for the operations of the facility to
