The above petition for a Site Plan Review Special Permit Modification is according to the requirements of the
North Andover Zoning Bylaw, Sections 8.1, 8.3, 10-3.and 10.31 and MGL C.40A,See.9.
So as to amend the previously approved Site.Plan Review Special Permit Decision, dated March 4, 1997, to
modify"Special Condition 1", to allow for in increase from a maximum of 19 dialysis stations to no more
than 22 dialysis stations.The site is located within the Industrial S Zoning District[I-S).
After a public hearing given on the above date, and upon a motion by L. MeSherry and 2nd by P. Boynton,
the Planning Board Approves the Modification of the Site Plan Review Special Permit as amended and
based upon submission of a revised Site Plan that reflects the handicap parking spaces discussed at this
hearing and review with the Conservation Department if any land disturbance is required The vote was 4-0.

The Planning Board herein APPROVES the Modification to the Site Plan Review Special Permit Decision
dated March 4, 1997 to amend a condition limiting the maximum,dialysis stations of nineteen 19 so as to
allow a maximum number of dialysis to stations of twenty two (22). This Special Permit was requested b

Davita Dialysis c/o Josh Frahm. The application was filed with the Planning Board on October 1,2015. The
public hearing on the above referenced application was opened on November 17, 2015, and closed b the
North Andover PlanningBoard November y
o n N nnber 17, 20�.5. The applicant submitted a complete application,
which was noticed and reviewed in accordance with Section 8.3, 10.3, and 10.31 of the Town of North
Andover zoning Bylaw and MGM C.40A, Sec.9.
The Planning Board makes the following findings as required by the North Andover Zoning Bylaws
Sections 8.3 and 10.3:

FMINGS OF FACT:
1) The specific site is an appropriate location for the project as it is located on land that is zoned for
industrial use and no changes will be made to the .exterior of the building other than
improvements to landscaping, sigiaage, and striping of parking spaces.
2) The use as developed will not adversely affect the neighborhood as the level of use e will 'increase
only minimally. _
3) There will be no increase in nuisance or serious hazard to vehicles or pedestrians.
4) No new drainage is proposed on site as no additional impervious surface will be created.
5) Adequate and appropriate facilities will be provided for the proper operation of the r. p p p proposed use.
The project will be on Town water and sewer.
6) On March 4, 1997 the North Andover Planning Board voted to grant a Site Plan Review Special
Permit for the change in use of an existing 6,500 SF building from light assembly and office to a
dialysis treatment center located in the I-S zoning district at 201 Sutton Street.The Special Permit
contained a condition that limited the number of dialysis stations at the site to nineteen 19 and
required the applicant to request a Modification to the Special Permit if he wished to add stations.
"There shall be no more than 19 dialysis stations at this site at this time. If the applicant wishes
to create additional stab Pp .stations he must appear before the Planning Board to request a modification
to the decision".
7)- On February 24, 1997 a variance was granted by the Zoning Board of Appeals under Section 8
Paragraph 8.2 and 8.7 in the I-S Zoning District for the relief of the parking requirement from}
fifty(50)to thirty seven(37) spaces, driveway width of 25' to 16.5' and allowing for fifteen 15
7.5 x 16 according to the certified plans from Richard F.Kaminski&Associates, Inc.
8) A "Modeling— Sample Property" estimate submitted in 1997 projected a demand of 29 parking

spaces for this use. The applicant has submitted a current estimate of a daily parking requirement
of 25 maximum parking spaces. There are currently no complaints about parking on file and

there is availability of 37 parking spaces onsite.

9) The North Andover Fire Department and North Andover Police Department have reviewed the
Site Plan and all comments have been addressed (see Lt. McCarthy memo dated November 6,
2015 and Lt.Charles Gray email dated November 9,2015)
10) The applicant has met the requirements of the Town Site Plan Review as stated in the Zoning
Bylaw Section 8.3.
11) The Special Permit Granting Authority makes a specific finding that the use is in harmony with
the general purpose and intent of the Zoning Bylaw-,
12)Finally the Planning Board finds that this modification generally complies with the Town of
North Andover,honing Bylaw requirements as listed in Section 8.3.5, but requires conditions in
order to be fully in compliance. The Planning Board hereby grants an approval to the applicant
provided the following conditions are net.

13) The"Locus"refers to the 2.06 acre parcel of land fronting Sutton Street.
14) The"Plans"refer to the plans entitled"Davita Dialysis 201 Sutton Street North Andover,MA
.01845 Site&Landscape Plan"dated Oct. 15,2015 and revised to Nov.23,2015,consisting of
one sheet,prepared by Civil Design Group,LLC,21 High Street Suite 207,North Andover,MA
01845.
15) The "Project" refers to the number of dialysis stations allowed to increase from 19 stations to a
maxhnurn of 22 stations.to modify"Special Condition 1",to allow for an increase from a maximum
of 19 dialysis stations to no more than 22 dialysis stations.
16) The "Applicant!'refers to Davita Dialysis c/o Josh Frahm, the applicant for the Site Plan Review
Special Permit Modification.
17) The"Project Owner"refers to the.person or entity holding the fee interest to the title to the Locus
from t%me to time,which can include but is not limited to the applicant,developer, and owner.
SPECIAL CONDITIONS:
PRIOR TO SITE WORD
18) The Notice of Decision must be recorded at the Essex North Registry of Deeds.
19) Two (2) copies of the signed and recorded Notice of Decision must be delivered to the
Planning Department.
20) If any land disturbance is required for the proposed work reflected on the revised Site Plan the
plan must be reviewed with the Conservation Department.

21) The applicant must submit a letter from the architect and engineer of the project stating that the
building, lighting, landscaping, and site layout substantially comply with the plans referenced at the
end of this.decision as endorsed by the Planning Board.
22) The Planning Staff shall review the site. Any screening as may be reasonably-required by the
Planning Staff will be added at the Project Owner's expense.
23)A,final as-built plan showing final landscaping, structures, curb cuts, and parking spaces must be
submitted to the Planning Department.
24) The provisions of this decision shall apply to and be binding upon the applicant, its employees,
and all successors and assigns in interest or control.
25) Trash shall not be stored in any exterior portion of the property in the public eye.
26) Gas, telephone, cable, and electric utilities shall be installed underground as specified by the
respective utility companies.
27)No open burning shall be done except as is permitted during burning season under the Fire
Department Regulations.
28)No underground fuel storage shall be installed except as may be allowed by Town Regulations.
29)Any action by a Town Board, Commission, or Department,which requires changes in the plan or
design of the building, as presented to the Planning Board, may be subject to modification by the
Planning Board.
30) This Special Permit approval shall be deemed to have lapsed November 17,2017 (two years from
the date of issuance) exclusive of the time required to pursue or await determination of any
appeals, runless substantial use or construction has commenced within said two-year period.
Substantial use or construction will be determined by a majority vote of the Planning Board.
31) The applicant, is hereby notified that should the applicant disagree with this decision, the
applicant has the right under MGL Chapter 40A Section 17, to appeal this decision within twenty
days after the date this decision has been filed with the Town Clerk.
32) Any revisions shall be submitted to the Town Planner for review. If these revisions are deemed
substantial,the developer must submit revised plans to the Planning Board for approval.
33) The following information shall be deemed part of the decision:
