Thank you for copying us on the photos. I understand that it is difficult to control parking
problems at the facility, but that seems to be a task for the police department. I have read your
desire for parking nearer to the front door, but that won't fix the problem either. Coupled with
the requirement originally set by the fire department that there be a way to get between any
parked vehicles and the building in case of fire, and made more difficult due to the pond
limiting access on the rear side, makes that a tough call that is beyond our ability to resolve.
There is also a setback requirement and limited curb cuts that also exacerbate the situation. I
hope that we can discuss these things when we meet on the 29th. The approved plan, which I
copied you with, shows the intended striping, and a painted fire lane marking that may help
out. There is also an issue in that the town has the right to traverse the existing driveway as
part of an access road to the mills located behind the property (hence the curb cut limit). It has
been a while, so I have no knowledge as to whether the town ever intends to pursue the road.
The recent expansion of the facility capacity by 15%, which we didn't know about until well
after it was completed, surely adds to the parking problems. We were only advised of painting
and carpeting improvements (neither requiring a building permit) that were agreed to in order
to grant a lease extension. I am hopeful that we can agree on an arrangement when we meet.

Renal would need to make to bring about ADA compliance. I've attached three photos of the accessible
parking spaces at 201 Sutton Street. These were taken on the morning of 2/20/16.
The photo labeled AP1 shows a car parked in the access aisle. AP2 shows a car parked over the line into
the access aisle. (Really,AP2 just shows a negligible driver error). AP3 shows a car parked in the access
aisle of the accessible space on the opposite side of the lawn from the space shown in API.
There are a total of 4 accessible spaces in the lot. I believe that number meets or exceeds the standard,
but I'll reserve on that issue until we've confirmed the total number of spaces. In any case, it practically
goes without saying that a car parked in an access aisle can render an accessible space unusable by
someone with a mobility impairment. Keeping vehicles out of the access aisle would require a policy
change on the part of ISD Renal. There would have to be effective communication with patients and
visitors that parking in the access aisles is prohibited.
On the other hand,the fact that not one but probably two patients felt a need to park in an access aisle
today indicates that the minimum required number of accessible spaces might not be suitable for this
particular medical facility. Also,to my mind,there would be something unseemly about having to

doesn't appear tobea manageable parking environment,even with the new spaces added since the
Complaint was filed.
The plaintiffs offer these photos and comments in support of their position that the lawn should be
removed,the entire lot should be repaved, re-striped,and all accessible parking spaces should be �
situated next to the main entrance at the front of the building. There should also bea clearly marked pick �

up and drop off area for wheelchair vans and ambulances at the front of the building. There should beo

clearly marked and defined path that vans and ambulances would follow to and from the pick-up and
drop off area. �
