Referring t the above petition for Review of Watershed Special Permit,according to the requirements o the
North Andover Zoning Bylaw,Article 4 Part 5 and Article 10 Section 19 5-10.7 and MGL C.40A,Sec.9
So as to authorize Site improvements including demolition of the existing bituminous concrete boat launch,
retaining wall, and gravel parking area. The Project includes construction of a new hand carry boat launch,
block retaining wall, permeable paver parking area and driveways, two bioretention areas, and landscaping.
The proposed work is located within the Ikon-Disturbance of the watershed Protection District.The property
is located in the Residential 1 (R-1)Zone.
After a public hearing given on the above date,and upon a motion by P.Boynton and a 211dby S.Kevlahan,
to APPROVE, as amended, a watershed Special Permit with the following conditions imposed on the
Project by a vote of 5—0, unanimous in favor or the application.

Watershed Special Permit
The Public Hearing on the above referenced application was opened on August 27, 2024 and closed by the
Forth Andover Planning Board on October 15,2024.
n October 1 ,202 ,upon a motion made by P.Boynton and a second by S.Kevlahan to APPROVE,
s amended,a watershed Special Permit to authorize Site improvements including demolition o the existing
bituminous concrete boat launch,retaining wall,and gravel parking area. The Project includes const uction of
new hand carry boat launch, block retaining wall, permeable paver parking area and driveways, two
bloretention areas, and landscaping. The proposed work is located within the 1 on- istarbance of the
Watershed Protection District, The propel is located in the Residential I R-1 acne. This Special Permit
was requested by Jae Veillette,Environmental Partners Group,LLC 1900 Crown Colony Drive,Suite 402,
Quincy,MA 02169,on behalf ofOwner,Town ofForth Andover on July 31,2024. The Applicant submitted
complete application, which was noticed and reviewed in accordance with Article 4,Part 5 and Axticle 10,
Section 195-10.7 of the North Andover Zoning Bylaw and MGL Chapter 4 A., Section 9. The motion t
approve was subject to the FMINGS OF FACTS and SPECUL C NDMONS set forth in this
decision.
The Planning Board vote was - 0, unanimous in favor. A special permit issued by the special permit
granting authority requires a vote of at least four members of a five-member board.
The.Applicant is hereby notified that should the Applicant disagree with this decision,the A.pp ,cant has the
right, under MGL Chapter 40A, Section 17,to appeal to this decision within twenty days after the date this
decision has been filed with the Town Clerk.
The Plmming Board makes the finding that the intent of the Bylaw,as well as Its specific criteria are met. This
decision specifically stated by the Planning Board makes the following FMINGS OFFACT:
1 The Project is located within an extremely environmental sensitive area and in close proximity to Lake
Cochichewick, the 'own's sole drinking water supply; however, the final design includes the,
implementation of Best Management Practices that reflect extensive discussions between the Town,
the Town'Town's sto nwater peen- review consultant, and Applicant to ensure the coat ued protection of
Lake Cochichewick and the safety and welfare of the residents off'North Andover.
2 The Project has been reviewed by the Town's Storrowater Review consultant, Horsley Witten, and wiffi
the application of erosion control measures and modifications to the drainage and sto mw t r management
designs,the consultant concluded that there Will not be sign cant degradation to the quality or qumtity of
water in or entering Labe Cochichewick. The Site drainage system and storrnwater management design
are designed in accordance with the Town Bylaw requirements and Best Engineering and Management
Practices. (See correspondence from Horsley Witten dated August 26, 2024, September 20, 2024 and
October 1,2024)and Environmental Partners Group,LLC response conunents dated September 11,2024
and September 26,2024.
3 The entire Site is located within.the 15 0-foot Non-Disturbance Zone of Lake Cochichewick,with proposed
cork within Bordering 'e etated Wetlands BVQ),inland Banc,Land Under W terbodies and waterways
(LUWW), Bordering Land Subject to Flooding (BLS '), and the 2 -foot, 0-foot, and 100-foot Buffer
Zones to the BVW. The Project is also under the jurisdiction of the Conservation Commission.
4 The boat launch ramp is located within the 100-year floodplain, identified as Zone A. on the most recent
Flood Insurance Rate Map 'D?,K. The Applicant has noted the Top of Bank T 8 at approximate
elevation 113 and Observed High water(OHW)at approxxnate elevation 1.14. By modifying the grades

along the bank and reducing the slope of the new ramp,the proposed project increases the flood storage
-volume by 100 cubic Feet below elevation 114.
5 The proposed redevelopment included reducing the total impervious area from. 5,2.53 square feet to 783
square feet,which includes eliminating the 5,074 square feet of em'sting gravel parking areas considered
irnpereble and installing 9,991 square feet of permeable pavers with crushed stone.
6) Fertilizers are limited to hose which are either organic or slow-release nitrogen and phosphorous-free,
non-organic and pestici.desPnerbicides use are prohibited.
7 Per Plan Sheet G--1 General Dotes and Legend#l : The locking bollards shown on Sheet C-6 are
required to li rnit trailer access to the boat ramp for exclusive use by the Town. of North Andover Fire
Rescue. Lake Regulations promulgated by the Select Board prohibit any trailer launehing boat into the
lake by the general public. The North Andover Fire Department shah be responsible for keeping the
locking bollards locked.
9) The specific Site is an appropriate location for the proposed use and structure as the proposed use i
allowed and consistent with the current use. The Site design compliments the surrounding use and
provides for sufficient boat storage and circulation improvements. The Site supports a range f
recreational activities, including Gaon-motorized boating during the spring, su=er and fall seasons.
Additionally,the boat launch plays a critical role in emergency response,providing access for the North
Andover Fire Department's boat in the event of water-based emergencies.
9 The Site as redeveloped will not adversely affect the neighborhood.The Project provides stormwater
management and landscaping.
to There will be no nuisance or serious hazard to vehicles or pedestrians.
l l) Adequate and appropriate facilities will be provided for the proper operation of the proposed use.
12) There is no reasonable alternative location outside the Non-Disturbance,Non-Discharge Zones and the
General Zone for any discharge,structure or activity.
The Planning Board also makes a specific finding that the use is in harmony with the general purpose and
intent of the forth Andover.honing Bylaw.Upon reaching the above findings,the Planning Board approves
this Special Pennit based upon the following SPECUL CONDITIONS:

14 There appears to be 1.6 trees proposed to be removed and 15 native tees to be installed.Trees proposed to
be removed shall be staled in the field. The Conservation Administrator and Planning Director shall meet
with the contractor to discuss the necessity of removal and review the list of size and types of gees to be
installed(see Horsley'mitten peer review letter dated October 1.,2024#8 Standard .d).

elevation 115.0 and 115.5 with approximately 4.5 feet of planting soil and crushed stone below. To
elevation 110.5 and 111..0. The contractor shall conduct additional soil testing to document that the
SGW is lower than.elevation 110.5 or raise the bottom of the systems.Receipt of the soil logs shall be
submitted to the Planning Director(see Horsley Witten peer review letter dated Sept.20,2024#2 Standard

2 The Applicant shall provide a copy of a Section 401 water Quality Certification(WQC), Chapter 9 1.,
Army Corps of Engineers, and MBPA.approvals to the Planning Department(see Horsley Witten peer
review letter dated Sept.20,2024#6 Standard .a).
2 The Town Engineer or his designee shall act as an environmental monitor.Upon the start of site work
the monitor shall make weekly inspections of the Project (any suspension in monitoring due to
inactivity on the Site shall be pre-approved by the Town Planner), provide monthly reports to the
Planning Department,and detail any areas of on--compliance'and corrective actions.The monitor will
also provide reports following heavy rain events. The monitar must also be available upon notice, t
inspect the Site accompanying a Planning Department designated official.
25 A. detailed construction schedule shall be submitted to the planning Staff for the purpose of tracking
the construction and informing the publio of anticipated activities on the Site.

28) A pre-construction meeting must be held with the developer, their construction employees, Planning
Department and other applicable departments,to discuss 'Scheduling of inspections to be conducted on
the Project and the construction schedule.
DEG CONSTRUCTION
29 Any stockpiling of materials(dirt,wood,pager material,etc.)must be shown on a Plan and reviewed and
approved by the Planning Staff. Any approved piles must remain covered at all times and fenced off t
minimize any dust problems that may occur with adjacent properties.It shall be the responsibility of the
developer to assure that no erosion from the construction Site shall occur which will cause deposition of
soil or sediment upon adjacent properties or public ways, except as normally ancillary to off-site
n tructi n.
30) It shall.be the respor sibility of the Project Owner to assure that no erosion from the construction site shall

Planning Board making a fording that the Project is not in compliance with the plan;provided,however,
that the Planning Board shall give the developer Witten notice of any such finding and three days to
cure said condition.
l In an effort to reduce noise levels,the developer shall keep in optimum working order, through regular
maintenance,any and all equipment that shall emanate sounds from the structures or Site.
PRIOR To CERTIFICATE of OCCUPANCY
2 The Applicant must submit a lever from engineer of the Project stating that the landscaping and Site
layout substantially comply with the Plans referenced at the end of this decision as endorsed by the
Planning Board.The Applicant must also submit a lever from a professional engineer certi*ring that
there are no illicit connections to the stornn drainage system,
33) The Applicant shall submit an as-built plan stamped by a Registered Professional Engineer in
Massachusetts that shows all construction., including stop water mitigation trenches and other pertinent
Site features. This as-built playa shall be submitted to the Town Planner for approval,The Applicant must

34 Any plants, tree, shrubs, or fencing that have been incorporated into the Landscape Plan approved in
this decision that die or fall into disrepair must be replaced by the Project Owner in perpetuity.
3 5 `The contractor shall contact Dig Safe at least 72 hours prior to con nencing any excavation..
3 6 All Gas, Telephone, Cable and Electric utilities to serge this Project shall be installed underground as
specified by the respective utility companies, except for so called "green utility boxes"" a -may be
required by the utility companies.
3 7 The hours for construction shall be limited to between 7:00 a.m. and 5:00 p.m.Noonday through Friday
and between 8:00 a.m. and 5:00 p.m. on Saturday.
8 No open burning shall be done except as is permitted during burning season under'the Fire Department
regulations.
39 The Owner shall,apply to the Board of Health for the appropriate dump ster permit, if needed.
4 The provisions of this conditioria.l approval shall apply to and be binding upon the Applicant, its
employees and all successors and assigns in interest or control.
1 Any action by a Town Board,Commission,or Department,which remixes changes in the Flan or design
of the buildn.g, as presented to the Planning Board, may be subject to modification by the Planning
Board.
42 This Special Permit approval shall be deemed to have lapsed after-October 1 ,2026 (two years rom
the date pennit granted),exclusive of the time required to pursue or await determination of any appeals,
unless substantial use or construction has commenced within said two-year period or for good cause.
For purposes of this development,the developer shall be deemed to have undertaken substantial use or

Cold Climate Considerations
Never store snow in bioretentien areas.The Operation and Maintenance plan must specify where
on-site snow will be stored.All snow dumps must comply with MassDEP's guidance,when
bioretentl n areas are located along roads,care must be taken during plowing operations t
prevent snow from being plowed into the bioretention areas. If snow is plowed into the cells, runoff
may bypass the cell and drain into d wngra ie t wetlands without first receiving the required water
quality treatment, and without recharging the groundwater.

Operation
Installation:
• Excavation: Excavate and compact the soil sub-grade.
• Base Preparation; Place and compact a gravel base, extending beyond the Turfst nes by at
least 6 Inches for residential use and 8 inches for vehicle loads.
• Bedding Sand:Spread and screed bedding sand to proper elevations. Ensure uniform
moisture content before placing the pavers.
Placement: Lay the Tu rfstones with a mi ni m u m joint spacing of 1/16 inch.

Bioretention Areas
Premature failure of bioretention areas is a significant issue caused by lack of regular maintenance.
Ensuring long-terra ,maintenance involves sustained public education and deed restrictions-or
covenants for privately owned cells. Bioretention areas require careful attention while plants are
