The Project includes const uction of new hand carry boat launch, block retaining wall, permeable paver parking area and driveways, two bloretention areas, and landscaping. The proposed work is located within the 1 on- istarbance of the Watershed Protection District, The propel is located in the Residential I R-1 acne. This Special Permit was requested by Jae Veillette,Environmental Partners Group,LLC 1900 Crown Colony Drive,Suite 402, Quincy,MA 02169,on behalf ofOwner,Town ofForth Andover on July 31,2024. The Applicant submitted complete application, which was noticed and reviewed in accordance with Article 4,Part 5 and Axticle 10, Section 195-10.7 of the North Andover Zoning Bylaw and MGL Chapter 4 A., Section 9. The motion t approve was subject to the FMINGS OF FACTS and SPECUL C NDMONS set forth in this decision. The Planning Board vote was - 0, unanimous in favor. A special permit issued by the special permit granting authority requires a vote of at least four members of a five-member board. The.Applicant is hereby notified that should the Applicant disagree with this decision,the A.pp ,cant has the right, under MGL Chapter 40A, Section 17,to appeal to this decision within twenty days after the date this decision has been filed with the Town Clerk. The Plmming Board makes the finding that the intent of the Bylaw,as well as Its specific criteria are met. This decision specifically stated by the Planning Board makes the following FMINGS OFFACT: 1 The Project is located within an extremely environmental sensitive area and in close proximity to Lake Cochichewick, the 'own's sole drinking water supply; however, the final design includes the, implementation of Best Management Practices that reflect extensive discussions between the Town, the Town'Town's sto nwater peen- review consultant, and Applicant to ensure the coat ued protection of Lake Cochichewick and the safety and welfare of the residents off'North Andover. 2 The Project has been reviewed by the Town's Storrowater Review consultant, Horsley Witten, and wiffi the application of erosion control measures and modifications to the drainage and sto mw t r management designs,the consultant concluded that there Will not be sign cant degradation to the quality or qumtity of water in or entering Labe Cochichewick. The Site drainage system and storrnwater management design are designed in accordance with the Town Bylaw requirements and Best Engineering and Management Practices. (See correspondence from Horsley Witten dated August 26, 2024, September 20, 2024 and October 1,2024)and Environmental Partners Group,LLC response conunents dated September 11,2024 and September 26,2024. 3 The entire Site is located within.the 15 0-foot Non-Disturbance Zone of Lake Cochichewick,with proposed cork within Bordering 'e etated Wetlands BVQ),inland Banc,Land Under W terbodies and waterways (LUWW), Bordering Land Subject to Flooding (BLS '), and the 2 -foot, 0-foot, and 100-foot Buffer Zones to the BVW. The Project is also under the jurisdiction of the Conservation Commission. 4 The boat launch ramp is located within the 100-year floodplain, identified as Zone A. on the most recent Flood Insurance Rate Map 'D?,K. The Applicant has noted the Top of Bank T 8 at approximate elevation 113 and Observed High water(OHW)at approxxnate elevation 1.14. By modifying the grades Bk 18232 Pg36 ## 5 Environmental Partners Croup On behalf of the Town of North Andover) Great Pond Road(across from 1939 Great fond Road) Map 3 5,Lot 21 Watershed Special Permit along the bank and reducing the slope of the new ramp,the proposed project increases the flood storage -volume by 100 cubic Feet below elevation 114. 5 The proposed redevelopment included reducing the total impervious area from. 5,2.53 square feet to 783 square feet,which includes eliminating the 5,074 square feet of em'sting gravel parking areas considered irnpereble and installing 9,991 square feet of permeable pavers with crushed stone. 6) Fertilizers are limited to hose which are either organic or slow-release nitrogen and phosphorous-free, non-organic and pestici.desPnerbicides use are prohibited. 7 Per Plan Sheet G--1 General Dotes and Legend#l : The locking bollards shown on Sheet C-6 are required to li rnit trailer access to the boat ramp for exclusive use by the Town. of North Andover Fire Rescue. Lake Regulations promulgated by the Select Board prohibit any trailer launehing boat into the lake by the general public. The North Andover Fire Department shah be responsible for keeping the locking bollards locked. 9) The specific Site is an appropriate location for the proposed use and structure as the proposed use i allowed and consistent with the current use. The Site design compliments the surrounding use and provides for sufficient boat storage and circulation improvements. The Site supports a range f recreational activities, including Gaon-motorized boating during the spring, su=er and fall seasons. Additionally,the boat launch plays a critical role in emergency response,providing access for the North Andover Fire Department's boat in the event of water-based emergencies. 9 The Site as redeveloped will not adversely affect the neighborhood.The Project provides stormwater management and landscaping. to There will be no nuisance or serious hazard to vehicles or pedestrians. l l) Adequate and appropriate facilities will be provided for the proper operation of the proposed use. 12) There is no reasonable alternative location outside the Non-Disturbance,Non-Discharge Zones and the General Zone for any discharge,structure or activity. Environmental partners group n behalf of the Town of North A,dower Great Pond Road(across from 1939 great Pond Road) Map 35,Lot 21 Watershed Special Permit 2 The Applicant shall provide a copy of a Section 401 water Quality Certification(WQC), Chapter 9 1., Army Corps of Engineers, and MBPA.approvals to the Planning Department(see Horsley Witten peer review letter dated Sept.20,2024#6 Standard .a). 2 The Town Engineer or his designee shall act as an environmental monitor.Upon the start of site work the monitor shall make weekly inspections of the Project (any suspension in monitoring due to inactivity on the Site shall be pre-approved by the Town Planner), provide monthly reports to the Planning Department,and detail any areas of on--compliance'and corrective actions.The monitor will also provide reports following heavy rain events. DEG CONSTRUCTION 29 Any stockpiling of materials(dirt,wood,pager material,etc.)must be shown on a Plan and reviewed and approved by the Planning Staff.
