The Planning Board herein APPRDvIE S the Sign Master Plan Special Pert,as further described below
(this"Decision"').
As described in the Application,the"Project"as previously approved by the Board includes the
construction of a proposed e-commerce storage,warehouse and distribution faci city with accessory office
and other uses, consisting of a 5-story building including approximately 3,835,500 s ware feet of oss
floor area,having a building footprint of approxinnately 817,212 square feet, aloe with accessory
structures,with upgrades to parking, access including a common driveway,utilities,stormwater
management, lighting, landscaping and other associated improvements to be located on the approximate
110.12-acre Prope rty. The S ign Proj ect,on the`Property"or"Lot B",unless otherwise described herein
shall include off-premises signage to he located on the adjoining parcel at 1600 Osgood Street also
known as Lot A, as depicted on the'`Plans."The Project,including the Sign ProJ'ec� is located within the
1-2 Zoning District.
Other than the proposed signage program as described in this Application and support'

materials,including signage schedules, illustrations, and plans depicted on the materials and related laps
attached to the Application(the"Si a e Improvements"), pPP � g and as further described below,no changes are
being proposed to the Protect previously approved by the Board.
The relief described in the Application requested by H P Transaction Services,LLC,the Applicant
with respect to the Site was filed with the Planningpp Board on February X 0,�0�2. The wrier of�e Site is
O sgood Rt-12 5 Proj ect,LLGa an affiliate of the Applicant. The public hearing on the ab ove referenced
Application was opened on March 15,2022,and closed by the North Andover Planning Board on March 15
2022. e Applicant submitted the Application and other supplemental documents of record in conformance
with the requirements of the Forth Andover Zoning Bylaw,which were noticed and reviewed in accordance
with Article 6, § 195-6.6.O.(4)and,Article 10,§ 195-10.7A[Special Permit-General],of Chapter 195--
North Andover Zoning Bylaw)and MGL c.40A,Sec 9•
The Planning Board voted unanimously(by a vote of 5-0) to approve the Si Master Man Special

The Applicant is hereby notified that should the.applicant disagree with this Decision,the Applicant has the
right,under MGL Chapter 40A, Section 17,to appeal to this Decision within twee 'days s after the date this

has been filed with the Town Clerk.
FINDINGS OF FACT
1. The specific site is an appropriate location for such a use, structure or condition since the
Property is zoned for industrial use, the signage is specifically tailored to the site,and therefore,
the Property is an appropriate location for the proposed signage master plan for the Project. The
signage design provides for a core si stent design and theme for the facilities,and
uses
properly
si gnage in a maser providing appropriate and aesthetically pleasing messaging,while at the
same time rovidin for
P g s a fe and effective d irectlon for drivers and pedestrians enterang and
exiting the Property and surrounding property.
2. The Project signage use will not adversely affect the neighborhood but will in fact enhance the
circulation and safety of the area by properly directly and circulating vehicles and pedestrians
within the surrounding neighborhood with the use of directional and wayfindinrg signs,along with
appropriate traf c signage to direct traffic in an orderly manner. Accordingly,the proposed
signage for the proposed industrial uses are well su ited for the proposed location.

3. There will be no nuisance or serious hazard to vehicles or pedestrians as driveways acces s m" g

et and the Property will be located and designed with appropriate signage in
accordance with the plans previously approved by the Board in prior decisions, and signs are
located at the existing driveway curb cut locations. The parking and loading signage has been
designed and located to rnm* imize conflicts and to maximize efficiency leading to the safe and
efficient ingress to and egress from Osgood Street and the abutting 1600 Osgood Street ro e
p p
for automobile,truck and pede st6an traffic. Site signage improvements have been designed to
maximize on-site and off-site safety.
4. Adequate and appropriate facilities will be provided for the proper operation of the use
proposed
as the Project is adequately and appropriately serviced by signage, in addition to other municipal
water, sewer and other utilities that adequately address the needs of the Project.
5. As required under§ 195-6.6.G.(4),the Property and Sign Project are located within the Industrial
2 (1-2)Zoning District,and the work ongoing at Lot A.and Lot B is a"redevelopment project"as
it encompasses one or more parcels of land which collectively consist of at least 10 o acres, and
involves new construction and/or renovations,
6. Although the proposed signage deviates from the specific sign requirements of Chapter 195,
§ 195-6.6,the Board finds that the signage contained within the Application,including the
proposed sizes, locations,and general design approach for signs as described in the materials

included n the Application,and as presented to the Board,is consistent with the general se
p
and intent of the sign bylaw criteria described under§ 1 95-6.2 since the signage protects and
enhances the visual environment of`the Town for purposes of safety,convenience,information
and the welfare of its residents,and are appropriate to the land buildings or uses to which they
are appurtenants and are adequate for their intended purpose while balancing the individual and
community interests identified under§ 195-6.2. The Board finds that the signage contained
within the A.ppl i cation is consistent with the special permit criteria described under§ 195-10.7
(special permits),as noted in this Decision.
7. The proposed use is in harmony with the general purpose and intent of this Zoning Bylaw for the

following reasons. First,the location of the proposed Project,Mcluding the Sign Pro' is
ideally suited to add additional industrial uses within the I-2 Zoning District to complement and
build a critical mass which is important to the future redevelopment of the Route 125 corridor in
this area of North Andover. Second,the siting of a facility in the proposed location will have the
effect of converting a functionally obsolete Site into an important and significant revenue-
generating property for the Town,and the Sign Project will complement the proposes uses on the
Property. Third,the proposed signage is consistent with the general purpose and intent of the
sign bylaw criteria described under§ 195-6.2 since the signage protects and enhances the visual
environment of the Town for purposes of safety, convenience,information,and the welfare of its
residents,and are appropriate to the land, buildings or uses to which they are appurtenant,and are
adequate for their intended purpose while balancing the individual and community interests
identified under§ 19 5-6.2, Lastly,the Project,as shown on the Site Plans,complies with the
Zoning Bylaw. For these reasons,all of the proposed improvements and enhancements noted
herein are in harmony with the general purposes and intent of Article 1 ("Purposes')of the Noith
Andover Zone"ag Bylaw as the proposed signage will also provide for and facilitate safe and
effective vehicular and pedestrian travel within and out of the Property aided by strategically
planed and visible signage,rn.arkings and other wayfindi_ng signs designed to facilitate internal
and external circulation. For these reasons,all of the proposed improvements and enhancements
noted herein are in harmony with the general purposes and intent of Article 1 ("Puiposes")of the
North Andover Zoning Bylaw.
8. The application was reviewed by Town staff as evidenced by emald communication from Amy
Maxner,Conservation Administrator,dated February 28,2022,email communication from Tim

2022.
Accordingly,the Planning Board finds that the Sign Project generally complies with the Town of Noah
Andover Zoning Bylaw requirements, including: Article 6, § 19 5-6.6,G.(4),and Arti cle 101 § 195-10 3A
[Special Permit-General],of Chapter 195--North Andover Zoning Bylaw), and MGL c.40A Sec, 9
but rewires conditions in order to be folly in compliance. The Planning Board hereby�ants an approval
to the Applicant of the requested Sign Master Plan Special Permit above,provided the following
Conditions are met.
PERMIT DEFINITIONS
The following Permit Definitions are as follows:

plans attached as Exhibit A to this Decision.
11. The"Sign Prol ect75 gofers to the signage proposed on and adjacent to the Property.The Sign Project

13. The`'Owner"refers to the person or entity holding the fee ifnterest to the title to the Property from
time to time,which can include but is not limited to the Applicant, an developer,and future owner.

SPECIAL CONDITIONS
14. All special permits granted under the"Notice of Decision--Site Plan Review,Parking, Common
Driveway,Building Height,and Floor Area Ratio Special Permits,,'dated May 20,2020,and
recorded with the Essex North Regime of Deeds in Book 16635,Page 193 (the"original Lot B
Decision"'), as modified by the"Modification to Site Plan Review,Parking,and Common
Driveway Special Permits,as well as the Modification to Site Plan Review,Parking, Common
Driveway,Building Height, and Floor Area Ratio Special Permits,"dated October 65 2020,and
recorded with the Essex Forth Registry of Deeds in Book 1663 5,Page 221 (the"Lot B
Modification Decision")(collectively,the"Loft B Decision")and special conditions in the Lot B
Decision shall also be considered as part of,and as adjusted by,this Decision and the Plans
incorporated-hereto
15. The signage as depicted on the Plans shall be installed substantially in conformance with the
Plans.
16. An"Amazon Trucks Left Only''sign shall be installed at both the northem and southern
access/egress drives. The final placement of the two(2) said signs shall be approved by the
Planning Director.

1.7. The internal illumination lighting specifications for the four(4):fireestanding signs along Osgood
Street shall meet the specifications detailed in Exhibit B,which is attached to this Decision.
18. After the initial sign installation as provided above,signs may be installed,removed,and replaced
with the approval of the Building Inspector,provided that such signage substantially conforms to
the Plans.
PRIOR TO ISSUANCE of SITE WORK)BUJULDING PERT,OR CONSTRUCTION
19. Two(2)copies of the signed,recorded decision with approved Plans attached must be delivered
to the Planning Department.
20. A pre--construction meeting must be held with the Applicant, developer,and Planning
Department. The purpose of this meeting will be for the Applicant to submit a sign schedule to
review the initial installation of new signage and timing for such initial installation.
21. Evidence of the application for, and issuance of,sign permits by the Building Commissioner shall
be provided.
DURING CONSTRUCTION
22. Any stockpiling of materials(dirt,wood,construction material, sign debris,etc.)must be
reviewed and approved as a part of the sign schedule described above by the Planning Staff.Any
approved piles must remain covered at all tunes and fenced off to minimize any dust problems
that may occur with adjacent properties.
AFTER INfrLAL SIGN INSTALLATION
23. The Applicant must submit a letter from the architect,engineer, or sign company for the Sign
Project stating that the installation of signs substantially comply with the Plans and are
functioning as designed.
24. All signage shall conform to the signage regulations contained within the North Andover Zoning
Bylaw,Article 6, except as modified by this recision.
25. The project engineer shall certify that sight lines at all Rt. 125 access/egress locations are in
compliance with engineering standards.
GENERAL CONDITIONS
26. The contractor shall contact Dig Safe at least 72 hours prior to commencing any excavation.
27. The hours for construction shall be limited to between 7:00 a.m. and 5:00 p.m.Monday through
Friday and between 8:00 a.m. and 5:00 p.m. on Saturday.
28. No open burning shall be done except as is permitted during burning season under the Fire
Department regulations.
29. The owner shall apply to the Board of Health for the appropriate duxnpster permit,if necessary,to
temporarily dispose of any signage debris.
30. The provisions of this approval shall apply to and be binding upon the Applicant,its employees
and all successors and assigns in interest or control.
31. Any action by a Town Board,Commission, or Department,which requires changes in the Plans,
as presented to the Planning Board,may be subject to modification by the Planning Board.

3 2. Pursuant to the North Andover Zoning Bylaw Article 10 Administration S ection 19 5-10.7 this
Sign Master Plan Special Permit Decision shall be deemed to have lapsed after April 26,2024
(two years from the date the permit is granted),exclusive of the time required to pursue or await
determm* ati on of any appeals,unless substantial use or construction has commenced within said
two-year period or for goad cause as determined by the Planning Board.
33. Pursuant to the North Andover Zoning Bylaw Article 10 Adminxstration Section 19 5-10.? th i s
