Them Speck P enmits were requested by Hffiwood Enterprises,LP,the Applicant. The applicafions
were tiled with the Planning.Board on.August 9,2019,except with regard to the application for Common
Driveway Speed permit which was filed on May 1,2020. The public on the above referenced
appneaticons were opened on September 3,2019,and closed by the North Andover Planning Board on May
2020,except that the public hearing for the Common Driveway Special Pwnit was opened May 2%
2020. The Applicant submitted a.complete.set+ofapplications cmfamdug to the requirements of the North
Andover Zoning Bylaw,which was notice and reviewed in accordance with(Article g,Part 3 [Site Plan

2. The Plans have been submitted M' accordance with the regulations and procedures as outlined in
Article 8,.Pant 3,and comply with§ 195- .15(review criteria and design guidelines),and § 19 -
103A(conditions for approval of Special Permit),as finther described below.
3. Site Plan Revever ern tier S l'" `t Farr . The specific Site is an appropnate locator
for such a use,structure or condition. Since the Site is zoned for industrial use under the 1-2 Zoning
District,I�ot B is an appropriate location for the proposed Project. The Site desIP
* compliments the
surrounding uses and provides for sufficient traffic,curb out and eircubWon hnprovements,as well
as sufficient grater,suer,and other utilities. The proposed height and floor area ratio for the
proposed building are appropriate for Lot D,as the highest p rt of the buildmg is located.932.3 feet
from Osgood Street,the ground flog elevation(measured from the midpoint of the building)drops
approximately 14 few from the Osgood Street elevation.,and most of the proposed building will be
located west of`(and behind the existing)Building Nos.20 and 21 located on Lot A,all of which
comrbine to enable the building to blend into the surrounding neighborhood. Parking Will also be
adequate to serge the proposed uses.
4. The Project use as developed will not adversely affect the neighborhood character for the following
reasons. The building entirely encloses the proposed use,and the building is complemented with
appropriate landscaping and screenm' g. The proposed building'is set far back from Osgood Street
and adjacent properties. The character of the architectural style ofthe proposed now building will
complement the architectural style of the buildmng;s to remain at 1600 Osgood Street. The Site is
zoned industrial and the proposed use as developed will result in a substantial improvement to Lot
from an aesthetics and environmental.perspective. 'Me proposed build' height and mass" 9

neighborhood. Accordingly,the proposed uses are well suited for its proposed location.
5. There will be no nuisance or serious hazard to vehicles or pedestrians. Driveways accessing
Osgood Street(including the south eftmee to the:dot,as well as the north en twice to the Lot
which will include access from Osgood Street over a private,perpetual access easement as a
common driveway over the North Access Road area on Lot A to be granted by the owner of Lot A
for the benefit of Lot B)Will be located substantially in the same location as currently existing,and
are located to provide for the best available sight distance along Osgood Strwt. The parking and

and pedestrian traffic. Traffic WVrovements have been designed to maximize on-Site and off-Site

6. Adequate and appropfiate facilities Vn*11 be provided for the proper operation of the proposed use.
The Project is adequately and appropriately serviced by water,sewer and other utilities that
adequately address the needs ofthe Project. Now stonnwater management facilities Will be
constmded to provide adequate treatment of stormwater in accordance with applicable
requirements.
7. In addition to the reasons described herein and as shown on the Site Plans and other information
submitted as part of the Site Plan Review and Special Permits process,the use is in harmony with

the general purpose and intent of this Zoning Bylaw for the following reasons. r ust,the location of
the proposed Project is ideally suited to add additional industrial uses withi the 1-2 Zoning District
to complement and build a critical mass which is important to the future redevelopment of the
Route 125 corridor M" this area of North Andover. Second,the siting of a facility M the proposed
location will have the effect of converdag a fimcdonally obsolete Site into an finportant and
significant revenue-generating property for the Town. Third,the off-street parking provided is
adequate to serve the uses of Lot B W* a safe and effective miner. Fourth,the Project,as proposed,
is Projected to potentially provide 1,500 new full-time jobs to Lot B,in addition-to between 200 and
250 temporary construction jobs during the peak constmetion phase when all of major construction
trades—sitework,concrete,steel,,roofin&mechanical,electrical,plumbing and fire protection-are
on the Site at the same time,along with the multiplier effect arismug from the m* creased number of
workers supporting other North Andover businesses,and potentially resulting in now busiesses
opening along the Route 125 com'dor. Lastly,the Project,as shown on the Plans,complies with the
Zoning By-Law,subject to the grant of the Special Permit relief requested.
8. The "Traffic Impact and Access Study for Proposed Redevelopment, 1600 Osgood orth
Andover,Massachusetts,"'dated August 2019,as supplemented by a"Traffle Impact and Access
Study for Proposed Redevelopment, 1600 Osgopd Stree�,North Andover,Masswhusetts,"dated
March 2020,both of which were prepared for MIlwood Enterprises,L.P.by Laapn En&eermg&
Environmental Services,as supplemented(collectively,the"Traffic Report")states:
a.the location and number of curb cuts proposed is the same as the em*sting curb cuts,and has
been reviewed and is appropriate for the proposed use.The driveways have been designed to
provide sight lines that exceed m'u=ium requirements for intersection sight distances.
Moreover,the proposed landscaping and Signs i the vicinity of the Site driveway Will have
been located mfficiently back from Osgood Street so as not to impede thew sight distances,and
turns into the Site driveways VA-11 operate at appropriate levels-of-service(LOS)during the
peak-hours,and exiting movements from Lot B driveways will operate at an appropriate LOS

during the peak-hours.MassDOT has sole jurisdiction over any curb cuts and other

improvements on Osgood Street which is a state highway,,so MassDOT will impose
requirements it deems necessaxy to ensure safe and efficient circulation along Route 125 as a
part of the MassD T permitting process;
b. truck traffic to and from the fulfillment center Lot will enter from/egress from/egress to the north along
Osgood Street as there is a.full interchange approximately two Mlles north that connects the
Site to 1-495 via the Industrial Avenue(Route 1 5)connector;
c. the proposed on-Site parking layout and Site access locations on Osgood Street will not cause
detriment to the surrounding neighborhood through increased traffie volumes,Will not result
increased vehicular congestion or gaeUM&should maintain or improve on-Site and off-Site
c crrcu�lation patterns and anmunne conflicts between motor vehicles and pedestrians;
d. the Pro,ect is expected to generate 1,868 new vehicle trips can an average weekday 934
entering and 934 exiting),with rQX ately 34 new vehicle trips 37 less entering and 71
esinexpected during the weekday morning roadway p hour,5 new vehicle trips(64
entering and 59 less exiting)during the weekday evening roadway peak hour, and 959 new
vehicle trips(500 entering and 459 a ititW during the weekday mormng generator peak-hour
and 1,027 new vehicle trips( 16 entering and 511 exiting)ding the weekday ev"�►ing
generator hour;
e. a tom of two curb-cuts with a fiffl access,driveway will be reconstructed in locations
substantially identical to the existing southernmost wxess road,,or South Access Drive(across
Osgood Street from the existing ps sMfion),as well as the northermnost access drive,or North
Access Drive,which will connect with an upgraded private perpetual roadway access easement
over Lot A,to be granted by the owner of Lot A.for the benefit of Lot B;
f. the development requires the upgrade of the signal equipment at both intersections,to be
approved by the Mass DOT;
g. M order to improve overall operations at bath the South Access Drive and North Access Drive,
the signal timings would be optimized;and,
br. all proposed traffic improvements in Osgood Street are pending MassDOT approval.
9. According to the Traffic Impact and Access Study prepared by Langan En,gini g
Environmental Service Inc.:
a. The traffic impact studyidentifies potential impacts of`the proposed Project.
b. There are approxhnately 5,170 parkingspaces servi+cmg the existing uses,which excludes the
existing halt area occupied by the on-site solar facilities.
c. Access to the Site is provided by two un-s" alized full-movement driveways and two Agnalized
full-movement driveways on Osgood Sbvd. The northernmost si driveway currently
operates m flash mode and functions as an,un-signalizeddriveway.
d. The Project proposes to modify the ar ess driveways as follows Site Plan►.in Appendix A.
i. The northern Lost so driveway,which will sbare both Uffllment center employee and
truck access and egress and also for the relocated soar array,will be updated to now traffic
sigrial operation.
ii. The southernmost s driveway will be exclusively dedicated to bal illm+ent oenter
employee ac=ss and egress.
iii, The two ccuter un- lP"ZOd chiveways will be dedicated exclusively to Buildings 20 and 21
operations on proposed Lot A.
e. To maintain acceptable or no-build and levels of',sem'ce the following of-site

type of vehicle customarily expected for the use while such vehicle is parked completely clear of
any public way or sidewalk.
12. The Board further finds that the modification of loading facility design standards under
195-8.8.D.2 is appropriate and is consistent with the pwposes set forthim thi's Part I-,and has found
that such relief does not cause detriment to the s=ounding neighborhood since the modification of
design standards Vn*lI not result in increasers traffic congestion or queuing of vehicles,or any change

m traffic patterns and access to the Site,or result in any unsafe conflict of motor vehicle and

13. The Board also finds that since the Applicant's proposed modification of loading design standards
meets the prerequisites for consideration of a Parma Special Permit,and since the P *ect meets

be no higher than 105 feet;as depicted on the Plans. Based upon elevation plans provided by the
Applican. the proposed building height is,appropriate for the area since: a the Site is located
Within the 1-2 Zoning District and is generally surrounded by industdal and commercial uses;
the building'is set back approximately 932.3 feet from Osgood Street; c the'building'is partially
obscured from Osgood Street due to the building's location west of,and behind,Bididings 20 and
21 on Lot A,such that only the northerly and soutimly►ends of the building will be visible from
Osgood Sbmvt as one drives on Osgood' meta and the approximate 14-foot drop in elevation of the
land between Osgood Street and the mid-location and the building, all factors,which the
Planning Board have deemed appropriate for the proposed building height.

19. 1 he Beard also finds that since the Applicant's proposed building meets the prerequisites for
consideration of a Floor Area Ratio Special Permit,and since the Pro Aect meets the Special Permit
criteria under§ 195-1.03A ofthe Zoning Bylaw as described herein,the gmnt of Floor Area Ratio
Special Permit is appropriate under the circumstances.

can tie into,subject to a sewer use agmment approval granted by the GLSD(the"'GLSD

26. The Board also undentands that the Applicant desires to tie into a new public sewer line proposed
to be constructed in Osgood Street which would extend from the frontage of 1600 Osgood Street
southerly to Sutton Street beyond the intersection of Osgood Street and Sutton Street(the"New
Sewee). The New Sewer proposal has been awarded a Mass oar, Grant with additional funding
committed by both the Town and the Applicant. Lot B Building is profecW to be constructed and
operational by Q3,2022,as may be adi*usted based upon potent 1.construction delays and other

27. The Board further understaids that ff the New Sewer is fully operational by the Bul"Idm' g
Operations Sty Date,and that ift the Applicant secures all applicable permits to tie into the New
Sewer by the Building B Operations Start Date,then the Applicant intends to tie into the New
Sewer and discontinue its use of the Existing Sewer. Otherwise,the Board finds it acceptable for
the Applicant to tie into the EXisting Sewer if the New Sewer is not fully operational by the
Building OpeTations Start Date. Once the New Sewer is operational and the Building Operations
Start Date has occuind,however,we understand the Applicant shall tie into the New Sewer*
accordance with the tems and conditions of GLSD Agreement and other applicable approvals.
29. The Town E ngineer has reviewed the Pro ect,and has also reviewed the comments identified by
TEC,the Town of North Andover's taffie peer review consultant,in their comment letter dated
April 1,2020,regarding the Traffic Study prepared by Langan,for the Ammn Fulfillment Center,
to be located at 1600 Osgood Street,and by letom,dated April 13,2020,has recommended that the
Applicant to continue to coordinate with the Town throughout the Mass DOT punnitting process
and keep the Town apprised of any potential mitigation measures within the Project area and/or at

has confumed that all engineering department comments have been adequaely addressed.

driveways to compare the anticipated tip generation and operating conditions of the proposed
facility to actual post-opening trip generation and operating conditions at the four site driveways to
verify that the anticipated t-affic volumes and operating conditions outlined within the traffic study
are in line,with actual post-opening conditions,and the tirnefiame for conducting this evaluation at
these site driveways shall be approximately twelve months from the time that Amazon opens for
full facility opemtions. To the extent that the MassDOTftnposes its own post-opening ftffic study
of these site driveways m* a manner which 'I's similar to that proposed herein,as contemplated under
Condition No. 116 herein,then the MassDOT post-operating study shall be substituted for the
requirements herein The results of any and all post-opening traffic studies shall be presented to the
