Proposed Amendment to Setback Modification-Special Permit (Article 8. Part
12, Section 195-8.
Dear Chairman Goldberg and Other Board Members:
On behalf of the Applicant, 1600 Osgood Street, LLC, and as discussed with the
Planning Board at its April 14, 2020 hearing., the purpose of this letter is to supplement
and amend the above-referenced special permit and site plan applications above to
include an additional special permit request for Setback Modification Special Permit
(Article 8. Part 12, Section 195-8.88.D), and, Article 10, §195-10.7A of Chapter 195 --
North Andover Zoning Bylaw as a result of the revised lotting proposed at 1600 Osgood
Street.
As background, we note the following:
I On or about August 9, 1600 Osgood Street, LLC filed the above-referenced
Application for Site Plan Review (Article 8. Part 3), and Parking (Article B., Part 1, 5
195-8.8.) Special Permits; and, Article 10, 9 195-10.7A of Chapter 195 of the North
Andover Zoning Bylaw for a portion of the property at 1600 Osgood Street most
recently proposed as Lot A.
2. Also on August 9, 2019, 1600 Osgood Street, LLC also filed an Application for
Large-Scale Ground-Mounted Solar Energy Systems Site Plan Review (Article 8, Part
12); Setback Modification Special Permit (Article 8. Part 12, Section 195-8.88.D), and,
Article 10, §195-10.7A of Chapter 195 of the North Andover Zoning Bylaw for a portion
of 1600 Osgood Street most recently proposed as Lot C.
3. The Applications relate to portions of real property depicted on the Town of
North Andover Assessors Maps as Map 34, Lots 17, 54, and 55. We note that since the
applications were filed, Map 34, Lot 54, which was owned by Osgood Landing, LLC, has
been merged for ownership purposes into 1600 Osgood Street, LLC by virtue of a
Certificate of Merger recorded with the Essex Country North District Registry of Deeds

in Book 1 250, Page 259, so that the entire 167.8 acres of real property at 1600
Osgood Street (depicted on Assessors Map 34, Lots 15, 17, 54 and 55 , is owned b
1600 Osgood Street, LLc, and the Applicant remains as 1600 Osgood Street, LLc.
As a result of State Department of Public Utilities DPU net metering facitit
rules, the movement of portions of the existing solar array from formerly proposed Lot
B to formerly proposed Lot c will result in the need to: 1 combine Assessors Map 34.,
Lots 15, 17, 54 and 55 into a single lot, and after the solar facilities are migrated to
the location of Former Lot c; 2 combine Lot A, Lot c, the subdivision road, and a
small portion of Lot B into a single, consolidated lot to be known as New Lot A. New
Lot A gill now consist of 57.46 acres (2,502,905 s.f. , as depicted on the attached Site
Plan.
5. Thereafter, Now Lot 5 .46 acres), and New Lot B 110. 5 acres, which lot
area has been slightly adjusted), both of which are depicted on the attached Site Plan,
would be proposed to be approved through the ANF endorsement process by the
Planning Board.
. Also note that all improvements previously reviewed to date will remain
substantially in their sane location as depicted on the it Plans.
. From a permitting perspective, the definitive subdivision would not be needed
at this time, and instead, a permanent easement would be granted by 1600 Osgood
Street, LLc over Lot A (ire the same location as the previously proposed subdivision
roadway) to provide access to Lot B via the North Access Road to Osgood Street.
8. As a result of the consolidation of New Lot A, however, the only substantive
change to permitting would be the need for an additional setback modification special
permit pursuant to S 195-8.88.D "Modification of Setbacks"). while 1600 Osgood
Street, LLc has already filed an arpplication for Setback 1lodification Special Permit as
noted above, the Applicant, in an abundance of caution, is simply amending that
special permit filing, in part, to enable a further setback special permit under these
same provisions.
. Specifically, 9 15- .88.B.2 (Dimensional Regulations) of the Zoning Bylaw
provides that large-scale ground-mounted solar energy systems shall be installed
either in the side card or rear yard and be located no nearer the street than the
building line of the principal structure.
10. By virtue of the creation of the combined New Lot A depicted on the attached
Site Plan, the solar facilities proposed to be relocated on the New Lot A would now b
closer to Osgood Street than Buildings 20 and 21. Accordingly, and in addition to the
current solar setback modification special permit previously applied for as noted
above for setbacks of the panels to the side and rear yards, by this letter, we are
supplementing and amending our application with respect to New Lot A with this
special permit request pursuant to S 15- .88.D. Note, however, that the solar energy
facilities remaining on the rooftop of both Buildings 20 and 21 will remain as is and

constitutes an accessory use alto wed by right under the use table in S 19 -8.87 Use
Regulations) pursuant to Article 8, Part 12 of the Zoning Bylaw.
1 1. The configuration of the solar panels on New Lot A is identical to the previous
configuration proposed on the former Lot C. The location of these solar facilities
remains unchanged; only the totting configuration has changed.
12. In accordance with S 19 -8.88. D. (Modification of Setbacks), the Planning
Board may modify and change the setback and other locational requirements
described under S 19 - 8. 88.13 for large scale ground mounted solar energy systems,
provided that such modification and change is granted by Planning Board Special
Permit after consideration of the special permit criteria described under S 19 - 1 .7A
of the Zoning Bylaw."
13. The Applicant, in its original Application for Large-Scale Ground-Mounted Solar
Energy Systems Site Plan Review (Article 8, Part 12); Setback Modification Special
Permit (Article 8, Pant 12, Section 19 -8,88.D), and, Article 1 O, S 1 95-10,7A ofChapter
198 of the North Andover Zoning Bylaw, did include a memorandum of lave identifying
hover the proposed Large-Scale Ground-Mounted Solar Energy System met the standards
for a special permit under the criteria described above.
1 . Accordingly, the Applicant deems that this proposed modification to the
setback criteria described above, as depicted on the attached Site Plan, complies with
the Special Permit Criteria (Article 8, Part 1 , Section 19 - .8 .D , and, Article 10,
19 -1 .7A, and accordingly, incorporates by reference, all of the materials filed in
the August 9, 2019 Application for Large-Scale Ground-Mounted Solar Energy Systems
Site Plan Review (Article 8., Part 12); Setback Modification Special Permit (Article 8,
Part 12, Section 19 - .88.D , and, Article 1 , 919 -1 o.7A of Chapter 195 of the North
Andover Zoning Blair, as well as all supplemental materials filed by the Applicant,
the Tern, including peer review, and all other materials maintained in the public
record, into this Amended Application.
15. And as noted above, the only substantive adjustment to the Application for Site
Plan Review (Article 8, Pant , and Parking (Article 8, Part 1, S 19 -8.8.) Special
Permits; and, Article 1 , S 19 -1 .7A of Chapter 195 of North Andover Zoning Bylaw is
that former Lot A is proposed to become a part of New Lot A as depicted on the
attached Site Plan.
16. In connection with the adjustments described herein, updated site plans which
reflect the proposed new lotti ng Sri 11 be fi led with the Board, i n addition to the
attached Site Plan.
17. For the reasons described above, as well as to be discussed at the public
hearing for this matter, 1600 Osgood Street, LLC respectfuLly requests than the
Planning Board make the required findings and conditions described under: Article 8,
Part 1 [site plan review]; Article 8, Part 12, Section 19 -8.88 [setback modification
special permit]; and, Article 10, S 19 -1 .7A [special permit - general], of the North
Andover Zoning Bylaw and grant the Applicant's request for approval of Large Scale
