These Special Permits for the Renovation Project were guested by 1600 Osgood Sbwt LLC,the Applicant,on behalf of the Owner, 1600 Osgood Str+eet�LL C,and its predeeesw by merger,Osgood L ,ndM L►L+ , With the e ti e crn of the Amended Setback Modification Special Permit and Common DTivevray Spwial Permit application de=Ud below,the applicadons were wed with the Pl ` gEkwd on August 9,2019. The public hearings on the above referenced applications were opened on September 3, 2019,and closed by the North Andover Planning Board on May2O,2020. The Applicant along with Hilhwood Enwrprises,L.P.,filed an application for a Common Driveway Special Permit on May 1,2020 and the public hearing on said application was opened on May 20,2020,and closed on WO,2020. The Applicant submitted a complete set of applications conrf+orrning to the requuirements of the North Andover Zoning Bylaw,which were noticed and reviewed in accordance with(Article 8,Pan 3 [Site Plan Review]; Article S,Part 1,§ 1 ' - ; #[Paddng Special Permits];Article 2.,§ 1.95-2.2. [Common v+e ay Special Permit];and,Article 10,§ 19 -103 [Special Permit- eneral],of Chapter 195"in North Andover Zoning Bylaw),and MGL+c.40A,Sec 9. The applications for Large Scale Solar Energy System.Site Plan Review,and Solar Energy System Setback Modification Special Peat were requested by 1600 Osg LLC,the"Applicant" With the exception+ofthe Amended Setback Modification Special Pear7rnit application and the Common Driveway Special Permit Application d nUd herein,the applications were:tiled with the Planning August 9,2019. The public hearing on the above referenced applications were opened on September 3,2019,and closed by the North Andover P'kunning Board on May2O,2020. The Applicant submitted a complete set of applications+confonrn' to the requirements of'the North Andover,'mining Bylaw,wbi ch were noticed and reviewed in accordance with(Article S,Part 12[Site PlanReview];Article 8,d`art 12,Sermon 19 -8.88[Setback Modification Special Permit];and,Article 10, 1600 Osgood Map 34 Lots 17,54 and 55(Ut A) Street, hearingsSite Plan Review and Parking,and Common Driveway Special Permits,and Large Scale Solar Energy System Site Plan Review,and Solar Energy System Setback Modification Special Permit 195-103A[Special Permit-General],of Chapter 195—North Andover Zoning Bylaw)and MGL c.40A, See 9. The Planning Board voted unanimously(by a vote of 5-0)to grant the Site Plan Review,Parldug,and Common Driveway Spechd Permits,and to approve the Large Scale Ground Mounted Solar Energy System Site Plan Review,as well as the Solar Energy System Setback Modification Special Permit A special permit "Issued by the planning board, as special permit granting authority,requires a vote of at least four members of a five-member board. FINDINGS OF FACTemn RENOVATION PROJECT I The Planning Board makes the foil ' findings under Article 8,Pad 3 [Site Plan Review]- owing 9 Article 8,Put 12 § 195-8.8. [Parking Special Permits]- and.,Article 10, § 195-10.7A[Special Permits-General],of Chapter 195—North Andover Zoning Bylaw. 2. The Plans have been submitted in accordance with the regula#ons,and procedures as outlined"in Article 8,Part 3,and comply with§ 195-8.15(review criteria and design guidelines),and§ 195- 103A(conditions for approval of Special Permit),as finther described below. 3. Site Plan Review and GeneraL§Pecial Permit Fin!9,W. , . The specific Renovation Site is an appropriate location for such a use,structure or condition. As Lot A i's zoned for office, industrial and other uns allowed M* the 1-2 Zoning District,Lot A i's an appropriate location for the proposed Renovation Project. The site design complfinents,the provides for sufficient tratTic,curb cut and circulation improvements. Parking will also be adequate to serve the proposed uses notwithstanding the requested reduction for the reasons described herein. 4. The Renovation Project use will not adversely affect the neighborhood for the following reasons. The buildings,which have existed'in exce;ss of 50 years,Will m" clude both existing and proposed future uses,and the buildings are complemented with appropriate landscapig and eta character of the architectural style of the buildm" gs�which have existed since the 1950's,VAH1 complement the architectwW style of existing build* located along Osgood Street.The existing and proposed uses as developed will result'in a substantial improvement to Lot A from an aesthetics and environmental perspective. The lighting plan demonstrates that on-site lighting The existing buildings are set far back from Osgood Street and adjacent properties. Ile its proposed location. 5. There Will be no nuisance or serious hazard to vehicles or pedestrians. Driveways accessing Osgood Street will be located inthe some location as will not adversely ftnpact the neighborhood. Accordingly,the proposed uses are well suited for provide for the best available sight distances along Osgood Street.The Owner Will grant a perpetual access easement over the existing North Access Road area(as defined above)which will be located on Lot A for the benefit of Lot B. The Renovation.Project is adequately and appropnately serviced by water,sewer and other utilities that adequately address the needs of the Renovation Project. Stormwater management facilities will provide adequate treatment of stormwater in accordance with applicable Is requirements. ?. In addition to the reasons described herein and as shown on the Flans and other information submitted as part of the site plan review p►roe the proposed use ls in harmonywith the general purpose and intent of this Zoning Bylaw for the following reasons. First,the location of the proposed Renovation Project is ideally suited for allowed uses within the 1-2 Zoning District to complement and build a critical mass which is fi portant to the fature redevelopment of the Route 12.E corridor in this area of North Andover. Second,the building renovations'in the current building locations wiH enhance:aesthetics and will continue to be an im ortsnt and. significant r+ev+enue-generating property for the Torn. Tbird,the off-street parking provided is adequate to serve the uses of Lot A.in a safe and effective manner. Fourth,the Renovation Project as proposed will continue to provid a job►s to the Town,along with the multiplier effect arising from the increased number of workers supporfmg other North.Andover businesses,and potentially resulting in new businesses opening along the Route 125 corridor. Lastly,the Renovation Project as shown on the Plans,complies with the ZoningBy-Law, subject to the grant of the Special Permit relief requested. For the reasons,all of`the proposed Renovation P'roJ ect i nprovements and enhancements noted herein are ha harmony with the general purposes and intent of Section 1 ("Purposes")ofthe North Andover'Zoning Bylaw. S. The ` c Impact and Access Study for Proposed Redevelopment, 1 00 Osgood t,North Andover,Massachusetts,",dated August 2019,as supplemented by a"Traffic Impact and Access Study for Proposed Redeveloprnent� 1600 Osgood Street North Andover,Massachusetts,"dated March,2020(collectively,the"Traffic Report"),both of which were prepared for Hill wood Enterprises,L.P.by Engineering .nvironmental Services,as supplemented(the 'Tmffle Report") a.. the location and number of curb cuts proposed is the same as the existing curb cuts,and has been reviewed and is appropriate for the proposed use. b. the driveways have been designed to provide sight lines that exceed requirements for safe intersection sight distances. c. any proposed landscaping and signs in the vicinity of'the site driveway will be located sufficiently back from Osgood d.Street so as not to Imp ede these sight di and turns into the site driveways will operate at appropriate levels--of-service(LOS)during the peak-hours,and exitmog movements from Lot A driveways will operate at an appropriate LOS during thepeak-hours. d. There are approximately 5,170 parking spaces servy cxng the existing uses,which excludes the existing asphalt area occupied by the on-site,solve facilities. c. Access to the Site is provided by two un-signalized faUrmovement driveways and two sigrialized full-movement driveways on Osgood Street. The northernmost signlized driveway curmntly operates in flash mode and-f m bons as an un-signaUzed driveway. d. The project proposes to modify the acom driveways as follows `see Site plan in Appendix A.) 1. The northernmost sigmdized driveway,which will sham both hal irnent center employee and truck access and egress and also for the relocated sow way,will be updated to normal tmffic signal operation. ii. The southernmost signalized driveway will be exclusively dedicated to fuMilment cent employee access and egress. iii. To maintain acceptable or no-build(background)levels of service the following off-site improvements are recommended(see Cone -She Improvements Plan,dated July 19,2019): i. The allocation of parking by use is depicted on the parldng table,as well as the breakdown of parking and loading spaces,as depicted on Plan CS 100►of the Plans. 1 . .Although the number of proposed parking spaces is less than what is pro,*eeted to be required for the uses on Lot A,sufficient parking spaces are provided on the Renovation Site to substantively satisfy the requirements for currentl6 ay proposeduses,and a Special Permit resulting in 0 adjustments to prarxmg requirements is appropnacte given the van/mg peak demands of the various uses on the Renovation Site,and in conjunction with such adjustments,the parking at the Renovation Site will not cause a detriment to the surrounding neighborhood since the proposed parking program for the Renovation Site will not in+cr a traf fie congestion or queuing or otherwise result in unsafe conflict of motor vehicle and pedestrian e,as fitrther d.e cni ed M the Traffic Report. A proposed future use such as a cag andlor fitness center would account for future parking spaces,but since the predominant users of those facilities would be the occupants of Buildings 20 and 21,it has been concluded that such uses would not likely require any additional parking spaces,or create any new demand for parking. 13. The purpose of the Applicant's requesW relief from,certain pwarldng standards'is to reduce the number of park' spa to 1,508 spaces where 1,620►parking spaces are required,representing less than an 8%reduction of the total number of spaces where up to a %reduction may be otherwise allowed under the Table of Parloing Requirements in§ 195--8 A. Further,the Applicant is reducing the number of loading spaces to 6 spaces where 9 loading spaces are required,and where up to a 35°l reduction may be otherwise allowed under the Table of Loading Requirements in§ 195-8.5.E. 14. Because it is not necessary to have all loading facilities located on and attached to the existing buildings,the Applicant has requested a Special Permit for a modification of loading design standwds,in accordance with.§ 195-g.g.D.2.to enable up to 4 of the 6 loading facilities to be located adjacent to the building on the Renovation Site as depicted on the Plans rather than attwhed to a building. While the loading spaces attached to the buildingwill meet the requuv.ments of having an opening In a building not less than 1.0 feet in wig and nine feet in height,including a plartform,for loading and unloading goods,m handise or other materials, the remainder of`the loading areas will not be attached to the building but Will comply with all other design standards required for loading facilities,each of which will have InM" uIn dimensions of 12 feet wide,25 feet length, 14 feet-in height clearance,and shall be locateA, arranged,and of sufficient number to allow service by the type of vehicle customarily expected for the use while such vehicle is parked completely clear of any public way or sidewalk. Building 20 and 21 are existing,occupied structures for which Owner regularly seeks permits, approvals and certificates of occupancy for work to be perfbrmed unrelated to the Renovation Project('"Ord' Course Permits"). FINDINGS OF FACT—SOLAR PR03ECT 24. The Planning Board makes the following findings ceder(Article 9,Part 1.2[Solar Energy System Site Flan.Review];Article 8,,part 1.2,Section 195-S. S[Solar Energy System.Setback Modification.Special Permit];and,Article 10, § 195-1 o.7A[Special Pamit general],of Chapter 195 of Chapter 195 North Andover Zoning]Bylaw with regard to the Solar Project on the Solar Site. 25. The Flans and applications were complete,and were submitted,in accordance with the regulations and Procedures as outlined in Article S,Fart 12,§ 195-' ." 5 and complies with 195- . 9(review criteria and design guidelines),and§ 195-10.7A(conditions for approval of Special Permit),exceptas modified by Special p'ennit as firther described below. 26. General S +dial Pe nt `` din Setback Modification. As the'Solar Site is zoned to allow forLarge-Scale Ground-Mounted Solar Energy Systems ms in the 1-2 Zoning District,,the Solar Site is an appropriate location for the proposed Solar Project. The Solar Site design compliments the surrounding uses and provides for sufficient vwffle,curb out and circulation improvements,as well as sufficient buffering and screening.Parking will also be adequate to serve the proposed use. 27. The Solar Project use will not adversely affect the neighborhood for the following reasons. First,a Solar Energy System currently exists at 1600 Osgood Street,and the Applicant is reloc at"Mg a portion of such Solar Energy System to the Solar Site in order to accommodate the redevelopment of Lots A.and B. Second,the Solar Project meets all+ofthe performance standards for Large Scale Ground Mounted Solar Energy Systems. 'Me Solar Project as developed will result in a substantial improvement to the Solar Site:from an aesthetics and environmental perspective,will increase the development opportunities for the Property as contemplated by the Board when it originally approved the existing Solar Energy System,and 9 Bk 16635 Pg157 #34284 1600 Osgood Street,Map 34 Lots 17,54 and 55(Lot A) Site Plan Review and Parking,and Common Driveway Special Permits,and Large Scale Solar Energy System Site Plan Review,and Solar Energy System Setback Modification Special Permit will not adversely u`npact the neighborhood. Accordingly,the proposed use is well suited for its proposed location. 28. The Solar Site driveway will be located on a segment of the North Access Road,and is located to provide for the best available sight distance along Osgood Street while reducing the need for a now curb out that could have otherwise required a wetlands crossing. The facilities have been minim=conflicts and to maximize efflcimcy in layout leading to the des' sde designed to 'm IP of and efficient mbgress to and egress from the Solar Site for limited vehicular traffic. Solar Site unprovements have been designed to UUM=* M* 0 on-site and off-sfte safay. There Will be no nuisance or serious hazard to vehicles or pedestdans.For additional detail pi case refer to the is Traffic Impact and Access Study as defined at The end of this decision. 29. The Solar Project is adequately and appropriately serviced by utilities fliat adequately address the needs of the Solar Project. Stormwater management facilities Will provide adequate treatment of stormwater-in accordance with applicable requirements. 30. In addition to the reasons described herein and as shown on the Plans and other information submitted as part of the Site Plan Review and Special Permit process,the proposed use is'in harmony with the general purpose and intent of this Zoning Bylaw for the follow M` g reasons. First,the location of the proposed Solar Project is a relocation of a portion of an existing Solar Energy System,and as such,continues to be ideally suited as an allowed use within the 1-2 Zoning District to complement the future redevelopment of the Route 125 corridor M" this area of North Andover. Second,the landscap'I and other screening,,combined with the base elevation ng of most of the Solar Energy Systems being lover than.Osgood Street,Will enhance aesthetics. Third,the proposed Solar Project will continue to be an important revenue-generating property for the Town. Lastly,the Solar Project,as shown on the Plans,complies with the Zonm' g By- Law,subject to the Special Permit relief requested. For these reasons,all of the proposed improvements and enhancements noted herein are in harmony with the general purposes and intent of the North Andover Zoning Bylaw. 3 1. Pursuant to§ 195-8.88.B(2),all Large-Scale Ground-Mounted Solar Energy Systems shall have a side and rear yard setback of at least 75 feet;and shall be installed either in the side yard or rear yard and be located no nearer the street than the building line of the principal structure. 32. Since the Solar Project constitutes a Large,Scale Ground-Mounted Solar Energy System,the Planning Board finds that the placement of the improvements as shown on the Plans,includ, Ing Ing but not limited to the modification of the side yard setback to 40 feet where 75 feet is required, and the modification of the rear yard setback to 26.5 fW where 75 feet is required,is appropriate because:(a)from an aesthetics perspective,the Solar Energy System improvements are being moved as far away from Osgood Street as reasonably possible in order to rn'mu"nize visual impacts along Osgood Street;and,(b)because a significant area of existing paved surface exists currently on the Site,including within setback areas,the location of much of the Solar Energy system improvements onto existing paved surfaces as reasonably possible and further away from wetland resource areas,serves to improve conditions from an environmental perspective and xninianm s impacts to existing open space and other green areas on.the Site. Moreover,since the reconfiguration of Lot A depI'cW on the Plans,the Solar Energy System proposed to be relocated on the Solar Site would now be closer to Osgood Street than Buildings 20 and 21, Note,however,thd the Solar Energy System remaining on the rooftop of both 11 Buildings 20 and 21 on the Renovation Site,will remain,as is,and constitutes an accessory use allowed by right under the use table in§ 195-8.87 Use Rogtdations)pursuant to Article 8,Part 12 of the Zoning Bylaw. 34. The configuration of the Solar Energy System on the Solar Site is identical to the previous configuration proposed on the former Lot C. Acoordingly,the location of the Solar Energy System on the Solar Site remains unchanged;only the lotting configuration for Lot A has changed. 35. The proposed setback and other locational modifications are depicted on the Plans,and the Applicant meets the Special Permit criteria for the reasons described in this decision. 36. Minimal and sporadic traffic will result from the Solar Project,and access to the Solar Site will provide for adequate maneuverability for fire and other emergency vehicles,as well as other vehicles and persons serview" g the Solar Site,as conditioned herein. 37. Adequate access to mh structure for fire and emergency service equipment is provided,as conditioned herein. 38. Screening,landscap* and othuses lave been micorporated into the design so as to- Mg er meas rnmimize visual intrusion by controlling the visibility of parking,storage,or other outdoor IL service areas viewed from public ways or premises residentially used or zoned,all as depicted on the Plans. 39. The Plans illusvate that the Solar Project has been designed so as to minunize the volume of cut and fill,the number of removed trees ftt are six inches or more in caliper,the area of wetland vegetation displaced,soil erosi1014 and threat of a r* and water pollution. 40. The Plans provide for adequate stormwater management and other utilities consistent with the functional requirements of the North Andover Stonnwater Regulations,Department of Environmental Protection Massachusetts Stormwater Management Handbook as revised). ID i 41. The,Applicant easu licant has undertaken all reasonable mres to minimize obstmetion of any scenic views from publicly accessible locations. 42. Although the improvements to the Solar Site will not need a sewer connection,the Planning Board understands that a New Town Sewer Pump Station as a part of the New Sewer(as defined above)is intended to be installed on the Solar Site as a part of the Town's proposed new sewer line improvements to be extended in Osgood Street and extending from the Lot A southerly to Sutton St (the(the"New Sewer Linel. The d oWls of the Now Town Sewer Pump Station will be subject to separate approvals being obtained by the Town of North Andover for the New Sewer Line. As part of the MassDOT permit application process,the Applicant will need to cw*that the project does not meet or exceed any review thresholds under 302 CMS.11.00 MEPA Regulations(see MassDOT correspondence dated January 31,2020 from Paul D.Stedman,District Highway Director). 59. Accordingly,the Applicant requested an advisory opinion as to whether a MEPA review is requit-ed. The MVA Offim detemined that UEFA Review is not required for the,Proj�ect.-. including the project proposed on Lot B. (See letter,dated May 8,2020,to David Hewett, Epsilon Associates,from Tori T.Kim,Assistant Secretary,MEPA Office). 60. Once both Lot A and Lot B are created via the endorsement of an Approval Not Required (ANC.)Plan,the common driveway to be created M* accordance with the common driveway provisions described under Article 2,§ 195-2.2.,will service both Lot B and the Solar Project via access from Osgood Street,and will be regulated by a recorded maintenance agreement. The"'P'rojectOwner"or"Owneej refers to the person or entity holding the fee ingest to the title to the Locus from time to time,which can include but is not limited to the Applicant,developer, and any firture owner. SPECIAL CONDITIONS 70. Recognizing the necessity of the Applicant's need to continue to construct,maintain and operate Buildings 20 and 21 for its existing,and future tenants,as well as to commence:, a abatement; b related demolition of certain existing buildings and structures either being removed or partially demolished on the Site; c the establishment,of"replacement utilities to support demolition and se ion of builIs der systems including selective ' a trenching and site work associated with new utili es and nutting and capping old utilities,or relocation of utilities, to support demolition and segregation activities noted above; d all work associated with the disconnection,movement,and installation of existing solar paneLs,and related infi s ructur improvements f`r rm existing round-mount d and rooftop locations on proposed Lot B to Lot ; .,and,(e)work associated with installing new boilers,chillers,and electrical equipment which ma ►requm a build*pemit pfior to renovation work for Buildings 20 and 21,the Applicant is not prohibited by this decision to continue its ordinary operations including obtaining Ordinary Course Permits(as defined in Finding of Pact# and, in addition,to commence and complete such work described above and such other activities necessary to facilitate such Site prepamflon Ivor; for the P'rcject notwithstanding the conditions described below,provided : i)the Applicant notifies the Building Inspector,and.PlanIng Department ent in advance of`such work,(ii) such savor is ormed in ao=danc+e with all applicable approvals,and, iii a demolition perinit is obtained from the wilding Inspector to demolish,or partially demolish,such buildings and other structures(collectively,including Ordinary Course Permits,the"Allowed Prelimiaryr Wort '' . 71. The Applicant shall supply a copy of the approved MassDOT permits necessary for access and construction of the Project to the Planning Department, In the event M=DOT requires a. material change(as deemed by the Planning rector)in the access/egress or other details depicted on the Plans and/or Conceptual -Site Improvement Plan dated July 1 , 019 (including,but not["united to details listed in Findings of F --Renovation Project#8 and#9 in. this dec ia►n ,the Applicant shall submit revised Plans to be reviewed in accordance with the process described in Section 1.9 -8.17(Revisions to Approved Site Plan). 75. The Applicant shall provide Final plans to the Planning Department when Route 125 roadway geometry and alignments are coordinated with MassDOT. 76. The private sewer pamp stafion shown as the Loot A Pump Station on the Renovation Site depicted on the Plans shall remain the property of the Applicant and/or Owner in perpetuity. An Emergency Readiness Ulan shall be developed for any chmmstance'in which the station is inoperable for greater than.24 consecutive hours. A copy of said Emergency Read m* ess Plan shall be submitted to the Planning Department prior to the commencement of operations of the Lot A.Pump Station,unless the Applicant provides evidence of an existing plan prepared for the Greater Lawrence Sanitary District. 77. The New Sewer improvements,including the New Town Sewer Pump Station,which are not part of this Project,but are intended to be located on the Solar Site shall be the property of the Town of North Andover in perpetuity,and an easement;as depicted on the Plans,shall be granted by the Applicant to the Town of North Andover to enable the construction,location,use, improvement,repair and replacement of the New Sever,including the New Town Sewer Peuznp Station. 7 g. Once the New Sever is opmtional,the Ap►pli t shall apply to the Town's Department nt of PublicWorks"Water&Sew erep► ent for permission to connect into such New Sewer,and subject to any other applicable approvals,thereafter connect to the New Sewer in accordance v►ith the requirements of the Department of Public Works'Water&Sewer Division. Until the later of either such time as the New'Surer is operational or after the Building B Operational Start Date,the Applicant shall maintain its connection to the Existing Sewer,subject to the rights contained within the GLSD Agreement. 79. All stormwater best management praofices shall be maintained as specified M the Long Term Pollution Prevention and Operation and Maintenance Plan(O&M). Evidence of mainwriance of the stortriwater management system shall be provided to the Planning Deparftnent on an annual basis by a Registered Professional Civil Engineer or other qualified professional post construction. The first report shall be submitted one year after the first stormwater structures goes on-line. 86. All permanent dumpsters shall be screened with fencing and plantings as shown on the Plaw. 97. The Owner and/or its tenants shall not place banners or other like sips on any structure or erect structures to hold such advertising devices unless othem*se approved by a Town Board or Building Inspector. 8. Any revisions to the approved Plans shall be submitted to the Planning Director for review. In consultation with the Director of Planning, the Applicant shall designate an Independent Environmental Monitor.The Envm* mnental Monitor shall read,sigA,and return.to the PlannM9 Director the Letter of Agreement for Independent Monitors.Ilse Environmental Monitor must be a Hable upon four (4) hours' notice to inspect the Site with the Planning Board des' ated val ign official. The Environmental Monitor I make weekly inspections of the Project provide monthly reports to the Plwm* Departraent throughout the duration of the Project and detail any Ing areas of non-compliance and corrective actions. The Environmental Monitor will also provide reports following heavy rain events. 101. Prior to any or; commencing on-site, the Applicant sW1 meet with the Site contractor, the Independent Construction Monitor, Independent Environmental Monitor, and the Project engineer/wetland scientist to discuss a Construction Sequence/Phasing Plan. In addition to updating the Stonnwater Pollution Prevention Plan and Construction Sequencing Plan, the Applicant shaU address when the underground stonnwater num tsystem BW&s go on-line relative to the M' stallation of pavement and building foundations,catch basm* s and related piping- A detailed and dated sequence of constmctiori,including the installation off'. ,di entationl+erosion control devices, consbwdon of temporary sedimentation basins and swales, reta" ' wall construction,drainage installation,building construction,and all other work planned through final stabilization.Any changes to the sequencing plan shall be approved by the Plann Ing' Board or its designated agent. 102. At least 30 days prior to the start of land disturbing activities,the Applicant shall provide to the Planning Department for review and comment a copy of its Stonawater Pollution Prevention Plan (SWPPP)prepared m* consultation with the Applicants' site contractor(s)and Project engineers. The SWPPP shall be prepared M accordance with the US Environmental Protection Agency's Stormwater Construction General Permit (USEPA, 2017), as amended, and related Wanoe gua document entitled "Developing Your Stomwater Pollution Prevention Plan: A Guide for Construction Operators!" The SWPPP shall build upon the Draft Stonnwater Pollution Prevention Plan and Construcfion Sequencing Plan referenced herein and the approved sequence of construction referenced in Condition#101 above. 103. In consultation with the Director of Planning,the Applicant may designate a single person or firm to complete the duties of both the Construction Monitor and Environmental Monitor for the Propmty if the shale person is cerffwd as a wetland scientist, and either has a Construction Supervisor License and/or is a Massachusetts Registered C Wit,Engineer. 104. The submittal of the plans is for informational purposes only. The Applicant must apply for and receive a building permit to be issued for the applicable retaining walls on the Site. 106. The Long Term Storm water Operations&Maintenance Plan Compliance and Certificafion Statement approved'in the Stormwater Management RWrt,as the same may be amended by the Wetlands Order of Conditions,shall be signed ed by the owners of Lot A and Lot B,and a copy 190 shall be submitted to the Planning Department. 107. The Applicant and/or Owner shall secure and long term third Pam contract or other qualified equivalent with an industry specific tWued and licensed professional capable of operating,inspectin and mainudning the stormwater management system.A copy of the executed third party cKmb=t or equivalent arrangement shall be provided to the Planning Department. 108. Any and all such cont=twl an-angernents shall be added to the fwal Stotmwater Management Operations and Maintenance Plan,as an addendum with continual updates,bus"mess registrations,certifications and proper insurances, as applicable. 109. The hauling route for the import and/or export of earth materials and demolition debris shall be approved by the Inspector of Buildings and the Operations Division Co ander(North Andover Police Department). All public ways are to be kept clean and free of any dirt or debris associated with haul*activities, PRIOR TO THE ISSUANCE OF A BUILDING PERMIT FOR LOT A BUILDING RENOVATIONS Except for the Allowed Preliminary Work described above,the followig conditions must be satisfied as Precondmons to the issuance of a building permit for the Bui*ldm* g 20 and 21 Renovation Pro3ect: I 11. A copy of those local,state and federal permits required for Solar Energy System installation must be submitted to the P ing Department. 115. The plans filed with the building permit application for the Solar Project shall address the following requirements to the satisfaction of the Fire Department: a. Plans shall be provided which demonstrate dua fire protection systems be installed'in accordance with MGL 148,527,CW 780 ChM,-and, b. Plans shall be provided that provide for adequate Site access for Fire Department apparatus and equipment in accordance with 527CMR Ch 18.['Desiga Standards 3. Safety%,and, c. DURING CONSTRUCTION 116. Dust mitigation must be performed weekly,or more frequently as directed by the Planning Director, throughout the construction process. The Site must be kept clean and swept regularly. 117. Any areas for sbockpiling of materials(dirt,wood,construction material,etc.)must be managed in accordance with the Wetlands Order of Conditions. 118. Twenty four hour emergency contact information and Owner's information shall be posted in a common am on a permanent sign. This information shall also be provided to the Planning,Police, Fire and Building departments. 119. Construction traffic associated with the Pro�ect shall be reguhded by the Inspector of Buildings. All construction traffic shall access the Site via the Ward Hill connector and egress the Site traveling towards the Ward Hill connector.Any deviation from the approved route and/or scheduling once established shall require proper notification and approval from the Inspector of Buildings. Construction traffic shall be defined as large trucks haul*mg earth moving equipment, dump trucks,trucks haW'1119 building matexials,,cement trucks,and contractor's vehicles larger than panel trucks. It shall be the developer's responsibility to inform all oonbwtors, subcontractors,vendors,and workmen of the restriction. 120.
