HomeMy WebLinkAbout114 French Farm Road DOA Negative Determination - Permits - 114 FRENCH FARM ROAD 5/13/2026 0 CONSERVATION DEPARTMENT Community Development Division NEGATIVE #3 DETERMINATION OF APPLICABILITY FINDINGS &SPECIAL CONDITIONS 114 French Farm Road,North Andover At the May 13,2026 public hearing,the North Andover Conservation Commission(NACC)voted to issue a Negative#3 Determination of Applicability approving the project at 114 French Farm Road,based on its findings below and subject to compliance with the conditions listed below. The work includes:Installation of 410 feet aluminum fencing around the perimeter of the backyard.TI-ds fence shall consist of one single gate and two double gates. One double gate shall be located in the rear to provide access, should anything go over the fence and need to be retrieved. All work shall be done by hand,and no dumpster or vegetation removal shall be required.The closest point of work shall be within existing lawn area,located just outside of the 25'No Disturb Zone associated with the Bordering Vegetated Wetland to the rear of the property. Distances to wetland were measured in the field by Conservation staff. Prior to construction,erosion controls (8" straw wattle) shall be installed and staked according to the instructions of Conservation staff. 2. Wetland markers mounted on 4x4 pressure-treated posts or other weather-resistant material(cedar or granite posts) shall be installed along the entire edge of the 25-foot No Disturb Zone,evenly distributed at 30-foot intervals as approved in the field by Conservation staff. 3. No mowing or vegetation removal shall occur within the 25-foot No Disturb Zone. 4. A pre-construction site inspection shall be scheduled with the Conservation Department and the contractor to review erosion control installation and project scope 5. A post-construction site inspection shall be scheduled with the Conservation Department to verify compliance and approve removal of erosion control The applicant,and their contractors are advised that NO other work on the properly that is within the 100- foot buffer zone is allowed under this permit. Appeals The applicant, owner, any person aggrieved by this Determination, any owner of land abutting the land upon which the proposed work is to be done, or any ten residents of the city or town in which such land is located, are hereby notified of their right to request the appropriate Department of Environmental Protection Regional Office (see ��urf&)to issue a Superseding Determination of Applicability. The request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee and Fee Transmittal Form (see Request for Departmental Action Fee Transmittal Form) as provided in 310 CMR 10.03(7) within ten business days from the date of issuance of this Determination. A copy of the request shall at the same time be sent by certified mail or hand delivery to the Conservation Commission and to the applicant if he/she is not the appellant. The request shall state clearly and concisely the objections to the Determination which is being appealed.
